The lawyer pushing for the release of photographs showing the harsh treatment of suspected terrorist detainees said President Barack Obama was backtracking on his word and commitment to transparency by reversing course and objecting to the release of those photos.

Jameel Jaffer, a chief litigator for the American Civil Liberties Union National Security Project, described Obama's reversal as "very disappointing" during an interview with Fox News.

"It is inconsistent not only with commitments the Obama administration has made to us and to the courts but inconsistent with the promise of transparency that President Obama has repeated so many times," he said.

Jaffer, who has filed suit for the release of these photographs under concerns over civil liberty violations and possible detainee abuse, noted that the Obama White House still had a steep hill to climb in its efforts to suppress the release of the photos. Jaffer has won his case in the district court in New York as well as a three-judge appeals court. The Bush Administration, towards the end of its term, asked the full Second Circuit Appeals Court to review the matter. They refused to do so.

"At this point," Jaffer said, "the burden is on the government because there is a court order that requires them to release these photos. So they are either going to have to seek Supreme Court review or come up with some creative strategy to get yet another hearing below the lower courts."

"These photographs are critical to the historical record so it is very disappointing... that the administration is going to try and suppress them," he added.

The President announced that he would oppose the release of the detainee photos on Wednesday after what spokesman Robert Gibbs described as a long process of determining what was the best course of action. The president, he added, was concerned about the impact such photos could have on U.S. Armed Forces. A White House aide sent this explanation for the decision on condition of anonymity.

Last week, the President met with his legal team and told them that he did not feel comfortable with the release of the DOD photos because he believes their release would endanger our troops, and because he believes that the national security implications of such a release have not been fully presented to the court.


At the end of that meeting, the President directed his counsel to object to the immediate release of the photos on those grounds.

Yesterday, during a meeting at the White House, the President raised the issue of these photos with General Odierno and told him of his decision to argue against this release.

Through his actions from the first days of his administration, the President has made it clear that the United States will hold itself and all the men and women who serve our country to the highest standards of conduct.

The President would be the last to excuse the actions depicted in these photos. That is why the Department of Defense investigated these cases, and why individuals have been punished through prison sentences, discharges, and a range of other punitive measures. But the President strongly believes that the release of these photos, particularly at this time, would only serve the purpose of inflaming the theaters of war, jeopardizing US forces, and making our job more difficult in places like Iraq and Afghanistan.

No one, and I mean no one, says that we shouldn't have secrets. Rather, what we're saying is that if someone breaks the law, you can't just classify your actions in an attempt to CYA.

But then again, the clueless righties have shown us that they have no respect for a court order.

When President Obama was a candidate @ times i questioned the direction of his campaign however, he exemplified time and time again that he had a superior plan and proved me wrong...... President Obama will get the benefit of the doubt from me; he established himself to be a thoughtful man...... I WON'T allow myself to write off my President whose been in office for 5 months!!!!! I think there is a better and smarter strategy on its' way

you misunderstand democracy. Just cos you disagree with him on one issue does not mean he is no longer "your president" you must be loyal to the US and our laws and values first. If you disagree with stance on not prosecuting previous war criminals and not releasing the truth of what was done un the past under our name, then you should let your voice be know. There are many on the far right voicing their opinions, and this is why Obama moves to the right. We need to have voices from the left also moving Obama to our side.

I commend Obama for stopping these atrocious policies. But this does not prevent future abuses once he is no longer President. He needs to bring to trial the people who engineered lawless acts to deter future wannabe dictators.

DnDC said it! Obama is a thoughtful man. He has more information than you and I. He always has a method to his madness. That's not to say that everything he does I agree with. But in this case because I don't see the same cards in his hands, I'll have to trust him, as DnDC is trying to explain. Since we already know that cr1mes were committed, every detail of that crime is not needed in order to prosec.u.te.

Remember Obama is not like Boosh. He doesn't run out of the door only to find he's at the edge of a clliff.

I agree with both the original comment and the follow up. However, Obama is the Commander in Chief. He is responsible for the well being of our service personnel. His concern that the release of these pictures could bring harm to our families in service over seas is a legitimate concern. We are not the only ones who would be looking at these pictures. You've heard the phrase that a picture is worth a thousand words. A few hundred of these pictures would be the gift that keeps on giving for Al Quaeda to recruit people for the purpose of killing Americans. Think about whether you'd want this to happen if it was your son or daughter who would bear the additional strain in the Middle East. I hope the time comes when we can deal with this openly solely for the purpose of insuring that it never happens again. But the time is not while my children have to face even greater danger in a war zone. But we do need to speak out against torture. Steven Colbert said it well the other night in response to what Condi said to the fourth graders about torture:

"Children are our future. If we explain torture right, then we can look forward to a future where torture isn't wrong."

