Legislation to give Congress greater oversight of the Federal Reserve was severely watered down on the Senate floor Wednesday in private negotiations between two powerful Republican senators.

Thanks to an overlooked document posted on the website of Sen. Charles Grassley of Iowa, the top ranking Republican on the Finance Committee, voters can virtually watch the water being dumped into the brew that Grassley had hoped to force the Fed to drink. (See the document at the bottom of this story.)

On page five of Grassley's amendment, he intends to give the Comptroller General of the Government Accountability Office power to audit "any action taken by the Board under...the third undesignated paragraph of section 13 of the Federal Reserve Act" -- which would be almost everything that it has done on an emergency basis to address the financial crisis, encompassing its massive expansion of opaque buying and lending.

Handwritten into the margins, however, is the amendment that watered it down: "with respect to a single and specific partnership or corporation." With that qualification, the Senate severely limited the scope of the oversight.

On the Senate floor, Grassley named the top Republican on the banking committee, Richard Shelby of Alabama, as the man pouring the water.

"Although I would have preferred to include all of the Fed's emergency actions under 13(3), in consultation with Senator Shelby I agreed to limit my amendment to actions aimed at specific companies," said Grassley.

"This modified version of the amendment does not give GAO authority to look at all of that additional taxpayer risk. It is much narrower than the one I originally filed, but it is a reasonable step in the right direction, and it does not threaten monetary policy independence."

The original version of the amendment also scratches out congressional authority to oversee Fed actions as they relate to the TARP bailout or "similar authority that the Board exercises under urgent and exigent circumstances."

The Senate walked right up to the edge, thought about auditing the Fed, and with the stroke of a pen, backed off. (Or maybe it was a pencil.)

The action the Senate took, however, is not meaningless.

Grassley entered into the congressional record a list of Fed actions that do fall within the limits of the language in his amendment (which could still be eliminated in conference committee negotiations):


1. Actions related to Bear Stearns and its acquisition by JP Morgan Chase, including:

a. Loan To Facilitate the Acquisition of The Bear Stearns Companies, Inc. by JPMorgan Chase & Co. (Maiden Lane I)

b. Bridge Loan to The Bear Stearns Companies Inc. Through JPMorgan Chase Bank, N.A.

2. Bank of America -- Authorization to Provide Residual Financing to Bank of America Corporation Relating to a Designated Asset Pool (taken in conjunction with FDIC and Treasury)

3. Citigroup -- Authorization to Provide Residual Financing to Citigroup, Inc., for a Designated Asset Pool (taken in conjunction with FDIC and Treasury)

4. Various actions to stabilize American International Group (AIG), including a revolving line of credit provided by the Federal Reserve as well as several credit facilities (listed below). AIG has also received equity from Treasury, through the TARP, which would also be captured in amendment #1020.

a. Secured Credit Facility Authorized for American International Group, Inc., on September 16, 2008

b. Restructuring of the Government's Financial Support to American International Group, Inc., on November 10, 2008 (Maiden Lane II and Maiden Lane III)

c. Restructuring of the Government's Financial Support to American International Group, Inc., on March 2, 2009

5. TALF -- finally, amendment #1020 would expand GAO's authority to oversee the TARP, including the joint Federal Reserve-Treasury Term Asset-Backed Securities Loan Facility (TALF)

*Neither* Amendment #1021 nor #1020 would include short-term liquidity facilities:

1. Asset-Backed Commercial Paper Money Market Mutual Fund Liquidity Facility
2. (AMLF)
3. Commercial Paper Funding Facility (CPFF)
4. Money Market Investor Funding Facility (MMIFF)
5. Primary Dealer Credit Facility and Other Credit for Broker-Dealers (PDCF)
6. Term Securities Lending Facility (TSLF)

We need this and a lot more stories of just how crooked and dirty DC has become. The more light you guys shine on them the more the little bugs have to run.
An informed public is a free public.
I have to wonder, do any traditional press, want to hear stories like this ?

Can someone explain to me what's the fuss about. The Dems have 59 votes in the Senate and the Repugs have at most 41. Well why do the President any of them to pass his agenda. Do not b5o votes pass in the Senate?

yes, 51 votes is necessary to pass legislation, unless the "opposition party" filibusters. Since the rethugs have no plans, no brains, no ideas, they filibuster everything. This is why 60 votes are necessary.

It's not about Dems Reps and Presidents. It's about The bank/Credit/insurance lobby who have bought and paid for What used to by YOUR government.
Yes we all thought when we got our President in and a majority in the Legislature things would change. The Lobby knew better, they just bought more politics.

I trust shelbee as far as i can throw him. Well 4 that matter any of these clowns, I solved mt credit crisies long ago i got rid of Credit cards. Simple fix for me If i want it i pay cash or do without. Just a Sat AM thought Bill

If Thomas Jefferson had written the bill, with George Washington and Jesus as Co-sponcers, 'by the time it got through all the Pharrisees and Phillistines, Money Lenders, and Roman Overlords , OUR GUYS would not recognize their bill. (I tried to use language our GOP brothers in arms could identify with. Grin).
I wish I was a political cartoonist, I would draw a picture of group of curvy crooked rattlesnakes
trying to create SOMETHING true and straight, then looking baffaled and scratching their heads cause everything keeps comming out warped and wrong and bad.

Excuse me, why are "we" counting on the Democratics to do anything? Honestly, I'm surprised by the level of interest emanating from Democratics in the first place. The Federal Reserve, its shenanigans, and its economic implications have never been the interests of either of the major political parties. It is the libertarians - no, not the party - who have concerned themselves with analysis of and opprobrium towards the central bank and, in fact, it is philosophical libertarian representative Ron Paul - not a Democratic - who brought this bill to the floor in the house.

Look, Johnny-Come-Lately or not, it definitely pleases me that a decent amount of Democratics have attached themselves to this piece of legislation. But this by no means signals a trend in the party that is anything approaching meaningful at this point and, let's be honest, the whipping boy right now is Shelby but it just as easily could have been a Democrat.

Just running through this comments thread, you'd be left with the impression that auditing or abolishing the Fed is a pillar of the Democratic platform and that just isn't the case. It wouldn't even be on the radar right now if it weren't for Rep. Paul's 2008 presidential bid. The rot in D.C. is bipartisan, let's take the blinders off.

When you have the crooks writing the laws the outcome will be pretty obvious. Until the corruption in our government is dealt with nothing will improve for we the people. Banks, Wall Street, and big corporations buy the laws that they want, and break the laws that they want to break. It is done legally and no one is every punished or held accountable. They have bankrupted our country.

My initial thought when I saw Shelby was "Nice dye job"...in goes nicely with his horribly pasty complextion. If a man is going to dye his hair, for gawds sake, go to a professional. His look personifies the creepy fake slime factor that defines Washington DC

I think it is the "slack" look in his face that really bugs me. He LOOKS corrupt and that is not fair to equal his character by his looks, but still. He has that fearful angry look in his eyes from that picture and he is very slack in the face. Means NO character to me. (and no I did not look into his soul)

This is an outrage. The Fed needs to be audited so the American people can see exactly how much of OUR money has been spent in an attempt to stabilize this economy. The TARP and 'stimulus" bills are a mere fraction fo what the Fed has spent. We'll never get out of debt. The Democrats have the majority, where are they when they're needed? On the same gravy train as the Republicans.
