WERNERSVILLE, Pa. — In a cold dose of reality for reality TV, Pennsylvania's Labor Department has opened an investigation into whether the hit show "Jon & Kate Plus 8" is complying with state child labor laws.

The TLC series about two parents raising 8-year-old twins and 5-year-old sextuplets drew nearly 10 million viewers for its fifth-season premiere Monday _ more than double the audience for its fourth-season finale several weeks ago _ following media reports that the parents, Jon and Kate Gosselin, had cheated on each other. They denied it, but conceded their marriage is in trouble.

TLC said Friday it "fully complies" with state laws and regulations.

The Labor Department received a complaint against the show and is "gathering information" from its representatives, department spokesman Justin Fleming told The Associated Press. Fleming would not say when the complaint was filed or who filed it.

The fact a complaint is being investigated doesn't necessarily mean the department believes the show did anything wrong.

"Any complaint we get, we investigate," Fleming said.

Child actors and other young performers are protected by Pennsylvania labor law, but it's not clear whether the law applies to reality TV. Investigators will have to decide whether the Gosselins' house in southeastern Pennsylvania is essentially a TV set where producers direct much of the action _ in which case the law may apply _ or if it's a home where the kids aren't really working but are simply living their lives, albeit in front of the cameras.

Kate's brother and sister-in-law made waves this week by saying the Gosselins are exploiting their children for financial gain. Jon and Kate Gosselin are reportedly paid tens of thousands of dollars per episode.

"Unfortunately, I think it has come down to all about the ratings," sister-in-law Jodi Kreider told CBS' "The Early Show." "And no one is looking at these children as what they are going through and the life consequences they are going to have as they get older."

Kreider said the children have told her they don't like the cameras.

Her husband and Kate's brother, Kevin Kreider, said in the same interview: "You can't imagine as a child realizing that my birthday party, that all the outings that my parents took me on were ... for ratings, and all organized by production companies."

TLC spokeswoman Laurie Goldberg said in a statement Friday that the network "fully complies with all applicable laws and regulations" for all shows.

"For an extended period of time, we have been engaged in cooperative discussions and supplied all requested information to the Pennsylvania Department of Labor," Goldberg said.

Child labor laws vary by state. Pennsylvania law permits kids who are at least 7 to work in the entertainment industry, as long as a permit is obtained and certain rules are followed. Kids can't generally work after 11:30 p.m., for example, or perform any place that serves alcohol.

The law allows performers younger than 7 to have "temporary employment ... in the production of a motion picture," and spend up to eight hours a day and 44 hours a week on set as long as their "educational instruction, supervision, health and welfare" needs are being met.

In contrast, California has more elaborate rules governing the work of child performers, establishing working hours by age group (20 minutes a day for infants, up to six hours for older kids) and requiring a teacher to be on the set.

"Jon & Kate Plus 8" tapes off and on throughout the year, averaging two to three hours a day, two to three days a week, Goldberg said.

George Voegele, a labor lawyer at Cozen O'Connor in Philadelphia, said the state Labor Department might well decide it doesn't have jurisdiction over the show, especially if investigators determine the cameras are there to document the kids, not direct them.

"The fundamental question I see here is whether or not they're employees, whether they're working, and whether the Pennsylvania child labor law provisions would even apply to this situation," he said.

The Pennsylvania investigation recalls a 2007 controversy surrounding "Kid Nation," a CBS reality show about 40 children given the task of organizing and running their own lives in New Mexico.

The Screen Actors Guild and others suggested the children were being exploited and one trade magazine said the show was skirting New Mexico labor laws by declaring the production a "summer camp." Producers denied the accusations; the show lasted 13 episodes.

Seeking more space for their brood, the Gosselins moved in October into a $1.1 million house on nearly 24 acres with a white picket fence and gated, tree-lined driveway.

A few miles away, in the small town of Wernersville, everyone seems to have an opinion about the sharp-tongued Kate and her long-suffering husband.

Amanda Baez, 32, an assistant at her mother's Wernersville hair salon and an avid watcher of the show, said she's not concerned about the children's welfare.

"This is all the children know, especially the sextuplets since they were babies. They grew up with cameras in their faces. They grew up with the production," she said. "It's probably like having their aunt and uncle with the family video camera just watching you."

The Dionne Quintuplets were born in 1934 and the abuse they speak of came from living in a compound where, "Approximately 6,000 people per day visited the observation gallery that surrounded an outdoor playground to view the Dionne sisters. Ample parking was provided and close to three million people walked through the gallery between 1936 and 1943."

Getting worked up over the perceived harm to these kids appears to be more about condemning their parents for their supposed 'greed' considering the millions of Americans who barely get to see their children because of hours they work. Instead of hating Kate or Jon 'for the sake of their children of course' why not help out in your neighborhood and be an advocate for a kid who doesn't have TLC to back them up.

