With his chief counsel and chief of staff by his side, Barack Obama made a surprise visit to the White House press briefing room on Friday, officially announcing the retirement plans of Supreme Court Justice David Souter and laying our what kind of appointment he would make.

With no advanced warning, even for Press Secretary Robert Gibbs, the President took to the podium to read a brief set of prepared remarks. He had just gotten off the phone with Souter, he announced, and wanted to say a few words about the conversation.

Watch:

"Throughout his two decades on Supreme Court, Justice Souter has shown what it means to be an independent and fair minded judge," said Obama. "He consistently defied labels and rejected absolutes, focusing instead on just one task: reaching a just result in the case that was before him."

As for making a choice to replace him on the bench, Obama laid out broad markers. Promising to "consult with members of both parties across the political spectrum," the president said he would like to see "our new Supreme Court justice in time for him or her to be seated by the first Monday in October when the court's new term begins."

Here are Obama's full remarks, as released by the White House:

Throughout his two decades on the Supreme Court, Justice Souter has shown what it means to be a fair-minded and independent judge. He came to the bench with no particular ideology. He never sought to promote a political agenda. And he consistently defied labels and rejected absolutes, focusing instead on just one task -- reaching a just result in the case that was before him.


He approached judging as he approaches life, with a feverish work ethic and a good sense of humor, with integrity, equanimity and compassion -- the hallmark of not just being a good judge, but of being a good person.

I am incredibly grateful for his dedicated service. I told him as much when we spoke. I spoke on behalf of the American people thanking him for his service. And I wish him safe travels on his journey home to his beloved New Hampshire and on the road ahead.

Now, the process of selecting someone to replace Justice Souter is among my most serious responsibilities as President. So I will seek somebody with a sharp and independent mind and a record of excellence and integrity. I will seek someone who understands that justice isn't about some abstract legal theory or footnote in a case book. It is also about how our laws affect the daily realities of people's lives -- whether they can make a living and care for their families; whether they feel safe in their homes and welcome in their own nation.

I view that quality of empathy, of understanding and identifying with people's hopes and struggles as an essential ingredient for arriving as just decisions and outcomes. I will seek somebody who is dedicated to the rule of law, who honors our constitutional traditions, who respects the integrity of the judicial process and the appropriate limits of the judicial role. I will seek somebody who shares my respect for constitutional values on which this nation was founded, and who brings a thoughtful understanding of how to apply them in our time.

As I make this decision, I intend to consult with members of both parties across the political spectrum. And it is my hope that we can swear in our new Supreme Court Justice in time for him or her to be seated by the first Monday in October when the Court's new term begins.

VII Grave Breaches and War Crimes

The Geneva Conventions and Additional Protocol I require the ratifying parties to repress grave breaches of the conventions, which are classified as war crimes under statutes of the International Criminal Court and the U.S. War Crimes Act of 1996. States parties—that is, the ratifying parties—are required to search for persons who have allegedly committed or ordered the commission of grave breaches of the conventions and bring those persons before their own courts, or hand them over to another state party for trial.

Grave breaches of the Third and Fourth Geneva Conventions include the following acts if committed against a person protected by the convention: willful killing, torture or inhuman treatment, including biological experiments; willfully causing great suffering or serious injury to body or health; compelling one to serve in the forces of a hostile power; and willfully depriving one of the right to a fair trial. Also considered grave breaches of the Fourth Geneva Convention are the following: taking of hostages; extensive destruction and appropriation of property not justified by military necessity and carried out unlawfully and wantonly; and unlawful deportation, transfer, or confinement.

Barack Obama is doing everything correctly: transparency, talking directly to the people, reaching out to the other side, the dwindling Republican party.

Just look at the disruptive Republican comments on this page to see why we are in the mess they put us in.

Imagine if we had Al Gore for president for 8 years, then Obama replaced Liebermann. There'd be no Iraq War and we wouldn't be in this economic mess that Bush created.

It's time for a Supreme Court that doesn't:

a)appoint a president and vice president

b)have a self-appointed vice president who goes hunting with one of the judges on that Supreme Court

I love the fact that he just decided to pay a visit to the press room on a Friday afternoon when the town was buzzing about Souter's retirement and speculating on who the President would nominate.

By marking out the nature of the person he would seek, he takes control of the discussion until the individual begins the appointment process.

Why can't one of the 5 Justices who voted Bush into office retire? Souter voted the right way, is younger and has his head in the right place. Well, if he really had his head on straight, he would have reminded the rest of the Justices and the American people that the Bush v. Gore decision wasn't even the Supreme Court's to make. That decision, Constitutionally, was up to Congress. Why am I one of the only people on this planet who knows that? I'm not a Constitutional scholar....they are. We basically had an illegitimate President for two terms (while he turned everything into s#*t), thanks to them. Souter should stay and we should get rid of Scalia. And why would Obama consult the Republicans anyway? No votes from them should mean no consultation. Why can't the Dems treat the Repubes like they were treated? Block them at every turn and ignore them as if they didn't exist. We need to get things done. After we solve all these problems, maybe we will start considering acknowledging their presence again. If Souter must be replaced, get Jeanine Garafolo or Michael Moore in there just to spite the m0rons on the right. That would be hilarious as well as good for the country.

My point demonstrated by Zeno469. Obama is already a "great president" with a "magnificent team." It is 4 months into his presidency. He's done almost nothing, and there's been no time to tell whether what he has done has been effective or successful. Mostly has has talked. And talked. Your point is well articulated. At this stage we can but say that the President speaks well, and has selected people that we approve of (or not). Time will judge whether the Presidency itself is successful.

I'm betting it will.
Most who disagree think the last Presidency was good. They are resoundingly bad judges.
