ALBANY, N.Y. (AP) -- A Republican coup in the state Senate, helped along by one Democrat with legal troubles and another who violated election laws, paralyzed the chamber on Tuesday.

Democrats vowed to fight back, possibly with a lawsuit, but the new leaders said the takeover was in the name of reform: to turn back Democrats' overspending and overtaxing.

Democratic Gov. David Paterson and good-government advocates criticized the move in a statehouse where control of a legislative chamber gives nearly unfettered power to the ruling party.

The Senate and its committee rooms were dark Tuesday, normally an active day in the part-time legislature. There are only eight full days of the 2009 session left and several key issues, including legalization of same-sex marriage and control of New York City schools, are pending.

Senate Republican leader Dean Skelos, the coalition's No. 2 leader, says he and Democratic Sen. Pedro Espada Jr., the de facto Senate leader if the coup survives, will conduct a session on Wednesday in a separate room if the Democratic conference locks them out of the ornate Senate chamber.

Paterson called the overthrow a dereliction of duty just as New York starts to dig out of a fiscal crisis and faces major policy issues. He said the power grab was "dressed up in the cloak, falsely, of reform and good government."

If reform was the point, said Barbara Bartoletti of the League of Women Voters, the Senate should have worked together to change the state's ethics and campaign finance laws and to take other steps to bring more democracy to the leader-dominated Legislature.

"The public should look at all of this with disdain," Bartoletti said.

Espada, named Senate president by the coalition, said its members plan to work past June 22 end of session set by Senate Democratic Leader Malcolm Smith, who was deposed Monday. Espada said there will be no delay on critical actions.

On Monday, Espada and a fellow Democratic senator, Hiram Monserrate of Queens, joined with Republicans on hastily introduced measures that changed the leadership structure. Neither Espada nor Monserrate changed party affiliation, but their votes helped the measures pass 32-30.

Espada has sided with Republicans in the past and threatened Smith's leadership as soon as it began in January.

He still has two pending election violation cases, but has pledged to resolve them.

In one case, he and his campaign committees owe the state $13,000 in fines for not filing contribution records related to his 2008 election campaign. In the other, he was ordered by a court in December to pay the New York City Campaign Finance Board $60,000 in fines related to his 2001 campaign for Bronx borough president.

Separately, state Attorney General Andrew Cuomo has announced he is investigating managers at the Soundview Health Center, founded by Espada. Cuomo is looking into allegations that state funds earmarked for programs designed to serve impoverished women, children and people with HIV and AIDS were instead diverted to finance political campaigns.

Monserrate, the other dissident, is charged with slashing his girlfriend's face with a piece of broken glass. He has maintained his innocence and called his prosecution politically motivated. A conviction on the felony assault charge could cost him his Senate seat and put him in jail for up to seven years.

I have lived in upstate NY for 35 years, and have almost never actually felt "represented" in the state legislature. In the past 15 or so years, I have routinely voted against incumbents whenever possible, at all levels of local and state government. They all need to go.

I think that nothing will change as long as the incumbents are able to remain in office for decades; the same Albany power structure remains in place, and only ridiculously ineffective "reforms" are offered to fix it.

I have often, of late, thought about returning to the nicer weather of the place where I grew up. Unfortunately, California might actually be worse now than NY is.

Recruting bribe-takers and accused felons will not do much for the GOP image. The NY legislature is in need of reform - and a large turnover in its membership - delivered by the voters, not a coup.

A poster asked earlier if any NY'ers were surprised about any of this. NO, we are not. Our legislature is and has been for many, many years a complete joke. They do absolutely nothing - if anyone can mention one piece of meaningful legislation they have passed in the last 5 years, I would like to hear about it. It is so infuriating and embarassing - and to add insult to injury we have Patterson - who is in so far over his head it's laughable. I am a lifelong Democrat and will continue to be - but I hope and pray that this next election will bring meaningful change to my state that I love. And no, that does not mean voting for any of the Republicans thus far mentioned as possible candidates - that would just be going from the frying pan into the fire. But please, let's really bring some radical, meaningful change to Albany - at long last.

This monkey business would not have occurred if Eliot Spitzer were still governor of New York. This state has suffered greatly from his absence. Level-headed New Yorkers should be outraged at the Republican dirty tricks and at these two men who call themselves Democrats. Today, New York is as leaderless as the U.S. had been under George W. Bush. Especially tragic as New Yorkers deserve a whole lot better. I certainly do hope that Spitzer and men and women like him will step forward to help out.

You are right, Elliot Spitzer was a uniter, both parties hated him.

The truth of the matter here is this defection was all over "pork - MONEY" it has nothing to do about principles, its all about cash.

If your memory is weak, you will note that Prior Senate leader Joe Bruno (R) is now under criminal indictment issued by the Bush republican justice department so don't blame the Dem's for that.

No these guys switched for now to get some pork before 1 faces his own criminal charges and the other 1 a victim of the upcoming election. This is a play to get future payoff.

Pattison is a nice guy and smart with a horrible staff who do not know how to play ball in the big league.

Unfortunately their constituents aren't the brightest bulbs and have been subject to political corruption for years. You'd be surprised how many disaffected voters there are in the Bronx or Queens.

I live near Rochester, and the news in-state was all about how this was engineered by bililionaire Tom Gollisano. Although he helped elect some Democrats during the last cycle, he grew impatient over the lack of reform - in only 5 months of a D. majority (after untold years of R. majority).

This is proof that government is bought and paid for by those who can afford it. The rest of us are merely peons.

are you from NY? I'd guess not. If you were, you'd know the MTA, the company that runs NY City trains, buses and subway, is desperately beging for a bailout from Albany right now.

NYC couldn't do the things it does without everything north of 168th street footing bils. And conversely, without the dollars NYC residents spend upstate, NYS would be in even bigger trouble. I am an upstater who moved to NYC, both are fantastic, but both need each other.