I never stated that there shouldn’t be criticism i only articulated that i felt had a better plan. Also, many on this thread have stated that they plan to write him off. My point is, I won’t do that to someone thats been in office for 5 months after 8 destructive YEARS.

The photos will come out one way or another. Might as well get out in front of it. Prosecuting the war criminals is the only way to take care of this mess and regain some of our standing in the world. Trying to hide photos - when their content is already widely and well-known - doesn't cut it.

I believe it is a sense of shame, whether personal or national, that really keeps people from wanting to see the photographs. I feel it, too.

However: that feeling of shame you feel is a strong indicator that the truth must be exposed. When shameful acts are hidden, they are soon forgotten. We must not forget that some of our brave soldiers -- men and women who *volunteered* to risk their lives protecting our country -- were ordered to commit unspeakable acts. We must not bury our shame, but hold out it before us for all to see. Only then can we ensure that such mistakes are not repeated in the future.

If Obama wants to delay the release of these photos in order to assist the prosecution of those who ordered the torture, good. I'll get on that wagon. But if he doesn't want to release them out of a sense of shame or fear of reprisal, then I strongly disagree with his choice.

All the pictures will show are the grunts who were ordered to perform these unspeakable acts, and like abu Ghraib, they will become the scapegoats while those in power sit quietly watching us be distracted.

It's not shame that makes many of us agree with Obama's decision; it's concern for our troops and the distraction of watching a bunch of low level foot soldiers take the blame for the policy set from above. That's all the pictures will do.

"I'm divorcing Daddy because he's a horndog"? If she tells you when you're 19, fine! I just think that as long as our soldiers are in the position of a backlash (remember how these Muslim Extremists nutted up behind a cartoon, dontcha?), our thirst for vengeance(and that's what it is, if you're honest) can wait till our guys are out of harm's way. "Broke his word"? Or changed his mind, due to compelling arguments? I have more than enough trust in our president's judgment to believe he changed his mind and has publicly announced that. What a refreshing change from past administrations, in which stubbornness was the virtue and it was wrong ("flip flopping") to reassess. This sounds like the right decision to me.

I agree - I know what happened and have no need to see more. I believe that he put much thought into his decision after listening to his advisors. I trust him to make the correct decision. (btw - that's a nice feeling - after so many years of always mistrusting what we were told.)

I am sure there are a lot of things that the President would like to do but maybe it's not in the best intrest of the Nation. He did say he will listen to the commanders on the ground.After all he has information that we are not privy to.Being President is a tough job and you will not please all the all the time.

you don't know how democracy works. Even if he takes a position you do not agree with--this does not preclude you from letting him know you do not agree. This is how voicing opinion in democracy knows. I hope Obama know the truth lovers and those who want justice in this country are not happy with this decision. Since its apologists relish the idea of torture (of torturing others, not being tortured) these photographs would feed their appetite for sadism.

But the contradiction in the so-called 'conservative' position is obvious: it's okay to do torture, and let the world know you do, and that --somehow?--won't incite reprisals by 'terrorists' but will 'keep America safe': but seeing pictures of the torture will incite them to take revenge?

Pleeease! Of course it may mean they think other people in the world are too dumb to acquire knowledge, but can be moved by pictures...

Silly issue (yes, I'm serious). Why do we need to see these photos? Why do we need to allow our enemies to see their operatives humiliated and abused? Most of us (except the 21 percenters, perhaps) are well aware that horrible abuses were committed in the name of the United States and we should be ashamed and see that it never again happens.

That being said, if the photos are needed for court documentation, so be it. But they should not be released to a greedy press. This has nothing to do with transparency but civility and good taste!

President Obama hasn't said he wishes the photos suppressed for all time, but just for now while the wars are underway. Is it not possible that once he got in office and saw the photos themselves, he decided that it might endanger our troops?

Remember, much about the Kennedy assassination is being kept under wraps for another 25 years or so. Many WWII items are just now being declassified and released.

Get a grip, people!

we need to see the photos so the American people can come to terms with reality and be moves enough to FORCE our reps to hold the people that disgraced our laws and our name ACCOUNTABLE.
