I Like ItI Don’t Like It

AP: WASHINGTON — President Barack Obama expressed confidence Saturday that efforts to scuttle Sonia Sotomayor's nomination to the Supreme Court will fail despite intensified scrutiny of her judicial career. He said senators should work quickly to elevate the federal appeals judge.

"I am certain that she is the right choice," the president said in his weekly radio and Internet address in which he scolded critics who he said were trying to distort her record and past statements. Those include her 2001 comment that a female Hispanic judge would often reach a better decision than a white male judge.

With the Senate returning this coming week from its holiday break, Obama said he hopes it begins the confirmation process without delay. He said he expects his nominee to be on the bench when the Supreme Court begins its new term in October.

In the interim, Obama said he expects "rigorous evaluation" of his nominee but added: "What I hope is that we can avoid the political posturing and ideological brinksmanship that has bogged down this process, and Congress, in the past."

He derided "some in Washington who are attempting to draw old battle lines and playing the usual political games, pulling a few comments out of context to paint a distorted picture of Judge Sotomayor's record."

"But I am confident that these efforts will fail," Obama added, "because Judge Sotomayor's 17-year record on the bench _ hundreds of judicial decisions that every American can read for him or herself _ speak far louder than any attack; her record makes clear that she is fair, unbiased and dedicated to the rule of law."

On Friday, Obama personally sought to deflect criticism about Sotomayor's comment in a 2001 lecture that "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

The quote in question from Sotomayor has emerged as a rallying call for conservative critics who fear she will offer opinions from the bench based less on the rule of law and more on her life experience, ethnicity and gender. That issue is likely to play a central role in her Senate confirmation process.

Story continues below

"I'm sure she would have restated it," Obama told NBC News, without indicating how he knew that.

Obama also defended his nominee, saying her message was on target even if her exact wording was not.

"I think that when she's appearing before the Senate committee, in her confirmation process, I think all this nonsense that is being spewed out will be revealed for what it is," Obama said in the broadcast interview, clearly aware of how ethnicity and gender issues are taking hold in the debate.

A veteran federal judge, Sotomayor is poised to be the first Hispanic, and the third woman, to serve on the Supreme Court She appears headed for confirmation, needing a majority vote in a Senate, where Democrats have 59 votes. But White House officials also want a smooth confirmation, not one that bogs down them or their nominee.

As a senator, Obama supported a failed attempt by Democrats to stall President George W. Bush's nomination of Samuel Alito to the high court.

The mosre I hear Limbaugh and Hannity the easier it is for me to understand how the NAZI's took over in Germany. These guys think that if they just lie well enough and often enough that it will become the "truth."

What is really going on here, is a full court press by the con media and perhaps even the so called main stream media to raise such a ruckus that they hope she will pull her name without any of the racist and bigoted senators having to actually get into the fray by doing the dirty work the righwing press is doing for them.

Think about it. The press is happy to oblige the racists, bigots and total ignorance being presented by these people as though they couldn't be happier about the idea of bringing down a nominee through lies and racism. ANYONE with two brain cells to rub together knows exactly what she meant and so do the cons and their lapdogs in the media.

And the press wonder why the public has such disdain for them.

I just hope that if BO gets to nominate another justice he will go for an outright liberal justice and stop trying to pick a moderate. Elections matter. You can be sure a President McCain would name a conservative justice had he been given that opportunity.

Joseph A. Palermo:

Is Sotomayor more likely to please the right or the left from the bench?

This noise from the GOP keeps obscuring that central question.

Of course the GOP is making the most outrageous noise. But look at what it accomplishes -- Democratic and Independent voters flocking to support her, without knowing a thing about her. She's no liberal. Her rulings, from what I've seen of them, are anti-populist.

I don't care what the gender or ethnicity of a SC justice is; I care that a SC justice interprets the laws from a populist's perspective of what's in the Constitution. A man could do it, an Asian could do it, anyone could do it.

Populist and liberal are not the same, Einstein. There are tons of right-wing "populists".

But coming from a tool who defined Sotomayor's judicial philosophy based on what he knows by the other Hispanics like her he's met, that's to be expected.

Yeah, sure. We know all 'dem dare hispanics think the same.

I agree women bring a different, not necessarily better perspective to the bench. And if the world is fair half of all judges should be women. But your second sentence is borderline sexist.

I object to the sentence:

"Sometimes women make decisions that are so wrong, especially about big things."

Do you?

Why is it being far to the right is OK and being on the left or being liberal is wrong?

What is this obsession by the conservatives that liberalism is bad for America? All they have to do is to take a hard look at the US Constitution.

I am no expert on Constitution. But my understanding is it is an ultimate product of liberal thiinking. It upholds good old values. But it also embraces new and progressive liberal values.

To suggest that it is OK for the US Supreme Court to lean heavily on the right, as it constitutes now, and wrong for some of its members to be progressive is the most biased and hypocritical statement one can imagine.

You have highlighted the point that this is not an intellectually honest debate about the SC or, particularly, the nominee. MSM is creating a ruckus for ratings and the rethugs had their "opposition points" of the candidate drawn up before the candidate was even known.
Hence there is no credibility at all in anything MSM or the rethugs choose to be outraged about at this point. All they have shown is outrage, regardless of the issues or people and some have openly declared that they will be obstructive and want the country to fail.

I have seen Posts ( Right wings websites Granted) in regards to Sotomayor being anti-second amendment and how she is agaisnt private ownership of guns

Since the majority/all the threads I can find on it are of the far right nature in politics, it diminishes the authenticity of the comments in her beliefs in regards to the second amendment.

What are other thoughts and findings in this regards?

The NRA is spewing their usual fear-mongering. The SCOTUS has RULED (last session) that private ownership of GUNS Is LEGAL. It does not matter what Judge Sotomaor thinks on that particular issue. It has little or no bearing on the confirmation hearings. She cannot overturn the Heller Decision by herself. The only real recourse for the Progressive Wing of the Democrats is to attempt to invalidate/repeal the 2nd Amendment. It can be done, but it will be a very hard slog to do it.

The leading proponent of the Unitary Executive is Clarence Thomas (and perhaps Scalia). I really don't think Judge Sotomayor will be lining up with Thomas or Scalia on many issues. I also don't envision her employing a John Yoo as a clerk as Thomas did.

What some folks dont get is that Liberalism is the foundation of the US constitution that means if you get a Supreme Court justice that Follows the constitution and upholds the rule of law those on the left should be happy.

We need to stop acting like Upholding the constitution is a bad thing for those on the left. It should be the most important ingredient we look for in a Supreme Court justice.

Common Sense is the basis Liberalism. President OBama gets that Sotomayor gets that hence why they are for upholding the Constitution.

I find it troubling that Liberals make it seem that upholding the constitution is something the republican justice do thats BS. The constitution is a document that embraces LIBERALISM.

I'm sick of this BS where Liberals allow Rethugs to define them as actvist judge who wants to change or interpret the constitution loosely thats BS. IF anyone does that its republicans and we need to stop falling for their ig norance.

This woman will make a good judge because she believes in the rule of law and upholding the constitution. THats what we WANT.

The RATS on the SCOTUS tend to look at the Constitution as something to be gotten around rather than establishing the stated principles of our government. They really tie themselves in knots sometimes to avoid actually stating that people (us serfs) have something called rights ( except for the right to own a gun of course)

If Roe v Wade was such a big deal for the Conservatives, than why after having all three branches of