Plus -it's LUDICROUS to see/hear the parents claim they "work" so hard, but yet the kids are not working....??? I call BS on it, and again ALL CHILDREN IN ENTERTAINMENT WHETHER SCRIPTED OR NOT DESERVE RIGHTS AND PROTECTIONS!!!

Please folks, these kids are nothing more than the modern equivalent of the Dionne Quintuplets: with every moment videotaped for the cameras and shown pretty 24/7 every where. The show went from being fairly sweet to this train wreck because the parents seem to be greedy. Did they really NEED a 1.1 MILLION mansion? $1,600/day bodyguard for the wife? Will these poor kids ever see a PENNY of the money their childhood's earned? Not to mention, if we're seeing the birth mother on every magazine and news show or out signing autographs, and the birth father is out drinking - who IS REALLY PARENTING THOSE KIDS? Paid help. Sad, sad, sad. ALL CHILDREN IN ENTERTAINMENT - whether scripted or not - need the SAME compensations across the board in all 50 states - as California enacted, along with a new version of "Coogan's Law" to protect their earnings. FREE THE GOSSELIN EIGHT!!!!

What does Kate talk about for $4,000 an hour.?I heard she does lecture tours around the country. What does she have to add to our society really????? I have raised four children and they are decent human beings, 2 in college and 2 on their way to college. I have a stable marriage and I work like a horse to make ends meet like most of us here in US and the world. What makes J&K deserve this attention???? Help me understand what do J&K add to our society? and Why are we interested in their lives??? Are they good role models??? Why do we have Octomom following in their steps?

Okay - IANAL, but it seems like the specifics regarding the legal protections of the kids would be fairly simple to clarify. If they are named or referred to as part of the show's contract w/TLC, then they aren't just "bystanders".

Easy way to determine the kids' role if the contract is unclear: remove them from the show and continue taping. If the show is predicated­/dependent on the presence of the children, then not offering them legal protections/ contractual powers - likely through their parents would be inappropriate if not illegal.

TLC states it is in full compliance of all laws and regulations, so they are fully aware of the status of the childrens' role as employees or not. They can't be in compliance with the law without knowing the laws applicable for the kids.

If the article above is correct, PA law states that children, just _7 years old and YOUNGER_ involved in entertainment work may "spend up to eight hours a day and 44 hours a week on set" as long as their education and health needs, etc. are met.

um... WHAT? Adults have a hard time attending school while working full time. How could anyone think that 1st graders or younger can handle it better? If they're taping 2-3 hours a day/ 2-3 days a week, the work necessary prior to/after the "taping" goes far beyond these few hours and generally involve the kids who have no choice in the matter.

In roughly 10 years, I see the sequel to "Mommie Dearest" coming to a theater near you.
Cara and Mady will then be of age to give us the real "behind the scenes" version of Jon and Kate + 8.

As where Joan Crawford's mantra was "No wire hangers!",
Kate Gosselin's is "Not without a coupon!"

I would hope that soon a smart investigative reporter will get the names of the people who have had access to the Gosselin house/set for filming and other activities of the show, and then run them against pred lists.

With the lack of regard that J&K and TLC have shown for the welfare of the kids, I would not be surprised if they didn't bother to run background checks themselves.

Very good idea. Also, boycott the advertisors (especially the ones with the ubituitous product placements on the show), and write to their board members to let them know why you are boycotting the show, and what you think about a company that would advertise on a show where the children are being exploited for profit.

Laws are on the books to protect kids in show biz. The laws are very clear, and if they are violated, it can shut down an entire production. Personally, I do think these kids already were abused. I think having to be on a show with parents who are too stupid, selfish, ego centric is abuse in itself. Using kids to further thier careers, wealth is abuse. If it was me, i would shut it down.

Well, "exploitation" is "abuse," and you describe exploitation by he parents, so I think you are making a case for the kids being exploited and abused.

And it might be more serious abuse than we know about. J&K have allowed very intimate access to their kids to the TLC filming crews and ancillary staff. THe cameras follow them into their bedrooms.

I do hope they have done background checks on all of the people who have access to the kids. Kate is gone 20 days out of a month, and Jon is very busy boinking a schoolteacher. They have shown they have priorities more important than the kids' welfare

These laws vary (dramatically) state by state. CA has far more rigorous laws than PA apparently has.

If there is anything I have learned in researching state laws is that the only thing they have in common is their LACK of clarity/co­nsistency.

Which laws are you referring to - which state/code­/chaper/ti­tle/sectio­n clarifies this so well? I would love nothing more to find out there is one...

By the way - I agree with you, and my prior post was not meant to be combative to you - but to be combative with the insanity of what we call "laws", which are usually only specific (and therefore protective) for state/government issues and personnel.

Federal and state codes/statues seem annoyingly and frustratingly vague when they pertain to the rest of us. Not always, but this seems to be the case more often than not...
