WERNERSVILLE, Pa. — In a cold dose of reality for reality TV, Pennsylvania's Labor Department has opened an investigation into whether the hit show "Jon & Kate Plus 8" is complying with state child labor laws.

The TLC series about two parents raising 8-year-old twins and 5-year-old sextuplets drew nearly 10 million viewers for its fifth-season premiere Monday _ more than double the audience for its fourth-season finale several weeks ago _ following media reports that the parents, Jon and Kate Gosselin, had cheated on each other. They denied it, but conceded their marriage is in trouble.

TLC said Friday it "fully complies" with state laws and regulations.

The Labor Department received a complaint against the show and is "gathering information" from its representatives, department spokesman Justin Fleming told The Associated Press. Fleming would not say when the complaint was filed or who filed it.

The fact a complaint is being investigated doesn't necessarily mean the department believes the show did anything wrong.

"Any complaint we get, we investigate," Fleming said.

Child actors and other young performers are protected by Pennsylvania labor law, but it's not clear whether the law applies to reality TV. Investigators will have to decide whether the Gosselins' house in southeastern Pennsylvania is essentially a TV set where producers direct much of the action _ in which case the law may apply _ or if it's a home where the kids aren't really working but are simply living their lives, albeit in front of the cameras.

Kate's brother and sister-in-law made waves this week by saying the Gosselins are exploiting their children for financial gain. Jon and Kate Gosselin are reportedly paid tens of thousands of dollars per episode.

"Unfortunately, I think it has come down to all about the ratings," sister-in-law Jodi Kreider told CBS' "The Early Show." "And no one is looking at these children as what they are going through and the life consequences they are going to have as they get older."

Kreider said the children have told her they don't like the cameras.

Her husband and Kate's brother, Kevin Kreider, said in the same interview: "You can't imagine as a child realizing that my birthday party, that all the outings that my parents took me on were ... for ratings, and all organized by production companies."

TLC spokeswoman Laurie Goldberg said in a statement Friday that the network "fully complies with all applicable laws and regulations" for all shows.

"For an extended period of time, we have been engaged in cooperative discussions and supplied all requested information to the Pennsylvania Department of Labor," Goldberg said.

Child labor laws vary by state. Pennsylvania law permits kids who are at least 7 to work in the entertainment industry, as long as a permit is obtained and certain rules are followed. Kids can't generally work after 11:30 p.m., for example, or perform any place that serves alcohol.

The law allows performers younger than 7 to have "temporary employment ... in the production of a motion picture," and spend up to eight hours a day and 44 hours a week on set as long as their "educational instruction, supervision, health and welfare" needs are being met.

In contrast, California has more elaborate rules governing the work of child performers, establishing working hours by age group (20 minutes a day for infants, up to six hours for older kids) and requiring a teacher to be on the set.

"Jon & Kate Plus 8" tapes off and on throughout the year, averaging two to three hours a day, two to three days a week, Goldberg said.

George Voegele, a labor lawyer at Cozen O'Connor in Philadelphia, said the state Labor Department might well decide it doesn't have jurisdiction over the show, especially if investigators determine the cameras are there to document the kids, not direct them.

"The fundamental question I see here is whether or not they're employees, whether they're working, and whether the Pennsylvania child labor law provisions would even apply to this situation," he said.

The Pennsylvania investigation recalls a 2007 controversy surrounding "Kid Nation," a CBS reality show about 40 children given the task of organizing and running their own lives in New Mexico.

The Screen Actors Guild and others suggested the children were being exploited and one trade magazine said the show was skirting New Mexico labor laws by declaring the production a "summer camp." Producers denied the accusations; the show lasted 13 episodes.

Seeking more space for their brood, the Gosselins moved in October into a $1.1 million house on nearly 24 acres with a white picket fence and gated, tree-lined driveway.

A few miles away, in the small town of Wernersville, everyone seems to have an opinion about the sharp-tongued Kate and her long-suffering husband.

Amanda Baez, 32, an assistant at her mother's Wernersville hair salon and an avid watcher of the show, said she's not concerned about the children's welfare.

"This is all the children know, especially the sextuplets since they were babies. They grew up with cameras in their faces. They grew up with the production," she said. "It's probably like having their aunt and uncle with the family video camera just watching you."

