Rep. Barney Frank, the powerful House Democrat from Massachusetts, introduced a bill Thursday to allow states to make their own medical marijuana laws free of federal interference.

The bill would also move marijuana from the FDA's Schedule I to Schedule II. Its current designation indicates that it has no medical value, a high risk of abuse and is extremely harmful. By keeping marijuana in Schedule I, the federal government makes research into its medical benefits nearly impossible.

Moving marijuana to Schedule II would recognize its medical value, make access to it for research purposes easier and would facilitate the creation of a regulatory framework for the FDA to begin a drug approval process for marijuana.

The bill is HR 2835.

Frank's legislation would also explicitly protect patients from federal arrest in state's where medical marijuana is legal. (Rhode Island's governor vetoed on Friday a state bill that would have allowed medical marijuana sales by state-run dispensaries, despite the fact that Rhode Island already permits possession and use of medical pot.)

Charles C. Lynch could have used that protection. On Wednesday, the Moro Bay, Calif. medical marijuana shop owner was sentenced to a year and a day in federal prison despite the fact that medical pot is legal in California and despite President Obama's earlier assurance that he would not interfere with the law. Unfortunately, Lynch was arrested during the Bush administration era.

"Years from now, Mr. Lynch may well be remembered as the last American to go to federal prison for a mistake, the final victim of an already repudiated policy well on its way to the ash heap of history, but whose mean-spirited effects still linger," said Marijuana Policy Project head Rob Kampia.

"This sentence is a cruel and pointless miscarriage of justice," Kampia said.

The sentence handed down by federal District Court Judge George H. Wu could have been worse. The Obama Justice Department wanted the mandatory minimum sentence of 5 years. The Justice Department declined to comment on the sentencing.

The lack of clarity from the Obama administration on medical marijuana prompted Rep. Maurice Hinchey (D-N.Y.) to introduce language Tuesday attached to a Commerce, Justice and Science Departments Appropriations bill seeking clarification on the policy.

"It's imperative that the federal government respect states' rights and stay out of the way of patients with debilitating diseases such as cancer who are using medical marijuana in accordance with state law to alleviate their pain," said Hinchey.

At the same time that Barney was on the floor on Thursday.Pomona Police RAIDED my home in Pomona, California. I was threatened with a charge of Felony Cultivation of Marijuana. They Confiscated my Plants and equipment. I am a 52yr Old Disabled Medical Marijuana Patient in California with a Doctors Recommendation. Cannabis is life saving for me for the conditions I suffer... I have done everything Possible to follow the law and set guidelines. The Pomona Police could only use the Federal charges to do what they did to me and gain access and prosecute me. I was compliant to state laws....And now I may face Felony charges and prison... I am also Poor and have no way to fight anyone with lawyers. They will set me up with a public defender and put my Life in his hands... Plea and get rid of me...
My only crime was getting sick... And cant work any more..

ALL,,, While at the same Moments in time.... Rep. Barney Frank is on the floor to introduce protection against this very thing...

"The Drug War's Big Lie"

"When Richard Nixon was handed Pennsylvania governor Ray Shaffer's report on cannabis ( The Report of the National Commission on Marihuana and Drug Abuse. Marihuana: A Signal of Misunderstanding.) he shelved it and ignored its recommendations.

In its final comments the report said this:

"Considering the range of social concerns in contemporary America, marihuana does not, in our considered judgment, rank very high. We would deemphasize marihuana as a problem.

"The existing social and legal policy is out of proportion to the individual and social harm engendered by the use of the drug."

And its recommendation:

- POSSESSION OF MARIHUANA FOR PERSONAL USE WOULD NO LONGER BE AN OFFENSE, BUT MARIHUANA POSSESSED IN PUBLIC WOULD REMAIN CONTRABAND SUBJECT TO SUMMARY SEIZURE AND FORFEITURE.

- CASUAL DISTRIBUTION OF SMALL AMOUNTS OF MARIHUANA FOR NO REMUNERATION, OR INSIGNIFICANT REMUNERATION NOT INVOLVING PROFIT WOULD NO LONGER BE AN OFFENSE.

A significant study 2 years later conducted in Virginia and funded by the NIH (National Institutes of Health) found the opposite of what they were looking for. While seeking evidence of cannabis harming the immune system they found instead that it actually is a potent anti-cancer agent:

That study was buried. Imagine... a policy so rigid and narrow-minded that they would hide a possible cure for cancer. Talk about bureaucratic terrorism..."

MEDICAL MARIJUANA (H 2160) - The Committee on Public Health is considering legislation allowing the medical use of marijuana by qualified patients. The measure allows these patients to possess up to four ounces of marijuana and 12 marijuana plants for medical purposes. The state would issue identification cards to qualified patients and to caretakers who could grow and provide marijuana for a severely disabled patient.

Doctors would be allowed to issue prescriptions for marijuana use by patients for debilitating medical condition including cancer, glaucoma, HIV/AIDS, hepatitis C, Lou Gehrig’s disease, Crohn’s Alzheimer’s and any disease or treatment that produces severe pain, nausea or seizures.

This bill is an absolute joke! The War on Drugs is a war on our freedom and civil liberties. Every citizen of the world should have a right to their own mental state and what plants they consume. Why don't our politicians speak the truth and call for an end to cannabis prohibition entirely? Anyone with common sense knows we have to legalize it for many reasons.

Cannabis is a peaceful plant (NOT a drug) and it's side effects (in addition to countless medicinal benefits) cause people to open their minds, question unjust authority and seek a better world. That's really why it's still illegal, don't fool yourself!

Plus, too many people profit from this injustice and until America has a truly democratic government OF the people and FOR the people, instead of the corporate lobbyist phony democracy we have now, don't plan on REAL change anytime soon. Even the Savior Obama doesn't have the guts to stand up to The System.

I've never met anyone who's life was ruined by cannabis. I've met too many, who's life was ruined by a cannabis arrest.

The fact that we arrest a million citizens each year, 600,000 for simple possession, is the real crime.

I agree, what is the harm if a person grows a little pot on their property for personal consumption in the privacy of their own home? I had an uncle who had luekemia, diagnosed back in 1975 and his doctors recommended weed to give him relief after the chemo therapy sessions. Smoking eliminated the nausea and gave him an appetite along with the euphoric feeling that reduced the pain. He actually purchased weed on the black market for about 15 years before he finally died of cancer. There is no reason why someone should have to break the law to get treatment for a terminal disease.

Good point.
For everyones information. Hemp is not a drug. It's a class of plants that includes marijuana but its main use is for rope making . Smoking it doesn't get you high yet it it's illegal.

I remember petition after petiition in Oregon (when I lived there) back in the early 90's. Marijuana has been the #1 cash crop there. Imagine what 100% legalization would do for Oregon's economy? All of the out-of-work forest and wood workers could find marijuana based jobs.

Marijuana's move from Schedule I to Schedule II is long overdue, seeing as how Marijuana is prescribed in the from of Maranol(sp, tablets) and has been prescribed, grown and mailed to Federal Medical Marijuana patients every month in the form of pre-rolled Joints. This program has been in effect for 30 years, and still we pretend that Marijuana has no medical value.

Marijuana has never killed anyone, is not addictive, and even the Goverments own top researcher says Marijuana has no ill effects on the lungs. No cancer, No brain cell damage, no memory loss. Just mild intoxication.

When you add the above to the fact that Hemp could replace all cotton, oil, and timber needs while giving back to the ground its grown in...
