AP: SAN FRANCISCO - A coalition of gay rights groups said Wednesday that a federal same-sex marriage lawsuit brought by two high-profile lawyers is premature and they'd rather work through state legislatures and voters to win wedding rights.

A day after the California Supreme Court upheld a voter-approved ban on gay marriage, the American Civil Liberties Union, Lambda Legal and other national organizations issued a statement saying they think the U.S. Supreme Court is not ready to rule in their favor on the issue.

"In our view, the best way to win marriage equality nationally is to continue working state by state, not to bring premature federal challenges that pose a very high risk of setting a negative U.S. Supreme Court precedent," said Shannon Minter, legal director of National Center for Lesbian Rights.

On Tuesday, lawyers Theodore B. Olson and David Boies, who represented opposing sides in the 2000 Bush v. Gore election challenge, announced they had filed a lawsuit in federal court on behalf of two gay men and two gay women.

Their case argues that California's voter-enacted ban on same-sex marriage, known as Proposition 8, violates the U.S. Constitution's guarantee of equal protection and due process.

Olson said he hopes the suit, which seeks a preliminary injunction against the California measure until the case is resolved, will wind up before the U.S. Supreme Court.

A favorable ruling there would allow gays and lesbians to get married in every state, just as the court's 1967 ruling in a Virginia case outlawed prohibitions on interracial marriage.

"There will be many people who will think this is not the time to go to federal," Olson said Wednesday at a news conference in Los Angeles. "Both David and I have studied the court for more years than probably either one of us would like to admit. We think we know what we are doing."

Boies agreed: "Reasonable minds can differ, but when you have people being denied civil rights today, I think it is impossible as lawyers and as an American to say 'No, you have to wait, now is not the right time.' I think if we had done that in prior civil rights battles, we would not be where we are."

Chad Griffin, a gay political consultant and former aide to President Bill Clinton, said he approached Olson about taking on the case several months ago while the California Supreme Court was considering several legal challenges to Proposition 8.

On Tuesday, the court rejected those challenges and upheld the state's gay marriage ban. The court said same-sex couples still have the right to civil unions and the law does not "entirely repeal or abrogate" the right to a protected relationship.

"For even one couple to live through even one more day in state-sanctioned second-class citizenship is too long," Griffin said.

The California court last year ruled that denying same-sex couples the right to wed violated the state constitution. An estimated 18,000 gay couples married in the months preceding the passage in November of Proposition 8, which changed the constitution to say marriage can only be between a man and a woman.

Indeed-----this (delightfully) also has the effect of the gays "cannibalizing" each other on strategy---------a LOT of people think this is a riot------(after all, there were plenty of gays who did not even think marriage was the priority issue at this juncture--­--i.e.---t­hey are MORE interested in other forms of cultural discrim.--­------jobs­, housing, et al---------this fissure will be used to the advantage of the christian right and others (AND THERE ARE MANY) who are sick and tired of San Fran. gays activists-­------sorr­y folks, that is reality ---"whether you like it or not" ----(to quote Gavin N. who has greatly impaired this issue------------

You must remember that the GLBT community is comprised of members of every other community in America; yes, even the fundamentalist christian community. There is bound to be disagreement amongst such a diverse population. If I were you I wouldn't start jumping for joy in the belief that this fact will cause the community to implode however. We have proven that we can come together when the time is right and the need is great.

sorry, but this g a y m a n lives in texas. the only way i'll see full equal civil rights in my lifetime is at the federal level.

sorry to disappoint you, but we don't all live in SFO. we're not all hair dressers and decorators (my partner and i breed horses for a living, thank you very much).

when we have marriage equality, all the other straw men preventing the glbt community from having full equal civil rights will crumble and seem arcane.

I worked for for "big-time lawyers" for over 30 years. This is an excellent idea if you believe this is a civil rights issue, which I do. Civil Rights equality under the law. Simple. Way to go, Ted and David.

Paranoia ensues.

The GLBT activists who see a problem with Olson's involvement are not doing themselves any favors.

With this news... and Rob Thomas's well-written blog entry... it is becoming clear that the level-headed straight world is beginning to speak out against their extremist counterparts (and anti-gay closet cases) to help the cause of Marriage Equality.

Olson is incredibly talented (did he not successfully make the case on behalf of our previous president during Gore v. Bush?), and his joining the legal team should be seen as one of the most significant developments for this movement thus far.

No candlelight vigil.

No signing "I DO support gay marriage."

No boycott of California.

None of those quixotic tactics have or will produce the kind of REAL progress on this issue as this unlikely "marriage" of these two giants from opposite ends of the political stratosphere.

Leave them to it... and stop it with the premature complaining.

Somehow, something is wrong here. Ted Olsen is an arch-federalist, and not to be trusted. Could he be pushing this case prematurely, while there's still a conservative majority under John Roberts?

Maybe I am being paranoid, but Olson's involvement in this case is making me wonder. Maybe this is a new tactic by anti-gay-marriage forces to get the Supreme Court to step in. Given the conservative bent of the SCOTUS, the chances of a ruling favorable to gay rights are low.
This will certainly energize the GOP conservative base - in time for 2010 elections - and if SCOTUS rules against gay marriage, the gay rights cause will be set back by years, if not decades.

htis site is turning into a murdoch style media event. palin story gets more play then gay marriage decision in ca, and the move to take an appeal through the fedeal courts. i used to come to this site several times a day, now i surf when i get to it and quickly get out of this declining neighborhood!

unless Scalia, Thomas, Alito, Roberts, Schwartneggar, Jindal, Palin, Gingrich, McCain, and all the other GOP goons can finally PUT A FACE ON - what being gay looks likes... a face of one of their own loved ones... a close family member... they can't relate to the fact that life, liberty, pursuit of happiness, love, life commitment, and recognized 'marriage' all comes in different sizes, shapes, colors, and genders. It's time for Funk & Wagnell to redefine love and marriage..­. not according to an outdated, impractical and unrealistic definition that was written thousands of years ago... but today, May 28, 2009. This country needs to catch up with the times.

My prediction on how this is going to shake out. Olson will get his way, the Supreme Court will agree to hear the case. The verdict: there is no right to gay marriage anywhere in the Constitution. A right-wing warrior will shrug his shoulders, say "oops" and be a hero to the wingnut brigade. Meanwhile, the cause of gay equality will be set back for years, if not decades, as everywhere the issue is raised, those raising it will be reminded ad nauseum that the Supreme Court has already "ruled" on the issue. Between Roberts, Scalia and Thomas the outcome is pre-determined. And don't think Olson doesn't already know this. Case closed.

Oh, Chicken Little...

The case will not be about GRANTING gay marriage rights explicitly. I would be against that too - and I'm gay!

The issue is the 14th Amendment. EQUAL PROTECTION.

GLBT people seem to be too close to the subject to figure out this very simple fact. Which is why it is VITAL for this fight to be led by STRAIGHT PEOPLE... because they see it from a very objective point of view.

STOP asking for special treatment.­.. Because we DON'T need or want to be treated any differently than the next guy.

START asking for equal treatment.­.. Then you'll start seeing progress.

Obama leads.

Now, we have a President that follow the Constitutional mandate of his role. He leads but clearly not in the way you want.

But he is not the only person who can lead. Do not put all your hope and disppointments on Obama. Find alllies where we can. Lobby everyone.

If you look at how past presidents dealt with civil rights issues, you can clearly see them taking a leading role. How has Obama taken a leading role in the fight for civil rights? And saying 'just words' is not enough. I'm talking action.
