WASHINGTON — CIA Director Leon Panetta told a federal judge Monday that releasing documents about the agency's terror interrogations would gravely damage national security.

Panetta sent a 24-page missive to New York federal judge Alvin Hellerstein, arguing that release of agency cables describing tough interrogation methods used on al-Qaida suspects would tell the enemy far too much about U.S. counterterrorism work.

The CIA director filed the papers in a lawsuit brought by the American Civil Liberties Union. The suit has already led to the unveiling of Bush administration legal memos authorizing harsh methods _ among them waterboarding, a type of simulated drowning, and slamming suspects into walls _ and a fight over releasing long-secret photos of abused detainees.

"I have determined that the disclosure of intelligence about al-Qaida reasonably could be expected to result in exceptionally grave damage to the national security by informing our enemies of what we knew about them, and when, and in some instances, how we obtained the intelligence," Panetta wrote.

Panetta acknowledges in the court papers that the CIA destroyed 92 videotapes of detainee interrogations that took place in 2002. Officials have previously said that a dozen of those tapes showed the so-called "enhanced interrogation techniques," which critics call torture. The destruction of the videotapes has spurred a criminal investigation into why they were destroyed.

The tapes _ and the interrogations _ are also an issue in the ACLU's lawsuit.

The CIA is fighting efforts to force release of the documents, including dozens of agency cables. The cables, Panetta said, describe in detail the methods used on terror suspects, the information gleaned from them and what U.S. officials still did not know at the time the suspects were being questioned.

The CIA last month denied a request by former Vice President Dick Cheney to declassify secret memos that detail whether valuable intelligence was gained from the use of the harsh interrogation techniques. Cheney said the documents show that the tactics prevented terrorist attacks and saved lives, contrary to the Obama administration's criticism of the Bush-era policies.

President Barack Obama also said last month he would try to block the court-ordered release of photos showing U.S. troops abusing prisoners, reversing his position out of concern the pictures would "further inflame anti-American opinion" and endanger U.S. forces in Iraq and Afghanistan.

This is the accused trying to make everyone believe they are not the accused. Pretty much like the soldier who says I was just following orders, or the guy who drives the getaway car in a bank robbery who says I was forced to do it. This is a tactic to skew the facts and perform a cover-up that allows the guilty to escape unharmed, the tactice that every shyster lawyer uses if you have enough money to be able to afford one.

Panetta's argument about releasing information about torture doesn't hold up well.

He keeps confabulating the release of information about torture with the release of other information about our knowledge of al-Qaeda activities and claiming that release of the other information would aid the enemy.

Don't release information about our knowledge of al-Qaida activities - just release information about the torture of prisoners.

On the darker side, I suspect that many American people are not fully prepared to accept the methods that the CIA has been using.

There is plenty of circumstancial evidence that the CIA and the military have been holding women and children and other family members hostage and perhaps torturing them and perhaps releasing selective information to the press about their mistreatment as part of an effort to induce collaboration by relatives.

When Jill Carol was being held hostage it was known that US forces were holding a hundred or more women and children at various locations - likely as hostages to coerce their relatives to take certain actions.

We were able to slide around the issue then, but if torture of relatives with no information was done to coerce others to cooperate that would be a level of depravity that we would find harder to ignore.

One thing about the issue you raise puzzles me. Why is it that those who are considered to be our enemy never take the time to complain about these tactics in the press. It is clear they have access to the press, every time it appears to be beneficial to us, we get a tape from someone claiming to represent OBL, why then don't they complain about these tactics in that same manner, or have they done so and I just haven't noticed it?

Sometimes they do. Those who took Jill Carol demanded the release of woman and children hostages held by the US in exchange for her release.

In other cases silence may be a condition for avoiding worse treatment or even execution of the hostages. When intimidation is working well there are no complaints.

What is very clear is that Panetta agrees with Cheney that Obama's release of the Bush administration's memos on enhanced interrogations did, in fact, harm our intelligence gathering capacity and thus our national security. That's why Panetta opposed their release.

Ther in lies the crux of the problem. Once you say what the how is, you automatically incriminate yourself when it is found out in the future you are still using those tactics. How can you outlaw something if your don't know what it is, how can you make something illegal, if the public doesn't know what is or isn't included in what you are proposing to be against the law?

That is to my mind the exact problem. It's like OMG they're so bad, we have to hide this. Nobody can ever see this.

Suppression just lends itself to people imagining things far worse than actually happened. Not only in the US but all over the world and inside the ME.

All I know is that the need for justice is greater to me than the need for full public disclosure and really, if there were trials but no full disclosure, that would definitely satisfy me much more than full disclosure and no trials.

How can we under one hand, send our troops into harms way where danger is imminent and then claim that the truth puts them in danger? The real truth is that those who want to escape responsibility for the use of torture are using our troops as their protection from prosecution for authorizing and using torture. It 's like the right wing saying that if you are against sending our troops into a war based on lies, that means you are against the troops and you are unpatriotic. Nothing is further from the truth! These tactics, if not fully disclosed, will leave those who insist on using them with a mandate to continue their use. If not dealt with appropriately, America will be forever known as country which has no right to dictate to any other that their treatment of detainees does not conform to the Geneva Convention, and we are no better than those we seek to change. As far as I am concerned, the release of this information is a danger only to those people who wish to remain above the law. Otherwise, this is a road we will travel over and over, and one that may eventually lead to the delivery of torture to our civilian authorities!
