The lawyer pushing for the release of photographs showing the harsh treatment of suspected terrorist detainees said President Barack Obama was backtracking on his word and commitment to transparency by reversing course and objecting to the release of those photos.

Jameel Jaffer, a chief litigator for the American Civil Liberties Union National Security Project, described Obama's reversal as "very disappointing" during an interview with Fox News.

"It is inconsistent not only with commitments the Obama administration has made to us and to the courts but inconsistent with the promise of transparency that President Obama has repeated so many times," he said.

Jaffer, who has filed suit for the release of these photographs under concerns over civil liberty violations and possible detainee abuse, noted that the Obama White House still had a steep hill to climb in its efforts to suppress the release of the photos. Jaffer has won his case in the district court in New York as well as a three-judge appeals court. The Bush Administration, towards the end of its term, asked the full Second Circuit Appeals Court to review the matter. They refused to do so.

"At this point," Jaffer said, "the burden is on the government because there is a court order that requires them to release these photos. So they are either going to have to seek Supreme Court review or come up with some creative strategy to get yet another hearing below the lower courts."

"These photographs are critical to the historical record so it is very disappointing... that the administration is going to try and suppress them," he added.

The President announced that he would oppose the release of the detainee photos on Wednesday after what spokesman Robert Gibbs described as a long process of determining what was the best course of action. The president, he added, was concerned about the impact such photos could have on U.S. Armed Forces. A White House aide sent this explanation for the decision on condition of anonymity.

Last week, the President met with his legal team and told them that he did not feel comfortable with the release of the DOD photos because he believes their release would endanger our troops, and because he believes that the national security implications of such a release have not been fully presented to the court.


At the end of that meeting, the President directed his counsel to object to the immediate release of the photos on those grounds.

Yesterday, during a meeting at the White House, the President raised the issue of these photos with General Odierno and told him of his decision to argue against this release.

Through his actions from the first days of his administration, the President has made it clear that the United States will hold itself and all the men and women who serve our country to the highest standards of conduct.

The President would be the last to excuse the actions depicted in these photos. That is why the Department of Defense investigated these cases, and why individuals have been punished through prison sentences, discharges, and a range of other punitive measures. But the President strongly believes that the release of these photos, particularly at this time, would only serve the purpose of inflaming the theaters of war, jeopardizing US forces, and making our job more difficult in places like Iraq and Afghanistan.

This is yet another big credibility problem for Obama. So much for restoring our moral standing in the world. Much as he renegged on his promise to call genocide by its rightful name and then deliberately refused to do so (Armenian Genocide) and promised to exhibit "unstinting resolve" to end the Darfur Genocide, he is now trying to suppress evidence of detainee abuse. He has proven to be a big disappointment regarding human rights issues and has most certainly not fulfilled his promises to deal with said issues in a forthright, just manner.

What we are being told through the President's attempt to suppress this evidence is that our troops have committed acts so horrible that not only our enemies but our fellow citizens cannot be allowed to see for themselves. This may not have been his intent, but this is the impression that he has managed to convey.

There are so many pictures already out on "the internets"... I don't get the issue of using judgment here. Is it likely there will be anything new that propels prosecution of those who created the policies and therefore conspired to break the law? Not a chance. For me, the ACLU often represents the worst instincts of those on the left. They want the information released because they believe we have a right to know. Perhaps so, but to what end, precisely? So they can micromanage the executive branch? Because they believe they understand issues of national security better than those who have access to classified intel and informed opinion? Perhaps next they'll demand that the President post his private thoughts online. I understand what the ACLU is trying to do. But they go overboard far too often. Let them fight this out in the courts. If they win, the photos should be released. But they haven't won yet. Until they do, they should quit carping about how unfair life is.

Hopefully the images will spark ANGER in the American people about the atrocities that are committed in our name by oir government. Then we will hold the people responsible for breaking our laws and lying to us ACCOUNTABLE>. Justice; Accountability; Future of the USA;s moral high ground is at stake. That is the 'end'.

Sounds like a plan to me. Now tell me the 'end' plan for our never-ending wars in Iraq and now Pakistan and Afghanistan...what's next? What does it mean to ;win; when will we 'win'? how? how many lives and how much money from now. will we implode by then?

I for one do not think we need to know everything that happen we know that people was tortured we have pictures of people being tortured. Even though you feel it is a must we should know and see all, at this point in the game I can not agree with you. As long as our soldiers are over seas and they lives are in harm way I for one think that if all the photos are made public it will just add fuel to the fire over seas and make it worse for our soldiers. Now when they are home show it all tell it all but right now there safety is way more important to me than those pictures.

The president has alot to do and so many people to answer too and if he released those pictures and more soldiers was killed because of the hideous things that our military has done over there would it be worth it to you.

This seems like a difficult decision to me. More spillover from the previous administration. I want to see the guilty held accountable--all the way up the line. And I think that the photos should eventually be made public. And I don't know enough about what's going on with those we're engaged in battle with to know if the publication of the photos right now makes a difference. Based on what I know, it seems like the right decision.

Rubberneck - I challenge that the release of the photos would endanger our troops any more than they already are. They are fighting two wars, one I believe necessary (Afghanistan) and one due to lies by the Bush administration. That already very much endangers them.

But the world - including all terrorists groups who seem to be very well informed and connected to the internet - already know the American government has approved torture, that the CIA tortures and our troops torture. Showing pictures of it doesn't change that at all. But facing this issue (transparency!!) may help us prevent it from happening again. It may show the rest of the world (not the terrorists of course) that we live up to our ideals, we obey our own laws, we are NOT hypocrites.

Showing the pictures shows the REALITY of what's been happening there. What is this "make the troops look bad" thing all about? Some soldiers behaved less than honorably, and that behavior needs to be stopped. The US does not torture, and so the images of this type of violation SHOULD be shown to the public: not to embarrass the troops (though the torturers might), but to show people who drastic some of the interrogation "techniques" were.

We can't just cover our eyes and pretend nothing happened.
