Rep. Barney Frank, the powerful House Democrat from Massachusetts, introduced a bill Thursday to allow states to make their own medical marijuana laws free of federal interference.

The bill would also move marijuana from the FDA's Schedule I to Schedule II. Its current designation indicates that it has no medical value, a high risk of abuse and is extremely harmful. By keeping marijuana in Schedule I, the federal government makes research into its medical benefits nearly impossible.

Moving marijuana to Schedule II would recognize its medical value, make access to it for research purposes easier and would facilitate the creation of a regulatory framework for the FDA to begin a drug approval process for marijuana.

The bill is HR 2835.

Frank's legislation would also explicitly protect patients from federal arrest in state's where medical marijuana is legal. (Rhode Island's governor vetoed on Friday a state bill that would have allowed medical marijuana sales by state-run dispensaries, despite the fact that Rhode Island already permits possession and use of medical pot.)

Charles C. Lynch could have used that protection. On Wednesday, the Moro Bay, Calif. medical marijuana shop owner was sentenced to a year and a day in federal prison despite the fact that medical pot is legal in California and despite President Obama's earlier assurance that he would not interfere with the law. Unfortunately, Lynch was arrested during the Bush administration era.

"Years from now, Mr. Lynch may well be remembered as the last American to go to federal prison for a mistake, the final victim of an already repudiated policy well on its way to the ash heap of history, but whose mean-spirited effects still linger," said Marijuana Policy Project head Rob Kampia.

"This sentence is a cruel and pointless miscarriage of justice," Kampia said.

The sentence handed down by federal District Court Judge George H. Wu could have been worse. The Obama Justice Department wanted the mandatory minimum sentence of 5 years. The Justice Department declined to comment on the sentencing.

The lack of clarity from the Obama administration on medical marijuana prompted Rep. Maurice Hinchey (D-N.Y.) to introduce language Tuesday attached to a Commerce, Justice and Science Departments Appropriations bill seeking clarification on the policy.

"It's imperative that the federal government respect states' rights and stay out of the way of patients with debilitating diseases such as cancer who are using medical marijuana in accordance with state law to alleviate their pain," said Hinchey.

With President Obama receiving grief from the gay community for not ending DADT, why is Barney Frank wasting his time with legalizing marijuana and not pushing a bill to end DADT instead? Isn't civil rights more important than the privilege to smoke herbs? Just curious.

vicodon any day or sleepless night.

Denying sick people their choice of an herbal remedy with little or now side effects is a civil rights issue. Especially when our Government knows the truth.

Wow, he has time for this but not to end H-1B... This is really amazing. We are still living with federal regulations that allow corporations to drive down wages by importing labor into the US market.

Wages being down is a major problem which could easily be fixed by ending this terrible regulations. But Franks wants to spend valuable time on pot. Great.

I withdraw my previous observation in this thread. (I love reading stories about addicts who say they're not addicted, but then get kicked out of relatives' houses for bringing the stuff into their houses behind their backs to smoke it... if it's not addictive then why do all that... not to mention I just remembered some studies claim pot helps AIDS sufferers; an ailment that is, unless you're a father infecting his infant with the virus, utterly preventable.)

Yeah, the economy should be the #1 issue. President Obama has said and done a lot up front, and India is having a tantrum right now (with buddy steve ballmer whining too, but I absconded from microsoft's second rate garbage (peddled by piracy supporters if you google up "Gates conquered China" and find one or two choice articles that have them incriminating their own duplicity) some time ago so I really don't care if that company goes under or not)

Moving marijuana from a Schedule I to a Schedule II is a step in the right direction, but it needs to be classified as a Schedule III. Just legalize and regulate it. It will save money in prison costs and that some of the money saved can be used to keep the most violent offenders in jail.

It's ridiculous classifying marijuana as a title one drug the same as Heroin or Oxycotin and Cocaine it's just not scientifically accurate...

Ask the head of the FDA or any politician which he would prefer his daughter tried Heroin or smoke some pot..?

The answer is obvious..

Regulating and controlling do cost money.

It's not as simplistic as your suggestion makes it out to be.

And I'm not sure it should be legalized; I'll re-state a pre-stated opinion based on reading some people on some discussion forums who smuggle in the crap to their parents' house so they can smoke it, and then get kicked out because they brought it with them. (the same people claiming they are not addicts, so why didn't they leave their illegal garbage at home for a while? That's right, they're ADDICTED to it. And for once, reality really is as simple as it sounds.)

Part 1 Decriminalize all drugs. If this were a truly free country we would not be told by the government what we can and cannot do with our own bodies. Prohibition has never worked. End the war on drugs and save tens of billions every year. There would be no reason to tax them either. We are overtaxed as it is.

Part 2 For those who freak out because c0caine and her0in would be legal consider this. Those who do heroin are already doing it. It's available everywhere. Legal or not it does not make a difference. The government and the pharmaceutical companies have been pushing their own version for years. Oxyc0ntin, m0rphine etc. Think you need to save drug addicts by making it illegal? It's not for you to decide. If someone has a problem with drugs they can seek help on their own. Making them criminals and putting them in prison does not help them one bit. All they do is learn how to become criminals.

While were at it release the 60% of the prisoners serving time for nonviolent victimless crimes. I don't really think that our government is ignorant in regards to the science which has proven that marijuana is relatively harmless and has tons of medicinal benefits. No, they just perpetuate the lies/myths about marijuana in order to justify keeping it illegal. Why you ask?

It's because legalizing marijuana would hurt big business such as oil, textiles and most importantly pharmaceuticals. Our reps are bought by those industries whose profits would take a dive after legalization.