All of you idiots who are saying there are far worse things going on----You are right! But that does not mean we should look away because these kids live in a nice home and have food on the table. There are injustices being done to these children and they deserve to be protected not paraded, for our entertainment. These children are lugged all over the place at all hours for their shows ratings. Cameras zero in on them when they are screaming, crying , throwing up, sleeping, pooping.
Come on !
If the filming of every childhood vacation, milestone, activity contiues-what will they remember as they get older-This is what helps define us as human being, our upbringing, and to think that it all may have just been for ratings or for TV? What might that do to them? Disgraceful

The point is, they might be rich kids now, but not rich adults after they grow up. This should be looked into. There would be no show without the children, but it's possible the parents might be taking all the money that should rightfully be put into a trust for those kids. A lot of people worked very hard to get child labor laws enacted in Hollywood that would protect child TV and movie stars. Similar laws might not be on the books in Pennsylvania. It deserves an investigation.

When making movies, casting directors hire twins or triplets to play one character because kids have only a limited number of hours they are allowed to work each day. And having cameras in your face all day would be illegal. Don't you find it strange that the older girls don't seem to have friends?

How do you have access to the identity of the person who placed the complaint? And, if you do know the person, how do you kno their motivation? Are you a psychic?

"Attacking the messenger" is a type of ad hominem logical fallacy, when one tries to detract from the opinion or claim by criticizing the person who made it.

The motivations of whomever made the complaint and the truth of the complaint are two separate issues. Just like the prosecuting attorneys in the Nuremberg trials possibly having a desire to make a name for themselves by their role in prosecuting N. azi criminals would have no impact on the guilt or innocence of those who ran Dachau and supervised the final solution.

TLC bought the house. I can see no way an argument can be made that the TLC-bought house, where they have access to film the family 24/7, even in the kids' private bedrooms, is not a film set.

Agreed, especially for any kids under the age of 13 or 14. Once the kids get to be teenagers, they will certainly let you know if they feel their privacy is being violated in any way.

Are they in Pennsylvania? No, so that is obviously the reason the Pennsylvania Department of Labor will not intervene if the other cases you talk about.

What isn't fair is the parents making money by selling the "cuteness" of their children and the children getting nothing but a screwed up childhood and some nice vacations they won't remember when they are adults.

Gloria Allred, backed by Paul Peterson's "A Minor Concern" nonprofit has filed suit to protect the earnings of the Octobreeder's kids. Peterson, seeing how many child actors reached age 18 without a penny to their name, thanks to the parents pilfering their earnings, started the organization to get laws passed to stop this kind of theft and abuse.

The Gosselin kids--it is such a horrible situation. Strangers with cameras have 24/7 access to the kids, even in their private bedrooms, while the parents are off focused on their other priorities.

At first, it seemed OK for TLC or Discovery or whatever to broadcast documentaries about this family. In fact, I think it might have been helpful to people considering fertility treatments to see what the experience is like to handle this many children. But the continuing show "Jon and Kate Plus 8" has gone on too long. I say leave these kids alone to have a private life. By now, all the unflattering comments that have been made on the internet can do nothing but hurt these kids in the long run.
Stop the insanity. Stop watching the show.

It is definately about time this is investigated! And they better not take TLC or the Gosselin parents word on how much time the cameras are on. Gosselins are known liars, you cannot believe a word they say. Viewers have known all along that they have filmed 4x weeek from morning to night. The house is set up like a studio for God's sake. There was a whole episode of them taking the fluorescent lighting down when they moved out of their old house. I just cannot believe it has taken 4 years to investigate this fraud! They claim the kids are not "working" BS--or maybe it could be true, because they are not getting paid-the parents are. It does not change the fact that children should not have cameras in their lives as they are showering, potty training, fighting, sick etc! Again It is about damn time!

The divorce just illustrate that this family is not emotionally stable and that the children are indeed at risk. The mother has now full control of the family and has fired "over 40" staffers, who, it is reasonable to believe, expressed concern for the welfare of these kids. 1 cra-Z and controlling person should not have complete control over 8 kids whether or not she is the biological mother and "lay on her back for 20 weeks" or whatever line she pulls when anyone questions her motives.

The divorce is not part of the complaint. It's the exploitation and abuse the kids are suffering so their parents can devote their lives to other priorities.

People tune in to watch Kate repeatedly immasculate and humiliate her husband and generally act like a complete psycho. It's the same reason people tune into Rock of Love or any of the shows on VH1: to see crazy women act crazy. The only difference is this crazy woman his kids. Lots and lots of kids.

I have only caught it a few times when there was nothing else on, and when I watched Kate actually berate her husband because of the way he was breathing, I decided to never watch it again.

This show is the epitome of voyeurism. This pitiful couple have found their "pot o' gold." They are going to drain it. and to hell with what is best for their their kids.

I don't watch the show, but see umpteen commercials for it every day. I suppose that certain people's desire for money knows no boundaries.

Personally, they both disgust me.
