Leroy Carhart

OMAHA, Neb. — A Nebraska doctor said Wednesday that he will perform third-term abortions in Kansas after the slaying of abortion provider George Tiller, but would not say whether he will open a new facility or offer the procedure at an existing practice.

Dr. LeRoy Carhart declined to discuss his plans in detail during a telephone interview with The Associated Press, but insisted "there will be a place in Kansas for the later second- and the medically indicated third-trimester patients very soon."

"I just think that until everything is in place, it's something that doesn't need to be talked about" in detail, Carhart said a day after Tiller's family announced his Wichita clinic was permanently shutting its doors.

Tiller's clinic was one of the only facilities in the country that performed third-trimester abortions. Carhart has run his own clinic in Bellevue, Neb., since 1985, but had performed late-term abortions at Tiller's clinic because of Nebraska's more restrictive abortion laws.

Nebraska law does not allow an abortion if the fetus is considered viable, or able to survive outside the womb. Kansas law allows abortions on viable fetuses after the 21st week if carrying the pregnancy to term would endanger the mother's life or cause a "substantial and irreversible impairment" of a major bodily function. Courts have interpreted a "major bodily function" to include mental health.

Carhart said he has not performed any abortion past the 22nd week of pregnancy at own clinic because he never trained his staff to do them.

"If I have to train the staff and if I have to do them, then that's certainly an option" for a fetus that would not survive outside the womb, he said. Carhart said some of the staff from Tiller's clinic may join him in Nebraska to help with training.

Carhart said he has already seen more patients at his Bellevue clinic since Tiller's was closed after he was shot May 31 while serving as an usher at his church. Scott Roeder, a 51-year-old Kansas City, Mo., resident, has been charged with first-degree murder and aggravated assault.

Operation Rescue president Troy Newman said his group, which tried for years to put Tiller's clinic out of business, has discussed the idea of buying the tan, windowless building in east Wichita.

"I would love to make an offer on that abortion clinic, and that's some of the discussion that we're having," Newman said Tuesday.

An attorney for Tiller wouldn't discuss the proposal. "I'm just not going to respond to every irreverent publicity stunt or comment by these extremists," attorney Dan Monnat said.

Tiller's clinic was the site of a 45-day "Summer of Mercy" protest in 1991 that included attempts to blockade it and led to more than 2,700 arrests. Operation Rescue was founded in the 1980s by Randall Terry, who led the "Summer of Mercy" effort. Terry stopped using the Operation Rescue name because of multiple lawsuits. He and Newman are engaged in a legal dispute over who has the right to use the name.

I find it extremely odd that people who have such strong feelings about abortions, especially late-term, know so little about them. Wouldn't it make sense that if people cared soooo much about a subject they would bother to learn something about it? Why is that the the laws and circumstances regarding LTAs have to be explained over, and over, and over again, and they still know nothing them? Makes me think it's not really about saving "babies" at all. It's about controlling the silly women who can't be trusted to make a rational decision.

Certainly, that's it! Men as spouses, etc. rarely have to bear the burden of raising a teratogenic child. Genetic/congenital malformations should be grounds for abortion AT ANY STAGE!!

If your child becomes brain damaged at five years old, would you advocate the right (lol) to kill them too?

You know very well that's not what I was saying. And how is it that you can understand "teratogenic" but not "medically indicated"?

Less than 1% of abortions are performed in the third trimester. Almost all of them are much-wanted pregnancies that are performed to save the life of the mother or because there is a serious problem with the fetus. But the anti-choice people do not want you to know this. They do not care that they are kicking women and their husbands/ partners when they are already facing horrible decisions and huge losses no matter what they decide.

I don't know what the statistics are today (what with the federal ban on IDX, and various state restrictions on other late-term abortions), but back in the 90s, there were a significant number of late-term abortions that were elective with a healthy fetus (see the infamous comments of Ron Fitzsimmons, http://www.nytimes.com/1997/02/26/us/an-abortion-rights-advocate-says-he-lied-about-procedure.html).

Regardless, most people agree that very late-term abortions ought to only be allowed in the extreme cases such as what you have described.

Of course, the stats that you are quoting (late 1980s, NOT 1990s) were gathered before there were many laws against such actions, so many women were noticing that they were pregnant at a late stage, then aborting it. NOW most states have a late-term abortion ban, and so they can only get them if they are in danger or the fetus will not be viable.

I think we should create a few laws restricting a males reproductive rights. All males on there 25th birthday should be required to get a vascetomy, no exceptions. Married, unmarried, has fathered children, has not fathered children, it just should not matter. They want to step on MY reproductive rights, lets step on theirs. This should cause a drastic drop in abortions and unwanted pregnancies and also many more couples would consider adoption. Oh and all males after receiving their vascetomys can be required to pay a special sperm tax to support single mothers and children.

Hate men much?

You do realize that plenty of guys are pro-choice, and plenty of women are anti-abortion, right? Or do those facts not fit into your narrow worldview of the oppressive man-rapist?

3rd term? Don't they mean 3rd trimester. Third term would mean giving birth for the 3rd time.

Oh, and Dr. Carhart has huge balls.

Though I am a staunch Democrat, I really love the hypocrisy of liberals sometimes. They whine and cry about gay marriage, but they hoop and holler for someone who is willing to abort unborn children in the 3rd trimester. Just shows were our priorities are.

I'm pretty sure all the "hooping" and "hollering" is in your imagination. All liberals want is respect for the right of women to make their own choices about their own bodies. As for gay marriage all liberals want is equal rights for all. If there's hypocrisy somewhere in that it must be the tiniest needle in the largest haystack ever.

No, my point is, they believe in equal dignity for everyone, but they don't believe that people have a inalienable right to live.

Please educate yourself about the reality of late-term abortions. There was a very informative and not emotionally charged post earlier on huffpost. Please realize that except for a few (indeed very disturbing) instances, late term abortions are performed to either protect a mother's life and ability to have children later (which almost all of them do), or sparing the baby the terrible suffering. Please read this.

And it may save the life of a pregnant woman.

Why don't you do some research on late term abortions? You may discover than they are performed for very serious reasons and that they are very rare.

"Trust Women" is exactly right.

It is deeply misogynistic to believe that women are flighty and irrational and would have a LTA just because "Oops! I changed my mind".

It's a shame that men were exempt from pregnancy and birth. Just seeing them so gosh awful rabid about something they haven't a clue about makes my blood boil.

Rabid men?

There are a great many board certified male OB/GYN physicians across the country who know a lot more about conception, pregnancy and childbirth than you should wish to give them credit for who are vehemently opposed to these practices.

Just as there are a great many plain old ordinary women, of all walks of life -- women who are probably clueless in your eyes, who find these practices abhorrent.

So why then, does gender make one naturally predisposed (and uniquely qualified) to favor this position of advocating for abortion, or the termination of a pregnancy?

It's tiresome to even respond. What other women think I should do if I had a pregnancy I decided I could not complete is completely irrelevant. What is relevant is I have a choice. It is my business and my business only.

I've known plenty of women who were quite certain of their anti abortion stance....right up until they got pregnant with the wrong guy at the wrong time for them in their life. If that has never happened to them, or if they are loaded financially and would never wonder how to care for their child, then their opinion on the matter is moot until then.

The thing about men is they are purely speculating from a safe can-never-happen-to-me perch. As if they would all be responsible fathers if their children were born. The entire situation is incumbent on the women and men are spectators in the whole game.

I don't know about you... but I wasn't exempt from birth. Well, to be honest, I was the result of a c-section... but I think that still technically counts as birth.

I wonder though... would you include in your judgment women who've never been pregnant?
