The lawyer pushing for the release of photographs showing the harsh treatment of suspected terrorist detainees said President Barack Obama was backtracking on his word and commitment to transparency by reversing course and objecting to the release of those photos.

Jameel Jaffer, a chief litigator for the American Civil Liberties Union National Security Project, described Obama's reversal as "very disappointing" during an interview with Fox News.

"It is inconsistent not only with commitments the Obama administration has made to us and to the courts but inconsistent with the promise of transparency that President Obama has repeated so many times," he said.

Jaffer, who has filed suit for the release of these photographs under concerns over civil liberty violations and possible detainee abuse, noted that the Obama White House still had a steep hill to climb in its efforts to suppress the release of the photos. Jaffer has won his case in the district court in New York as well as a three-judge appeals court. The Bush Administration, towards the end of its term, asked the full Second Circuit Appeals Court to review the matter. They refused to do so.

"At this point," Jaffer said, "the burden is on the government because there is a court order that requires them to release these photos. So they are either going to have to seek Supreme Court review or come up with some creative strategy to get yet another hearing below the lower courts."

"These photographs are critical to the historical record so it is very disappointing... that the administration is going to try and suppress them," he added.

The President announced that he would oppose the release of the detainee photos on Wednesday after what spokesman Robert Gibbs described as a long process of determining what was the best course of action. The president, he added, was concerned about the impact such photos could have on U.S. Armed Forces. A White House aide sent this explanation for the decision on condition of anonymity.

Last week, the President met with his legal team and told them that he did not feel comfortable with the release of the DOD photos because he believes their release would endanger our troops, and because he believes that the national security implications of such a release have not been fully presented to the court.


At the end of that meeting, the President directed his counsel to object to the immediate release of the photos on those grounds.

Yesterday, during a meeting at the White House, the President raised the issue of these photos with General Odierno and told him of his decision to argue against this release.

Through his actions from the first days of his administration, the President has made it clear that the United States will hold itself and all the men and women who serve our country to the highest standards of conduct.

The President would be the last to excuse the actions depicted in these photos. That is why the Department of Defense investigated these cases, and why individuals have been punished through prison sentences, discharges, and a range of other punitive measures. But the President strongly believes that the release of these photos, particularly at this time, would only serve the purpose of inflaming the theaters of war, jeopardizing US forces, and making our job more difficult in places like Iraq and Afghanistan.

I'm ready for a true progressive in 2012! Or a third party to challenge both the parties, one that is not Liberterian, which another name for failed 90s policies.

I am kaput with Obama. By 2012, he will have compromised so much he'll have half hearted support from everyone. Not a recipe for success.

I see this health care reform being demolished by his insane neocon foreign policy & his now being complicit in war crimes.

I'm for asking the Spanish prosecutor to stay at my house & begin investigations of Bush/Cheney war crimes & coverup & now Obama's collusion in covering up war crimes. Now, I no longer believe him when he said America no longer tortures. Given the history of the last 8 years and his recent decision, I see no reason to give him any benefit of the doubt. He has proven he cannot be trusted nor his word trusted. A Bush Democrat, doing one thing, saying another.

PICTURE THIS PEOPLE: CNN decides to air video of Americans being subject to grossly inhumane treatment. What would we do? We would vow revenge. There would be riots in the streets to that end. Obama is right - we don't need to open more wounds, we need to heal them. He has done a remarkable job of lifting our esteem in the eyes of the world. ACLU needs to be a bit more Spock-like and recognize the Pandora's box they're attempting to pry open would be a dangerous and destructive force.

This about face by Obama is yet another example of the president reneging on promises that he would return the rule of law, openness, and accountability to the WH. From kowtowing to banks, to plans for reinstating tribunals, to his refusal to pursue those who approved torture in violation of federal and international law, to blocking release of visual evidence showing the human consequence of abuses endorsed by the Bush administration -- Obama's administration appears to be a watered down extension of the previous.

