Although they both stated in January they'd try to co-parent amicably, Gossip Girl star Kelly Rutherford and estranged husband Daniel Giersch are facing off in court again in a dispute over their 2-year-old son.

Rutherford, 40, who claims son Hermes is in danger because Giersch, 34, leaves the swimming pool uncovered at his Los Angeles home, hired a private eye last week to conduct three days of video surveillance on the German businessman, court documents show.

She should be ashamed of her juvenile actions. I wish a judge would call her out on her foolishness. I know that both parties take their respective corners in a divorce, but some of these tricks are just plain old hateful, petty and pathetic.

She's older and should act like it. Take the high road.

What a time for a divorce. She's pregnant with a second child and their going to court over when to potty train the first child. Boy, I wouldn't want to be in their or their children's spot. They are going to be in court over everything if they don't start to work on this as responsible adult parents. Oh, and cover the damned pool will you man.
