Rep. Barney Frank, the powerful House Democrat from Massachusetts, introduced a bill Thursday to allow states to make their own medical marijuana laws free of federal interference.

The bill would also move marijuana from the FDA's Schedule I to Schedule II. Its current designation indicates that it has no medical value, a high risk of abuse and is extremely harmful. By keeping marijuana in Schedule I, the federal government makes research into its medical benefits nearly impossible.

Moving marijuana to Schedule II would recognize its medical value, make access to it for research purposes easier and would facilitate the creation of a regulatory framework for the FDA to begin a drug approval process for marijuana.

The bill is HR 2835.

Frank's legislation would also explicitly protect patients from federal arrest in state's where medical marijuana is legal. (Rhode Island's governor vetoed on Friday a state bill that would have allowed medical marijuana sales by state-run dispensaries, despite the fact that Rhode Island already permits possession and use of medical pot.)

Charles C. Lynch could have used that protection. On Wednesday, the Moro Bay, Calif. medical marijuana shop owner was sentenced to a year and a day in federal prison despite the fact that medical pot is legal in California and despite President Obama's earlier assurance that he would not interfere with the law. Unfortunately, Lynch was arrested during the Bush administration era.

"Years from now, Mr. Lynch may well be remembered as the last American to go to federal prison for a mistake, the final victim of an already repudiated policy well on its way to the ash heap of history, but whose mean-spirited effects still linger," said Marijuana Policy Project head Rob Kampia.

"This sentence is a cruel and pointless miscarriage of justice," Kampia said.

The sentence handed down by federal District Court Judge George H. Wu could have been worse. The Obama Justice Department wanted the mandatory minimum sentence of 5 years. The Justice Department declined to comment on the sentencing.

The lack of clarity from the Obama administration on medical marijuana prompted Rep. Maurice Hinchey (D-N.Y.) to introduce language Tuesday attached to a Commerce, Justice and Science Departments Appropriations bill seeking clarification on the policy.

"It's imperative that the federal government respect states' rights and stay out of the way of patients with debilitating diseases such as cancer who are using medical marijuana in accordance with state law to alleviate their pain," said Hinchey.

I can't believe that in 2009 we are still debating this. There is no good reason why alcohol is legal and pot is not. At least pot doesn't make people v.i.o.l.e.n.t. like alcohol does.

I have heard folks are encouraged to call the White House to demand Lynch's immediate release. It is unacceptable for him to sit in jail, but nothing will be done if we aren't loud about it.

gee you can,t even be legal in our own country with out having money because of taxes

car in,s car reg,s tax and license gas tax road tax just to drive a car

you have to pay license when it expires on B-day and it not valid if it is expired

fail to do any of one of these thing and guess what your not legal poor people suffer because of taxes

Now that you know, know this: Marijuana DOES NOT HAVE AN LD 50!

No lethal dose is possible of the herb. Cannabis simply cannot be ingested at levels that produces death, unlike salt, sugar, opiates, nicotine, alcohol, other analgesics. The FDA allows thousands of pharmaceutically useful but potentially LETHAL drugs on the market, but Marijuana [a useful analgesic, BTW] is still Schedule I.

Any drug that is a viable analgesic & has no LD50 is a miracle drug. It's crazy stupid that this very useful substance continues to be illegal.

Big Pharma doesn't want marijuana legalized..They have a lot to lose from the beneficial properties of marijuana. For one thing, it is a cure for arthritis, the number one crippler in the world and the number one reason for SS enrollment which is a cost to the country that doesn't affect them, but rather goes in their pockets.

Marijuana causes sinovial fluids to let down like mother's milk. If you are suffering with arthritis find a way to get the cure. Get your life back and don't let Big Pharma trick you into taking a bunch of symptom treating chemicals that will rot your liver and stomach.

There is absolutely NO reason for cannabis to be illegal. The only reason people are against it is because they've been fed propoganda for years. The truth is that it was never a problem until it started to interfere with money-making schemes. Our forefathers grew it and our farmers grew it. The government knows this. If this really is a govt of, for and by the people, let's put it to a vote. I guarantee you it would be legalized if the people had their say. People from all walks of life including Doctors, Lawyers, Ministers, etc... know the truth. You owe it to yourself to know the truth before you light up a cigarette or drink your alcohol or take over-the-counter or prescription meds. You're much safer with marijuana. Kendall Craig Farris' website is filled with influential endorsements for the drug prevention program he founded. Los Angeles City Councilman Bill Rosendahl called them "amazing tools which our schools and communities desperately need" and thanked Farris for meeting with him and his staff.

Something went wrong, however, and Farris was arrested Thursday at a Starbucks in El Segundo after Redondo Beach police set up a drug buy over the phone.

Farris, 47, arrived at the coffeehouse in a taxi, police said. An undercover officer gave him an envelope containing $480 in exchange for methamphetamine and ecstasy tablets, which turned out to be fake, authorities said. Farris was arrested at 3:40 p.m.



Farris, according to his website, was founder of the Over the Wall Foundation in Marina del Rey and a recovering alcoholic and addict. His mission, he says, is "to help youth, schools, and families prevent drug and alcohol abuse before it starts, and intervene in any drug abuse which may already have begun."

Of all the famous Barney's (Rubble, the dinosaur, my neighbor's Jack Russell who does backflips for calamari), this ones my favorite. A politician who means business.
