California Governor Arnold Schwarzenegger called on Tuesday for an open debate on legalizing and taxing marijuana. A recent Field Poll showed that 56 percent of Californians support taxing and regulating marijuana as a way to address the state's fiscal crisis. Schwarzenegger was asked at a press conference if it was finally time to legalize marijuana.

"No, I think that it's not time for that, but I think it's time for a debate," he said, according to a transcript provided by Schwarzenegger's office. "And I think that we ought to study very carefully what other countries are doing that have legalized marijuana and other drugs, what affect it had on those countries, and are they happy with that decision."

The Mexican ambassador to the United States, Arturo Sarukhan, recently called for the United States to hold such a debate to address cartel-related violence. Mexico has decriminalized possession of marijuana but doesn't tax it.

James P. Gray, a retired Orange County Superior Court judge, applauded Schwarzenegger's openness. "Once people allow themselves to discuss the issue of treating marijuana like alcohol, the result is pre-ordained. Today marijuana is fully available for anyone that wants it -- expressly including our children -- so why not regulate and control it, and tax it as well? That will reduce the violence in its distribution, and bring in needed revenue for government," Gray, now a member of Law Enforcement Against Prohibition, told the Huffington Post.

Schwarzenegger referenced his native country of Austria, which has recently loosened penalties on marijuana. "I've heard that they are unhappy with that and they want to roll back some of the decisions that were made in European countries. I've had dialogue with experts over there where I was born. So I think that one ought to look at all that. And it could very well be that everyone is happy with that decision and then we can look at that. And if not, we shouldn't do it," he said.

The movement to legalize pot has picked up steam in recent months as budget deficits have plagued both state and federal coffers. But for Arnold, the decision to legalize should be made on its own merits, not merely as a way to raise money.

"But just because of raising revenues, we have to be very careful not to make mistakes at the same time," he said.

Dear God:

I know you put Pot on this Earth for all of us to enjoy. Not just people from California. Although, there will probably be a lot more people living in California, if they make it legal and sell it in cute little stores.
I'll move to California. It's going to be tough. That why I asking for a Miracle, God. Will you please let all mu stuff fit into just one, big, U-Haul Truck! Thanks, God. I know I owe you. If, when the time comes, it all fits into one truck, ... that would be nice.

Arnold is right.

Although driving or doing anything else that puts others at risk while under the influence of ANYTHING should be prosecuted and punished very severely.

there needs to be a blood-THC-level test and some leeway. There are some of us with neuromuscular diseases that are actually helped by marijuana and make us better drivers than without it

Testing chemicals levels in blood or any other body fluid has been shown to be a very poor indicator of intoxication. You can take one hit of pot on Friday night and still have detectable levels of THC on Wednesday, even though you are no longer affected. The reason these tests are being used are that there is some sort of provable number that attorneys can use to indict and there's an industry supporting the testing and materials.

A even better test is for impairment. It has been shown to be more effective in determining capacity to perform, such as driving a car or operating machinery. There is no discrimination for the reason of impairment - you're either impaired or not. Be it pot, alcohol, cocaine, Benadryl, or lack of sleep. If you're not fit to drive it shouldn't matter the reason why.

Medical Marijuana may be the gateway to full legalization . Though legalization may have to come first for some states to not use federal law to excuse medical marijuana distribution

as someone who has risked arrest to explore the potential of marijuana for medical purposes, I can say for certain that in my case, it actually improved my depression and anxiety symptoms and made me MORE productive and active and lively.

Unless you already have your own seeds growing your own will probably go the way of growing your own tobacco. I am sure that someone is already creating a seedless variety that will be good for commercial applications. I don't smoke or use other drugs but the greatest impact this will have is in our insane madness of putting more and more people in jail or prison. I can see the prison guards union going balistic over this proposal even if it is just to debate the issue. We are already seeing a flood of anti drug ads on tv putting out the same old failed message from 30 years ago.

The point is to CONTROL pot. The criminalization of it has spawned an unholy drug industry.

I don't indulge but I think it's absurd that it's not (at least) decriminalized.

There are people in prison for 25 years just for getting caught smoking pot under the three strikes law. That's ridiculous!

Yet torture - apparently - is fine and perfectly legal...

If you don't legalize it, or at least decriminalize it on a federal level, then states will have the ability to say "federal law supercedes state law, therefore we can not offer medical marijuana to our elderly, dying, and suffering patients" for whom traditional pharmaceutical medications are not effective. Marinol, the synthetic form of ONE of the 400 cannibanoids in THC, the active ingredient in marijuana, does not cross the blood-brain barrier, and therefore is not effective in pain control management. And ALL pharmaceutical drugs, including Marinol, Morphine, and all other opiates are formulated with ingredients that are not processed by the body and can lead to kidney and liver damage, especially in patients who already have compromised organ function, such as the disabled, those who suffer from lower extremity paralysis

There is an amazingly successful social experiment in 2001 when Portugal legalized ALL drugs (cocaine, herion, etc for personal use - but trafficking is still a serious crime) now Portugal ranks as the 7th most 'Peaceful' country in the world. As for the US, we rank 97th out of 140.
