Missing Bush E-Mails Won't Be Released, Court Says

WASHINGTON — A federal appeals court ruled Tuesday that the office that has records about millions of possibly missing e-mails from the Bush White House does not have to make them public.

The appeals court in Washington ruled that the White House Office of Administration is not an agency subject to the Freedom of Information Act, allowing the White House to keep secret documents about an e-mail system that has been plagued with problems.

During its first term, the Bush White House failed to install electronic record-keeping for e-mail when it switched to a new system, resulting in millions of messages that could not be found. The Bush White House discovered the problem in 2005 and rejected a proposed solution.

A group known as Citizens for Responsibility and Ethics in Washington sued to get documents about the office's electronic record-keeping, including reports analyzing system problems, plans to find the missing e-mails and create an improved system and records of any retained messages.

In response to court orders in the case, the White House disclosed that it has located nearly 3,500 pages of documents about problems with its e-mail system. But the Bush administration argued in this case for the first time that the office's records are not subject to public disclosure, even though it had responded to hundreds of other FOIA requests in the past decade and even included instructions on its Web site for filing them.

A lower court sided with the Bush administration last June, and Tuesday's opinion upheld that order.

"We conclude that the Office of Administration is not (subject to FOIA requests) because it performs only operational and administrative tasks in support of the president and his staff and therefore, under our precedent, lacks substantial independent authority," the three-judge panel said in its opinion.

President Jimmy Carter created the Office of Administration in the late 1970s as part of the Executive Office of the President. It is responsible for such duties as personnel management, data processing, records, and office services like printing, supplies and mail.

The appeals court decision was made unanimously by Judges David Sentelle, A. Raymond Randolph and Thomas Griffith. All were Republican appointees _ Sentelle by Ronald Reagan, Randolf by President George H.W. Bush and Griffith by his son, President George W. Bush.

The case was argued before the judges in November, before President Barack Obama took office. But the Obama administration is siding with the previous administration in trying to kill another lawsuit that seeks to recover any missing e-mails.

The Bush White House eventually said that it located 14 million e-mails that were misplaced and that the White House had restored hundreds of thousands of other e-mails from computer backup tapes. But two groups _ Citizens for Responsibility and Ethics in Washington and the National Security Archive _ filed a lawsuit against the Executive Office of the President in February arguing that large amounts of e-mail may still be missing, and that the government must undertake an extensive recovery effort.

The groups expressed disappointment that Obama's Justice Department asked that the suit be dismissed after Obama promised greater transparency in government.

Anne Weismann, CREW's chief counsel, said the group is disappointed in the ruling but it is negotiating with Obama's White House to get access to the Office of Administration's documents anyway.

"Every president except for George W. Bush has treated OA as an agency subject to the FOIA and we are counting on President Obama to do the same," she said in a statement.

I feel a growing perception from within our own government that we the people are expected to kowtow and work for them..... whether it be Bush 2, Obama or this White House Office of Administration. Our fore fathers never had that in mind and it needs corrected before it becomes an ingrained philosophy regardless of politics.

They need reminded that we the people pay for everything they have and receive, and without us they are nothing. Certainly seeing the rise of an Independent Party would benefit us and the country. The current two Parties collude for power and that would not be as likely with three or more viable Parties.

Why did the HuffingtonPost use a headline stating that the "Missing Bush E-Mails Won't Be Released, Court Says"? For starters, the court decision does not pertain to emails created by Bush administration officials. It deals with technical and records management materials from the WH OA about the *handling* of email by the White House. It deals with materials such as you would find if you went to your company's or agency's records management (RM) official and asked to see policy guidance and material on implementing an electronic document management system, or an electronic records management system. That type of email records guidance and implementation documentation from RM staff was at issue in the court case, *not* the actual content of Bush administration officials' email messages. Even if the latter had been at issue -- and it was not, not in this particular litigation --, the headline wouldn't make sense. "Missing" material can't be released on the face of it -- simply because it's not there. This case dealt with RM and IT related material known to exist in the OA. It just is beyond the reach of FOIA as long as it is part of active records in use at the WH. As for email created by Bush administration officials and maintained under the Presidential Records Act, members of the public can begin to file FOIA requests for it to the National Archives in 5 years.

What happens when the emails one is looking for never made it to the National Archives?

Hopefully, someday, we will have an honest DOJ and we will find out, just not yet!

That's a good question. I'm not sure, though, that idiocy/incomptence (of the "Office of Admin) or missing documents are the purview of the DOJ. Would the GAO have jurisdiction? I don't know if there's an enforcement provision of the Presidential Records Act (they may have assumed it would just be followed).

You know, PUMAs were over here all the time in the lead-up to the election, letting you all know what an empty suit conman Obama is. We were called racists and worse.

I'm glad a little light is getting in now, but, unfortunately, it's too little, too late.

This is just the beginning, unless...

There is one positive note. Obama is fighting, still, tooth-and-nail to not reveal his birth certificate, and school records from Occidental, and there's a good reason for that. If they are shown to the public, Barack is history, and not in a good way.

I doubt this will get posted, but if it does, please consider becoming involved in the efforts to make sure Obama is Constitutionally eligible for the office of president. I can assure you, if you research this even a little bit, you'll find that he is not.

Your point about The President's birth certificate is moot. This has already been settled. Go to snopes or any other fact check and you will find out this is over with. A big waste of time.Obama is the president and that will not change. We can only hope and pray that what he is doing is in all our interest.

HA! Yes, that is an important consideration, honestly and seriously.
(That said, Obama would be an amazingly cool m-----f----- to say, "I have the right not to release. But I'll do it anyways.")

Analogously, the Republicans are now touting the wonders of fillibuster during nominations -- a MASSIVE change from their "up or down vote!" position from just a few years ago.
