Press Reduces Torture Investigations Into Partisan Warfare

News that President Obama is open to having an independent commission investigate the use of torture during the Bush years is undoubtedly the story of the day, with implications extending back to the previous administration and far into the future.

In the aftermath of the president's statement, however, the preponderance of attention has been spent on political minutia as opposed to the policy details. The media, in particular, focused almost exclusively on two specific angles: had Obama cowered to those liberal proponents of prosecuting Bush officials, and had he contradicted his own administration in expressing openness in doing so?

In the process, the issue of launching an investigation -- which would have to be bipartisan in nature for Obama to support it -- was reduced into an overtly partisan and cynical frame. Issues of justice and morality boiled down into "the left's" influence compared to "the right."

The mood was set even before White House Press Secretary Robert Gibbs came to the podium to talk about the president's remarks. "There does seem to be a little bit of a reaction to how this was received on the left," said Chuck Todd, White House correspondent for NBC. "Frankly this feels like a political food fight now. Vice President Cheney on one side, President Obama on the other. The hard left, the hard right, fighting over this in the blogosphere. When he talks about - he fears the politicization - that may be too late."

It was continued well into the briefing, where MoveOn.org and two Democratic Senators were trotted out as suspected catalysts for Obama's willingness to investigate.

"What changed over the last 24 hours?" asked CNN's Ed Henry. "Because yesterday you were flat in saying that we're not going there, as Rahm was on Sunday. And in the last 24 hours we've seen groups like MoveOn.org on the left come out and write a petition to the Attorney General saying they want accountability from the Bush administration. Is this an example of this White House giving in to pressure from the left?"

"I don't -- I have not, and I doubt the President has been on moveon.org in the last 24 hours, so, no," responded Gibbs.

Later, another reporter asked whether comments by Sens. Diane Feinstein and Russ Feingold pushing backs on Emanuel's statement "have some influence on what the president said today?"

"Not that I'm aware of," Gibbs responded. "No."

It was the simplification of a complex legal and political matter that even the folks being credited for moving Obama's hand scoffed at.

"Torture is illegal under the laws of our nation--this is not a question of left or right; it's a question of America's moral leadership," Justin Ruben, Executive Director of MoveOn.org Political Action, said in a statement to the Huffington Post. "The only way to be certain that this never happens again is to investigate, and prosecute the leaders responsible, and today our members joined a growing chorus of voices asking the Attorney General to do just that."

Indeed, five questions into the hour-long presser, Gibbs had been asked five separate times whether Obama had shifted his position. In one particular sequence, he was pressed in rapid-fire succession whether the president had "learned anything since those previous comments," whether he was saying "there was absolutely no change in policy today," and, for good measure, whether the president has "changed his policy today?"

To the fourth estate's credit, Obama did seem to be contradicting members of his own staff. Whereas the president said on Monday that he wanted the Attorney General to make the determination on prosecuting "those who formulated those legal decisions" on torture, his chief of staff insisted on Sunday that, "those who devised the policy... should not be prosecuted..." Moreover, in insisting that it was not the president's purview to weigh into the judicial debates over who may or may not have committed criminal activity during the Bush years, Gibbs did seem to invalidate Obama's prior statements that those officials who were merely following orders didn't do anything criminally wrong.

To these points, Gibbs largely floundered, sticking to the talking point that Obama had not changed tracks, favored looking forward not back, but would prosecute crimes when they were exposed. He was correct in one respect: the issue is largely not in the White House's hands. Congress can and likely will create the committee to investigate the matter, with Senate Judiciary Committee Chairman Patrick Leahy trying to take the lead on that front. And the Justice Department - independent of the president - will be the place where any prosecutions originate.

"The president believes and was assured by the Department of Justice that those who have acted in good faith on what they believed was legal won't be prosecuted," Gibbs stressed. "The president still believes that."

The writing in this piece was HORRIBLE, though it improved midway to being at least competent, thank goodness.

These shortcomings aside, this is a terribly important topic and we can see already the media lining up to as.sault. the very idea of prosecutions - we knew this was coming.

But with statements like this, "The president believes and was assured by the Department of Justice that those who have acted in good faith on what they believed was legal won't be prosecuted," what are we to think of "ignorance of the law is no excuse"?

