I Like ItI Don’t Like It

With his chief counsel and chief of staff by his side, Barack Obama made a surprise visit to the White House press briefing room on Friday, officially announcing the retirement plans of Supreme Court Justice David Souter and laying our what kind of appointment he would make.

With no advanced warning, even for Press Secretary Robert Gibbs, the President took to the podium to read a brief set of prepared remarks. He had just gotten off the phone with Souter, he announced, and wanted to say a few words about the conversation.

Watch:

"Throughout his two decades on Supreme Court, Justice Souter has shown what it means to be an independent and fair minded judge," said Obama. "He consistently defied labels and rejected absolutes, focusing instead on just one task: reaching a just result in the case that was before him."

As for making a choice to replace him on the bench, Obama laid out broad markers. Promising to "consult with members of both parties across the political spectrum," the president said he would like to see "our new Supreme Court justice in time for him or her to be seated by the first Monday in October when the court's new term begins."

Here are Obama's full remarks, as released by the White House:

Throughout his two decades on the Supreme Court, Justice Souter has shown what it means to be a fair-minded and independent judge. He came to the bench with no particular ideology. He never sought to promote a political agenda. And he consistently defied labels and rejected absolutes, focusing instead on just one task -- reaching a just result in the case that was before him.

He approached judging as he approaches life, with a feverish work ethic and a good sense of humor, with integrity, equanimity and compassion -- the hallmark of not just being a good judge, but of being a good person.

I am incredibly grateful for his dedicated service. I told him as much when we spoke. I spoke on behalf of the American people thanking him for his service. And I wish him safe travels on his journey home to his beloved New Hampshire and on the road ahead.

Now, the process of selecting someone to replace Justice Souter is among my most serious responsibilities as President. So I will seek somebody with a sharp and independent mind and a record of excellence and integrity. I will seek someone who understands that justice isn't about some abstract legal theory or footnote in a case book. It is also about how our laws affect the daily realities of people's lives -- whether they can make a living and care for their families; whether they feel safe in their homes and welcome in their own nation.

I view that quality of empathy, of understanding and identifying with people's hopes and struggles as an essential ingredient for arriving as just decisions and outcomes. I will seek somebody who is dedicated to the rule of law, who honors our constitutional traditions, who respects the integrity of the judicial process and the appropriate limits of the judicial role. I will seek somebody who shares my respect for constitutional values on which this nation was founded, and who brings a thoughtful understanding of how to apply them in our time.

As I make this decision, I intend to consult with members of both parties across the political spectrum. And it is my hope that we can swear in our new Supreme Court Justice in time for him or her to be seated by the first Monday in October when the Court's new term begins.

Here's more discussion of the Court from the briefing, after Obama had made his remarks:

After reading numerous comments, I have come to the conclusion that you folks have nothing better to do with your time! Or is it that Obama has made everyone giddy here today? Can't really tell, since I'm not part of the "in" crowd here. Not that this isn't a valid endeavor. It's good to get things off your chest. And writing is fun. And it is communicating. But when was the last time any of you saw some sun?

I used to visit the sun at the beach, but since the Republicans tanked the economy, no more vacations. Just sitting here watching it rain. But, "The sun will come out tomorrow, bet your bottom dollar." (If you still have one after this recession.) I bet "W" has sunshine in Texas! and Cheney too! They can afford the sun, Martha's Vineyard even! I bet our soldiers in Iraq and Afghanistan have sun there in the desert! More than they bargained for! So what if we are so giddy about hope? It's better than the despair "W" left us.

When the economy reconciles--Obama will have completely ruined Americans for another President. We better enjoy him every minute of these next eight years!

Leah Sears Ward in Georgia would be excellent. She ran a spirited, intelligent race for Chief Justice of the Ga. Supreme Court against a red-neck conservative and beat him ....it was remarkable. She happens to be African-American.

LOL. This is all so amusing to me. What do the right-wing blowhards imagine Professor Obama went through to become a professor? Ever hear of oral exams? Ever been to class? Think the professor needs a teleprompter to get his point accross? Snicker. None of mine ever did (although one guy got on his knees to use the last itty-bitty space at the bottom of the blackboard, which was funny as he talked to the board when he did that, and frequently obscured what he wrote with his head). If you're right of center and think you're a talk show phenom, some more education might be helpful.

Republicans are so insanely jealous of President Obama's intelligence, demeanor and style, that the majority of them have been reduced to babbling idiots. No one is perfect (maybe not even Obama), and the president is bound to have some mis-steps during his 8 years. However, so far, everything he touches "turns to gold", and this is driving the Repubs insane. More and more, the "teleprompter" is the only ammunition they have. Pretty damned weak!

Ain't that the truth! :) I'm sure one of the reasons he uses the teleprompter is he's dealing with serious issues and wants to make sure things are said just right, especially given the way people jump all over him like a cheap suit if he makes the slightest verbal error or isn't perfectly clear. These days when the media and the opposition is climbing all over every word to see if there's some underlying meaning he's not saying, or whatever it is they're looking for, it's important to get it right the first time. I think he'd be much more impromptu when he spoke if he didn't have to worry that everything out of his mouth was going to be analyzed to death. I've noticed even when he answers questions at the press conferences, he speaks slowly, carefully, making sure that what he's saying is just right. Anyone would if they were under that much scrutiny.

I'm proud of this country for having the guts to do the right thing and elect a black guy, with the middle name of Hussein, son of a Muslim. The voters got past any concerns they might have had to look at the man himself. He's the right choice and the US electorate surprised and delighted the whole world, including me. Rock on, Big O.

Hm. This is a tough one. But, as with everything else, Obama explained it clearly. He wants a REAL person sitting on the The Supreme Court, not some ideologue. What's wrong with that? Are we such a rigid society that we cannot comprimise anymore?
