AP: WASHINGTON — President Barack Obama expressed confidence Saturday that efforts to scuttle Sonia Sotomayor's nomination to the Supreme Court will fail despite intensified scrutiny of her judicial career. He said senators should work quickly to elevate the federal appeals judge.

"I am certain that she is the right choice," the president said in his weekly radio and Internet address in which he scolded critics who he said were trying to distort her record and past statements. Those include her 2001 comment that a female Hispanic judge would often reach a better decision than a white male judge.

With the Senate returning this coming week from its holiday break, Obama said he hopes it begins the confirmation process without delay. He said he expects his nominee to be on the bench when the Supreme Court begins its new term in October.

In the interim, Obama said he expects "rigorous evaluation" of his nominee but added: "What I hope is that we can avoid the political posturing and ideological brinksmanship that has bogged down this process, and Congress, in the past."

He derided "some in Washington who are attempting to draw old battle lines and playing the usual political games, pulling a few comments out of context to paint a distorted picture of Judge Sotomayor's record."

"But I am confident that these efforts will fail," Obama added, "because Judge Sotomayor's 17-year record on the bench _ hundreds of judicial decisions that every American can read for him or herself _ speak far louder than any attack; her record makes clear that she is fair, unbiased and dedicated to the rule of law."

On Friday, Obama personally sought to deflect criticism about Sotomayor's comment in a 2001 lecture that "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

The quote in question from Sotomayor has emerged as a rallying call for conservative critics who fear she will offer opinions from the bench based less on the rule of law and more on her life experience, ethnicity and gender. That issue is likely to play a central role in her Senate confirmation process.

"I'm sure she would have restated it," Obama told NBC News, without indicating how he knew that.

Obama also defended his nominee, saying her message was on target even if her exact wording was not.

"I think that when she's appearing before the Senate committee, in her confirmation process, I think all this nonsense that is being spewed out will be revealed for what it is," Obama said in the broadcast interview, clearly aware of how ethnicity and gender issues are taking hold in the debate.

A veteran federal judge, Sotomayor is poised to be the first Hispanic, and the third woman, to serve on the Supreme Court She appears headed for confirmation, needing a majority vote in a Senate, where Democrats have 59 votes. But White House officials also want a smooth confirmation, not one that bogs down them or their nominee.

As a senator, Obama supported a failed attempt by Democrats to stall President George W. Bush's nomination of Samuel Alito to the high court.

Pres. Obama empathizes with Judge Sotmoyor because he went through the same thing with the republicans and the Clintons during the campaign.

Anytime, we minorities are trying to aspire to powerful positions are race comes into play--the constant questions as to whether we are truly qualified because whites don't believe it. We are scrutinzed more thoroughly in everything we do than whites.

Notice how people didn't have to know anything about Sarah Palin, but the day after she gave her speech at the Republican convention, many rethugs thought she was more qualified than Obama and they didn't even know anything about her. It was the democrats who tried to vet her. The media didn't go after her in a more serious way. They only attacked her for the trivial stuff like the clothes etc. How come they didn't attack on 24/7 regarding her ethics comlaint, her husbands affilliations with that secession group, her comment about another legislature being a cancer bi!ch--a comment she made on the radio.

They're just all hypocrites, who cant even do a little research or give credence to FACTS unless it serves their own sad purposes.

The GOP needs to stop their off-the wall attacks. Sotomayor is actually not particularly controversial. She has more experience than any of the active SC justices did when they were cofirmed and she has ruled on the basis of the law time and time again.

I think it was a brilliant move on behalf of Obama to select Sotomoyor--to further erode the republican party, but I don't like hispanic groups trying to bully the government and senators that they had better kiss their a$$es if they want to stay in power. All these various groups are doing the same thing. The gay groups, hispanics, I haven't heard too much from African-American groups. But this needs to stop because this is going to further tarnish race relations if whites are made to feel that they had better kiss the butts of minorities.