With his token actions to appease those who believed he was the one man who had the courage and integrity to return our country to the moral highground -- Obama has instead continued the path of the previous administration. When it comes to *real* actions and *real* results, he has shown no more respect for the rule of law and our constitution than those who showed complete disdain for the same for the past eight years.

Let it be clear, despite the media's bogus categorization of those criticizing Obama on these issues -- I am no liberal, let alone a "far-left liberal". I am a NH independent throughout -- voting for Reagan, Bush, Clinton, Clinton, Bush, Kerry (nose plugged) and finally Barack Obama. I am an American who, with every ounce of my being believes in the idealism that echoes in our forefather’s words, and who grows more and more disheartened, losing more and more hope, with each passing day.

perhaps we should think in this way: if i was poor and middle eastern person how would i feel if my father/unc­le/brother­/cousin/fr­iend/husba­nd ... whatever .... was paraded, beaten, bruised, tortured, emasculated and naked in front of the world to prove what was already written in numerous documents, memos, and otherwise recorded exchanges. I WOULD PERSONALLY HATE AMERICA (kind of like the slaves and SOME black people prior to the civil rights amendments). these feelings are being/will be fostered if we release these photos to the public which in this day and age includes the rest of the world. let us not forget a picture is worth a thousand words, a paragraph however, is, only and can only be interpreted as that ... a paragraph. words are harder to skew (Dick Cheney is finding this out now) than pictures. so let us lower our level of outrage and understand that for every action there is a reaction, whether it is positive or negative is really predicated on how a) well we know ourselves and b) well we know the rest of the world. the art of war states that you must know your enemy .... obviously our POTUS/CIC knows this and is paying attention to his generals in the field and thoroughly evaluating the advise they give and is acting as a real DECIDER unlike our former FOOL IN CHIEF.

I find it amazing that those stating they support the troops would be so willing to put them in harms way like this. we have overwhelming evidence that our enemies and allies worldwide see these as marketing and recruitment tools for extremist groups and terrorists domestically as well as internationally. let us not forget that it is not the job of the pres/CIC to endanger our military personnel but to use them to defend our nation against foreign attack and protect our interests worldwide. RELEASING THESE PHOTOS WOULD DO NEITHER, nor would they drive home any new points or uncover any new evidence that we could not glean from written affidavits. IN OTHER WARDS IF YOU CAN READ YOU DON'T NEED PICTURES (are there pictures in The Great Gatsby or War and Peace). this is another example of the POTUS/CIC observing the idea that only fools rush in. the far left needs to let up and the far right needs to sit down and shut up, both have had their chance. i support the POTUS/CIC's decision because if my friends can't come home because some 9yr old child strapped a bomb to him/herself and detonated him/herself near a group of civilians and troops i would be inclinded to say maybe we should not have showed those pics.

To be quite honest, I'm sort of happy they won't be released. I can't imagine what those detainees had to experience and I hope everything does come to light but it does worry me that releasing them could be detrimental to the troops. I know It was pointed out yesterday that these aren't the first but idk. As long as they get used against the morons who carried it out.I think The President did the right thing.

Seems to me the discussions are going just as intended..­.cause I think the real question becomes,

Just what is it about these new photos that government does NOT WANT the general public to KNOW?

When has transparency, facts and shining a light into the darker corners of our society ever done ANYTHING but illuminate? No matter how uncomfortable (and that's the real issue, isn't it!?) And can someone PLEASE share with me an example of "outing" truth or facts that has lead to more harm/evil doings/bad things? I'll gladly admit I'm wrong if someone can show me a legitimate example of where "hiding" something actually ended up living up to the rhetoric of being done in the name of "greater good".

HEar Hear. Maybe the pics will spark outrage on behalf of us lazy clueless Americans and we will move to FORCE accountability. Those who approved and carried out these horrors in our name will be brought to justice--but only if we the people demand it.

EVERYTHING The American government does, it does in OUR name. Do we want the government doing things that are so nasty that we can't even release info or photos of it out to the people. Do we want our government hiding its actions from we the people--the people they are supposed to SERVE>?>?