The less than intelligent also seem to have trouble understanding that "those who formulated those legal decisions" and "those who devised the policy... should not be prosecuted..." are not necessarily the same people (though we can understand if it happens that they are.

But all that is noise to the question of investigations and prosecutions. As was correctly observed, "Congress can and likely will create the committee to investigate the matter, with Senate Judiciary Committee Chairman Patrick Leahy trying to take the lead on that front. And the Justice Department - independent of the president - will be the place where any prosecutions originate." But, these two ideas are completely at odds - or at least usually are so! If a committee is formed to investigate, they USUALLY provide immunity for testimony and THAT will kill the whole prosecution thing.

Duh.

To paraphrase Dicken's Mr. Bumble: "The media is a ass!" -especially the WH press corps.

The left helped elect Obama - their issues are supposed to be his so it is hardly "giving in"; that's why we vote for someone. The truth is there's not much "left" left in this country, just a "center" trying desperately to right some of the wrongs of the last 8 years.

And to Sam Stein: your article mentions that "MoveOn.org and two Democratic Senators were trotted out as suspected catalysts for Obama's willingness to investigate" like it is three people. MoveOn.org is a huge group of people united in a representative voice...you should have said, "two senators and thousands of people's views were trotted out!"

The White House reduces torture investigation into political theater by giving mixed messages from Gibbs in his presser and then his boss the next day, all to control the news cycle over the fact that Geithner is clueless and the watchdog group is hot on his heels!

This is a media spin that is impossible to fight. Just strap yerself in and enjoy the ride! The media, left and right, are palpably licking their chops over this one. It combines all of the best elements of the biggest political stories of the past 2 years, and adds some good, old-fashioned Jerry Springer-esque appeal for good measure.

Hey...it's OK by me! Maybe this is what it'll take to get Jaws Palin outta my news coverage...finally!!

I absolutely agree. This will definitely be, and in fact already is, a major spin operation. The question is, how frenzied will it be, and how long will it last?

I too will enjoy the ride, and I am sympathetic to Gibbs and others who are telling it like it is to a media machine that only wants to feed their spinning adventure.

"Falling on deaf ears" is a phrase that comes to mind though perhaps it may be better described as partial deafness paired with selective twisting of what IS being heard.

The bush administration was full of incompetent croney's, Misfits, and criminals. The media, was full of incompetent fools, wannabe journalist, and a disgrace to their so-called profession. The Justice Department was saddled with incompetent leaders for the purpose of fraud, deception upon the american people.
The bush administration was the worst, incompetent, criminal enterprise in US History. This group of criminals knew fully well what their mission was and covered their backsides at every step, and the media became the mouthpiece for the regime, and continue to be at the present time.

That's the same press that were cheerleaders for the Bush administration during their years in power. So, do you really expect anything different now? It would be great if that were true! That's what I believe the most of us are hoping for.

However, I'm not holding my breath. We saw the same thing circa 70 years ago.

The democratic system of the USA is held hostage by a foreign power, Israel, and a tiny coterie of deeply corrupt leaders and businessmen. Only the people can order the sewers to be cleaned, but the people have been relentlessly "educated" to believe that America is always right and questioning the system is treason. I think it is a big mistake to think that Obama is going to give a green light to Eric Holder. Whats more important to you getting Bush or getting your programs in place! Last week Obama announced that contrary to campaign promises he would not revisit NAFTA. During the campaign he swore to get concessions to make NAFTA more American worker friendly, now he says never mind. When you get over the Bush's you are going to look up and say, I thought he'd reverse fisa, wiretapping, the war, gay marriage and NAFTA and now I find out he does not differ from Bush on any of these. . I realize that he has a lot on his plate and needs time but so far i would think the right is happier than the left.

I have a son serving in Iraq and I pray that he is never captured, but if he were, I would hate to think what we have done to detainees and prisoners in this war could be done to him. George Bush and Dick Cheney and all their Neocon ilk who advised and sanctioned torture should be indicted, tried, and put in prison for war crimes. May they, at the very least, live their remaining days in the infamy that they deserve. There is no apology or rationalization that can ever make me believe anything less than that they are just evil people, consumed with their delusions of power. They have the blood of many on their hands.

Obama has made enough concessions for a life time to the right. Hiring Rahm Emmanuel and leaving out Howard Dean should have been enough. There is no appeasing the beast.
