I Like ItI Don’t Like It

With his chief counsel and chief of staff by his side, Barack Obama made a surprise visit to the White House press briefing room on Friday, officially announcing the retirement plans of Supreme Court Justice David Souter and laying our what kind of appointment he would make.

With no advanced warning, even for Press Secretary Robert Gibbs, the President took to the podium to read a brief set of prepared remarks. He had just gotten off the phone with Souter, he announced, and wanted to say a few words about the conversation.

Watch:

"Throughout his two decades on Supreme Court, Justice Souter has shown what it means to be an independent and fair minded judge," said Obama. "He consistently defied labels and rejected absolutes, focusing instead on just one task: reaching a just result in the case that was before him."

As for making a choice to replace him on the bench, Obama laid out broad markers. Promising to "consult with members of both parties across the political spectrum," the president said he would like to see "our new Supreme Court justice in time for him or her to be seated by the first Monday in October when the court's new term begins."

Here are Obama's full remarks, as released by the White House:

Throughout his two decades on the Supreme Court, Justice Souter has shown what it means to be a fair-minded and independent judge. He came to the bench with no particular ideology. He never sought to promote a political agenda. And he consistently defied labels and rejected absolutes, focusing instead on just one task -- reaching a just result in the case that was before him.


He approached judging as he approaches life, with a feverish work ethic and a good sense of humor, with integrity, equanimity and compassion -- the hallmark of not just being a good judge, but of being a good person.

I am incredibly grateful for his dedicated service. I told him as much when we spoke. I spoke on behalf of the American people thanking him for his service. And I wish him safe travels on his journey home to his beloved New Hampshire and on the road ahead.

Now, the process of selecting someone to replace Justice Souter is among my most serious responsibilities as President. So I will seek somebody with a sharp and independent mind and a record of excellence and integrity. I will seek someone who understands that justice isn't about some abstract legal theory or footnote in a case book. It is also about how our laws affect the daily realities of people's lives -- whether they can make a living and care for their families; whether they feel safe in their homes and welcome in their own nation.

I view that quality of empathy, of understanding and identifying with people's hopes and struggles as an essential ingredient for arriving as just decisions and outcomes. I will seek somebody who is dedicated to the rule of law, who honors our constitutional traditions, who respects the integrity of the judicial process and the appropriate limits of the judicial role. I will seek somebody who shares my respect for constitutional values on which this nation was founded, and who brings a thoughtful understanding of how to apply them in our time.

As I make this decision, I intend to consult with members of both parties across the political spectrum. And it is my hope that we can swear in our new Supreme Court Justice in time for him or her to be seated by the first Monday in October when the Court's new term begins.

As long as the candidate is not "Biblically Correct", a spiritual foundation is fine but a belief in Evolution a MUST!

I'm not an Atheist myself but would have no problems with an Atheist being selected either.

Why would you pick such an inconsequential matter to be the deciding factor in choosing a member of the Supreme Court? Whether the earth evolved or was created in one fell swoop on a certain day makes absolutely no difference in our lives today. It is only useful by providing a topic for a useless and unprovable argument.
I would tend to have less trust in a person who gives a clear answer to a question he has not yet been asked. A judge should hear all the arguments before making a decision.

It would only be an inconsequential matter in choosing a member of the Supreme Court IF religious fundamentalists from the right had not tried to stack the court with justices who would be more sensitive to religious-based ideology and it's influence on their decisions. That, in spite of the fact that "a judge should hear all the arguments before making a decision."

Regardless of whether evolution~vs~ creationism is "a useless and unprovable argument".­.cases about "creationi­sm/intelli­gent design" still wind their way from schools to local, state, federal and eventually the Supreme Court for redress. It most certainly DOES make a huge difference in our lives today. It is relevant today, in context to the Justices who make up the Supreme Court, because those cases still challenge separation of church/ state and the 1st Amendment Establishment Clause protection in seeking to inject sectarianism into schools. Such cases are dependent on the Justices' continued strict interpretation of gov't/ religion and hence, schools and the science of evolution/ pseudo-intelligent design (ie., creationism), as well as their continued adherence to definitive rulings!

Often that necessity falls to the Supreme Court.....

LOL, his appearance was not planned or announced, Mr. Gibbs didn't even know he was coming, obviously there would have been more viewers had it been scheduled, and 23% isn't anything to scoff at for a general press corps meeting. And I don't think that being elected President of the United States and having nearly 3/4 of the country thinking your doing well should be put under the 15 min. of fame category.

What kills me is how the media keep referring to the four "liberals" on the court, of which Souter is labeled as one. We have four moderates, not liberals, on the court. There is no one on the court to the left as the same degree the conservatives are to the right. The Republicans have succeeded in changing the perception of what constitutes a liberal. I hope that Obama makes a commitment to selecting a real liberal so that we redefine the center in this country and on the court.

I tried to join the military back in the eighties and they told me in order to make the grade, I had to loose 20pds. Well, if it were today, would loose the 20pounds in a heartbeat. I would go to war and serve this president with my life.

The Supreme Court upheld the constitutionality of the Fairness Doctrine in the Red Lion case. The doctrine was dispensed with administratively under Reagan's FCC. Congress then legislated -- twice -- to establish it by law (instead of by administrative proceeding as it historically had been), and was vetoed twice.

Then the in-bred HillBilly cousins of the Visigoths took the Congress in 1994, who carved up the broadcast airwaves and gave them away to radical right-wing extremists.
