Judy Shepard appeared on last night's edition of the Rachel Maddow Show to discuss the recent expansion of Federal hate crimes legislation and the remarks made by North Carolina representative Virginia Foxx, who, in testifying against the expansion, suggested that Shepard was merely the victim of a robbery, and that suggestions that he was targeted because he was gay were all a part of "a hoax that continues to be used as an excuse for passing these bills."

Shepard responded thusly: "Well, you know, attacks of lesser consequence, I guess, have been said about Matt since the beginning, and in 2007 when it passed the House, the same sort of vitriol' was spoken from the floor as well. I did not ever expect it to be called a hoax. Anyone who has done research into what happened to Matt knows it was a hate crime, although technically we couldn't prosecute it that way because there was no hate crime law in Wyoming and no Federal hate crime law protecting sexual orientation. So we couldn't call it a hate crime, but it was."

Told that Foxx had later "clarified" her remarks by saying that "hoax was a poor choice of words," Shepard wasn't particularly mollified. "It's apologizing for semantics, not her ignorance."

On the matter of how the expansion may assist the victims of other hate crimes, Shepard offered some specifics: "How it will change in Matt's case in particular, in Wyoming, because the federal law did not cover sexual orientation as a protected category, Laramie was not eligible for Federal resources...they had to furlough four employees to pay for the investigation and subsequent trials. That's not right. That's not right...This is an amazing advance of what already exists."

Also worth noting is Maddow's excellent elocution of the rationale behind hate crimes legislation, which intentionally guard against miscarriages of justice, but are often interpreted as political correctness run amok:

MADDOW: The concept behind this kind of legislation is often misconstrued but here's the deal as I understand it. The idea is that the federal Justice Department can get involved in a case to help local authorities or even to take the lead on a case if need be, in prosecuting individual serious violet crimes and murders in which the victim was selected on the basis of race, color, religion, national origin, sexual orientation, gender, gender identity, disability - the idea that crimes like that are intended not only to hurt or murder an individual, but to terrorize an entire community, and so there is a national interest in ensuring that those crimes are solved and prosecuted, particularly if local law enforcement doesn't want to because they are blinkered by the same prejudice that led to the crime in the first place.

I truly do hope this will lead to Virginia's Foxx's dismissal from the congressional seat she occupies. I am a constituent of the North Carolina Fifth District, and I am determined to join my fellow citizens in seeing Foxx sent out on her backside in all the complete disgrace she so richly deserves.

Please join us in North Carolina in demanding Foxx's dismissal by dialing her offices and complaining loudly about her inexcusable conduct.

It's a shame that Foxx shows such little compassion for a fellow AMERICAN and a fellow human. Put politics and your view of a particular issue aside ... how thoroughly insensitive is it to not understand FULLY the circumstances of another person's demise, in this case MURDER, and grandstand about it. How can someonenot have an ounce of compassion that this was someone's son. Whether he was killed in the act of someone committing a roberry or a hate crime, to marginalize the death the way that Foxx did is so very inhuman ... especially in such a public way. I sincerely hope that people across the country remember this in 2010 when she's up for re-election.

By the way, it would seem that yes, she is this type of person on a regular basis. She voted against the extension of the Voting Rights Act and was one of only 11 Congressmen to vote against aid to Katrina victims.

Wow - so many people missing the SALIENT POINT. Hate crimes legislation is important because the victims are RANDOM, selected for membership in a particular group and the acts there fore, if unprosectued, terrorize everyone in that group, because they could also be selected on the same basis.

Exactly. People miss this point because hate-crime legislation has been wrought into a tool with which to fram any supporters of the legislation as wanting to police people's thoughts by the right. Too often, people merely believe what they hear instead of taking the time to look it up themselves.

It's only more of a crime when you kill them because their gay. Most people don't kill straights because they are straight, but they kill gay people because gay people somehow or another, with all their love and parades, threaten them. That's the distinction, but evidently you missed it.

Excuse me, mam/sir, when a straight person purposely kills a gay man or a lesbian woman just because they are homosexual, it is not only an act of murder but also an act of grave discrimination and bigotry. And based on studies on crimes like this, they were done with the express intent to terrorize the entire gay and lesbian community. So yes, additional legislation is required to protect us LGBT from violent straight people. We are the victimized sector, not yours.

For someone who seems to harp (And I do mean harp) on issues of Constitutionality, she went straight from local law enforcement to the FEDS! There are a few levels of law enforcement in between, not that it maddows to you crusaders!
