I Like ItI Don’t Like It

With his chief counsel and chief of staff by his side, Barack Obama made a surprise visit to the White House press briefing room on Friday, officially announcing the retirement plans of Supreme Court Justice David Souter and laying our what kind of appointment he would make.

With no advanced warning, even for Press Secretary Robert Gibbs, the President took to the podium to read a brief set of prepared remarks. He had just gotten off the phone with Souter, he announced, and wanted to say a few words about the conversation.

"Throughout his two decades on Supreme Court, Justice Souter has shown what it means to be an independent and fair minded judge," said Obama. "He consistently defied labels and rejected absolutes, focusing instead on just one task: reaching a just result in the case that was before him."

As for making a choice to replace him on the bench, Obama laid out broad markers. Promising to "consult with members of both parties across the political spectrum," the president said he would like to see "our new Supreme Court justice in time for him or her to be seated by the first Monday in October when the court's new term begins."

Here are Obama's full remarks, as released by the White House:

Throughout his two decades on the Supreme Court, Justice Souter has shown what it means to be a fair-minded and independent judge. He came to the bench with no particular ideology. He never sought to promote a political agenda. And he consistently defied labels and rejected absolutes, focusing instead on just one task -- reaching a just result in the case that was before him.


He approached judging as he approaches life, with a feverish work ethic and a good sense of humor, with integrity, equanimity and compassion -- the hallmark of not just being a good judge, but of being a good person.

I am incredibly grateful for his dedicated service. I told him as much when we spoke. I spoke on behalf of the American people thanking him for his service. And I wish him safe travels on his journey home to his beloved New Hampshire and on the road ahead.

Now, the process of selecting someone to replace Justice Souter is among my most serious responsibilities as President. So I will seek somebody with a sharp and independent mind and a record of excellence and integrity. I will seek someone who understands that justice isn't about some abstract legal theory or footnote in a case book. It is also about how our laws affect the daily realities of people's lives -- whether they can make a living and care for their families; whether they feel safe in their homes and welcome in their own nation.

I view that quality of empathy, of understanding and identifying with people's hopes and struggles as an essential ingredient for arriving as just decisions and outcomes. I will seek somebody who is dedicated to the rule of law, who honors our constitutional traditions, who respects the integrity of the judicial process and the appropriate limits of the judicial role. I will seek somebody who shares my respect for constitutional values on which this nation was founded, and who brings a thoughtful understanding of how to apply them in our time.

As I make this decision, I intend to consult with members of both parties across the political spectrum. And it is my hope that we can swear in our new Supreme Court Justice in time for him or her to be seated by the first Monday in October when the Court's new term begins.

As I have stated before..it will be Gov.Ed Rendell's wife at some point..Rendell has agreed not to run for Senator against Arlen Spector in exchange for his wife getting a Supreme Court seat.. Pay for play folks ..qualifications don't matter.

Oh, so that is why Dybya picked his own personal counsel to sit on the Supreme Court—he was getting a favor in return. He just forgot to share her favors with the rest of the GOP, who then refused even to consider her nomination.

But please do tell us, Wiseup2Day, how did they get Justice Souter to resign his high office for this 'pay to play' deal with Senator Arlen Spector and Governor Ed Rendell? What was in it for him to let some governor's wife take his seat from him? What side of your tinfoil hat will you consult for the answers to these questions?

An African-American woman would be an excellent choice.

It takes us back to two women on the court; it restores the legacy of Thurgood Marshall--a black person on the court (sorry Clerance Thomas doesn't count) and adds just the kind of person that he is describing. The perspective of an African American woman will be different--just look at how different this first L is compared to the others.

I know that there is a highly qualified African-American woman out there who can be appointed to the court and I hope that he finds her.

I would be very happy to have another woman of any ethnic persuasian. We are seriously outnumbered and the kind of empathy that Obama has discussed is more of a feminine trait (albeit not exclusively).

When I was a kid I thought the world of Kunstler for standing up to Judge Julius Hoffmann when he was defending the Chicago Eight, especially with the Nixon Administration shadowing his every move. Cohn set the standard for modern day GOP hypocrisy with his accusing others of homosexuality while working for McCarthy, yet was gay himself.

I was watching the press briefing when the President walked in and asked for a few minutes. I guess I was as shocked as the reporters, as I've never seen this happen. I was very relieved when he began speaking and it was about his talk with Justice Souter rather than some giant new crisis. (For a few moments there, I was actually frightened!) Leave it to this President to maximize the moment already in place, rather than calling another news conference. I like that about the man!

A President who is Intelligent, who has a great sense of humor, a leader.
I would like to see a woman but I would also like to see that woman who is chosen not chosen just because she is a woman, but of here credibility, experience and intellect.
We know that the right will be trying to head to the fear button!
We have been missing this for way to long, I am so excited about this guy I think we will be heading
into a better day here in the next year but they have to start to create the jobs, remember it is all in
baby steps, we have to remember this is going to take a very long to create this mess.

Supreme Court Justices are to interprete and apply the law impartially, blindly, without predjudice..big period..Whether your rich, poor, black, white, disabled, gay, straight, Democrat, Republican.blindly..we are all to get and expect the same justice..The time for empathy needs to take place when the law is written..by the legislators..if we start to allow judges to be empathetic or make emotional decisions and depart from the law..we are in very dangerous territory..they then become legislators and equal justice becomes threatened..ask anyone in courts in Venezuela..Obama is outright wrong..and his view is Unconstitutional.

Nope not really--why do you think cases are decided everyday by 5-4 votes? It's all about how you read and interpret the law and constitution. And it makes no sense to make these types of arguments when one of the biggest changes in this country (desegregation) came about as a result of how the constitution was interpreted versus written. Come on just think.
