The U.S. Supreme Court handed medical marijuana patients and advocates a resounding victory on Monday, refusing to hear a case brought by San Diego County, which has long chafed at implementing statewide medical marijuana laws.

The state of California, in an effort to systematize the 1996 voter-approved initiative, required localities to implement identification card programs for patients with doctor approval in 2004. Such ID cards are required to enter medical marijuana shops in California and can be shown to police officers who find patients in possession of marijuana.

San Diego County, however, argued that the federal ban on marijuana trumps the state law, meaning they are not required to follow the state law. The county filed suit in 2006. Both the San Diego Superior Court and the Fourth District Court of Appeals rejected the argument, which was followed by the California Supreme Court's refusal to review the case in 2008.

The San Diego Board of Supervisors voted to appeal to the Supreme Court.

"The courts have made clear that federal law does not preempt California's medical marijuana law and that local officials must comply with that law," said Joe Elford, chief counsel with Americans for Safe Access (ASA), a national medical marijuana advocacy group with a large presence in California. "No longer will local officials be able to hide behind federal law and resist upholding California's medical marijuana law."

It is not the job, in other words, of local cops or municipalities to enforce federal laws. In fact, the federal government has never made such an argument. The California counties acted on their own.

The Supreme Court ruling, following the Obama administration's decision not to raid medical marijuana clubs acting in accordance with state law, removes one of the last barriers to full implementation of the state law.

ASA has now given notice to 10 conservative holdout counties (Colusa, Madera, Mariposa, Modoc, Mono, San Bernardino, San Diego, Solano, Stanislaus, and Sutter) of their legal obligation to implement the ID card program. In January 2009, ASA, something of an industry trade group, filed a lawsuit in January against Solano County for its refusal to implement the state ID card program.

ASA was joined by the ACLU Drug Law Reform Project in assisting the California Attorney General in the case against San Diego. San Bernardino teamed with San Diego.

"The Supreme Court and the lower courts in California have blown away the myth that federal law somehow prevents states from legalizing medical marijuana," said Rob Kampia, executive director for the Marijuana Policy Project.

Thirteen states have laws that allow certain folks to use medical marijuana if their doctor recommends it. Illinois, Minnesota, New Hampshire, New Jersey and New York are currently considering medical marijuana bills in their state legislatures.

Mexico's Congress just passed a bill decriminalizing the possession of small amounts of drugs (see San Diego Union Tribune) and that will set an example that American should consider when we begin having "open" discussions as Governor of CA and others have called for. BTW: folks that are fearful of publicly commenting on these US policies can comment on the Mexican policies without similar concern; which is a major plus for freedom of speech!

The amount of cash generated cannot be ignored in "these tough times" and may prove to be the incentive for more realistic policy "changes", which will lead to a much lower number of people being jailed at huge expense ($50,000 per year) and also reduce the amount of money going to Drug cartels...

As far as the medical uses go, anyone actually interacting with those folks with MAJOR health/pain problems will understand just how bias these "studies" have been and how it has changed the quality of life for the elderly and chronically ill (FOR THE BETTER); despite what Big Pharmacy and the Private Jail Lobbies say!

Fantastic decision. People who are on chemotherapy or suffering from glaucoma have been shown to do better on marijuana than on synthetic equivalents.

If my glaucoma got any worse there is nothing else I can use except medical marijuana as I have had two operations and have been using all of the stat-of-the art drugs available. I certainly don't want to go blind if I knew that marijuana could help me and I hope that New York State approves the use very shortly.

I am all for legalization for medical and light recreational use.

However, if you are under stress, it is better to first address and correct the issues which are causing you stress, then learn appropriate coping mechanisms to handle stressful situations. Not self medicate with a drug so as not to deal with it.

JMHO as a medical provider.

California needs to hurry up and completely legalize and tax pot. They are losing a lot of tax dollars by using this bogus get a note from your doctor law. Once California does it, other states will slowly start to legalize it, except of course the republican southern dummy states.

Any private industry has the right to establish, implement and enforce it's own rules in regards to how they want their business run.

If they do not allow employment of those under the influence, they stipulate that at time of hire. If a person does not want to adhere to that then they need not take the job.

But once they take the job, knowing the rules and policies of that employer, if they decide to break those rules, they have no defense.

The Feds have absolutely no interest in Marijuana. If the product does not cross state lines there is no Federal interest what so ever.

Funny, isn't it, how all the Conservatives claim states rights and strict construction of the Constitution when they really want to restrict peoples rights.

Hypocrites all.

In the 1930's they couldn't figure out how to make marijuana a federal crime. So they instituted a Marijuana stamp act. Which said if you didn''t have a marijuana stamp you had violated federal law.

But they would never issue any stamps.

That was overturned because it was clearly unconstitutional, as well as being outright dumb.

Somehow they got around the constitutional issue in the 1970's.

But the fact remains, regulation of a weed that grows everywhere is not a federal issue.

Nice to see the Supremes make a good decision for once.

the basis for the modern day federal involvement in drug policy is the interstate commerce clause which was first applied to machine guns and interstate kidnapping.

The Marijuana Tax Stamp Act declared all marijuana to have been imported. A ridiculous notion for a weed that can grow in every county in America.

Again, there is NO FEDERAL ISSUE with marijuana!