I'm an African-American woman and I do agree with civil rights organizations that serve all cultures, but I do not agree with separate race-based groups that seeks to advance the causes of their race. If we don't want whites establishing race-based groups, then other minorities shouldn't be doing it either. I remember when I was in college and I was appalled that we had a black student union, an asian student union, a hispanic student union. I know our history, but I don't want us to repeat history by creating these separatist societies and further erode race relations. I can't stand Rush Limbaugh, but I was happy that he made the comment about not kissing the a$$es of hispanics because their not going to get their vote anyway.

If you go back and do some research you would find that although he joined the effort to filibuster Alito he had reservations. He also had a clear reason why he thought Judge Alito shouldn't be nominated. This is what he said...

On January 29, 2006, Mr. Obama told George Stephanopulos on "This Week" that he would "be supporting the filibuster because I think Judge Alito, in fact, is somebody who is contrary to core American values, not just liberal values, you know. When you look at his decisions in particular during times of war, we need a court that is independent and is going to provide some check on the executive branch, and he has not shown himself willing to do that repeatedly."

On the Dems fiibuster...
"I think that the Democrats have to do a much better job in making their case on these issues," then-Sen. Obama said. "These last-minute efforts using procedural maneuvers inside the Beltway, I think, has been the wrong way of going about it, and we need to recognize because Judge Alito will be confirmed that if we're going to oppose a nominee that we've got to persuade the American people that, in fact, their values are at stake and frankly I'm not sure that we've successfully done that."

He's clearly correct
There is not a unified front against her nomination. Its just rhetoric. She is going to sail through the actual confirmation vote
She is a centrist. This is who the conservatives wanted. The talk radio people and republicans who are in right wing districts are just putting on a show to appease their base.
There would only have been a real fight if Obama tried to actually move the court to the left. Instead of replacing a centrist (Souter) with another centrist

Here, and elsewhere, I've challenged wingnuts to come up with the evidence that Sotomayor is/was/would be "racist" in her opinions. And no one has to date...why not? Perhaps because of this over at DailyKos:

Tom Goldstein does something novel over that SCOTUSblog and actually looks at Sonia Sotomayor's record:

Other than Ricci, Judge Sotomayor has decided 96 race-related cases while on the court of appeals.

Of the 96 cases, Judge Sotomayor and the panel rejected the claim of discrimination roughly 78 times and agreed with the claim of discrimination 10 times; the remaining 8 involved other kinds of claims or dispositions. Of the 10 cases favoring claims of discrimination, 9 were unanimous. (Many, by the way, were procedural victories rather than judgments that discrimination had occurred.) Of those 9, in 7, the unanimous panel included at least one Republican-appointed judge. In the one divided panel opinion, the dissent’s point dealt only with the technical question of whether the criminal defendant in that case had forfeited his challenge to the jury selection in his case. So Judge Sotomayor rejected discrimination-related claims by a margin of roughly 8 to 1.

I taught English as a Second Language and my students used the term la raza to refer to their community. The term had nothing to do with race but with their latino community. They translated "La Raza" as "The Community" with no race context at all. I'm sure their website provides their translations of their name and agenda.

Exactly what do you think the alternatives were for the new Administration? It will take a year or more just to move our equipment and troops out of the Iraq theatre. We started a mission in Afghanistan and abandoned it to regain control of Iraqi oil and oust Iraq's leader because Dubya held him responsible for the assassin.ation attempt on his father that was thwarted. Saddam had nationalized his country's oil and thrown out western countries which Haliburton and other interests were instrumental in persuading Dubya was a major problem for them and their shareholders. You are right that we have lost our taste for war and with the erosion in public support it will become necessary to leave Afghanistan sooner rather than later. Pinning this on the new Administration is counterintuitive to the mess he was left with. His options are few.

The politicians get to look "statesmen", and in the end she gets confirmed and turns out to be very much a moderate, perhaps even closer to Kennedy than Souter.
