Rep. Barney Frank, the powerful House Democrat from Massachusetts, introduced a bill Thursday to allow states to make their own medical marijuana laws free of federal interference.

The bill would also move marijuana from the FDA's Schedule I to Schedule II. Its current designation indicates that it has no medical value, a high risk of abuse and is extremely harmful. By keeping marijuana in Schedule I, the federal government makes research into its medical benefits nearly impossible.

Moving marijuana to Schedule II would recognize its medical value, make access to it for research purposes easier and would facilitate the creation of a regulatory framework for the FDA to begin a drug approval process for marijuana.

The bill is HR 2835.

Frank's legislation would also explicitly protect patients from federal arrest in state's where medical marijuana is legal. (Rhode Island's governor vetoed on Friday a state bill that would have allowed medical marijuana sales by state-run dispensaries, despite the fact that Rhode Island already permits possession and use of medical pot.)

Charles C. Lynch could have used that protection. On Wednesday, the Moro Bay, Calif. medical marijuana shop owner was sentenced to a year and a day in federal prison despite the fact that medical pot is legal in California and despite President Obama's earlier assurance that he would not interfere with the law. Unfortunately, Lynch was arrested during the Bush administration era.

"Years from now, Mr. Lynch may well be remembered as the last American to go to federal prison for a mistake, the final victim of an already repudiated policy well on its way to the ash heap of history, but whose mean-spirited effects still linger," said Marijuana Policy Project head Rob Kampia.

"This sentence is a cruel and pointless miscarriage of justice," Kampia said.

The sentence handed down by federal District Court Judge George H. Wu could have been worse. The Obama Justice Department wanted the mandatory minimum sentence of 5 years. The Justice Department declined to comment on the sentencing.

The lack of clarity from the Obama administration on medical marijuana prompted Rep. Maurice Hinchey (D-N.Y.) to introduce language Tuesday attached to a Commerce, Justice and Science Departments Appropriations bill seeking clarification on the policy.

"It's imperative that the federal government respect states' rights and stay out of the way of patients with debilitating diseases such as cancer who are using medical marijuana in accordance with state law to alleviate their pain," said Hinchey.

not an expert. I did work in the mental health field so I had to be aware of the symptoms. Hey I'm a holistic person. I live in the beautiful desert of Arizona. If people want to smoke pot, go ahead. I think all drugs serve a purpose. Moderation is good in all areas, it's when moderation is not followered tha inappropriate behaviors occur

You have an opinion, they have thousands of people who work in drug enforcement and punishment. You can't afford a new car, they have hundreds of highly skilled and highly paid lawyers to do one thing, prevent pot from becoming anything other then what it currently is. You have a desire to live free, they have a desire to lock you up, and if possible throw away the key. The saddest thing, is that after 40 odd years, most people that have worked day in and day out in drug enforcement by and large agree that the war is lost, and the money thrown in the toilet to catch people, adjudicate their circumstance and then throw them in jail, has not done anything at all to limit the availability of drugs. Imagine for a second, in the land of the free and the home of the brave, bringing that progress report to your next corporate board meeting. Americans, hypocrits writing the script of their own doom. Pity.

I mean - I could go through all the stats that compare marijuana to alcohol, and talk about the crime rates that involve alcohol, and talk about all the diseases and deaths alcohol has either contributed to or been the cause of - but we all know the story.

Lets get this thing passed so we don't have to waste anymore money on this issue - the war on drugs is - and always has been - a lost cause!! We need the money!!

I do not support legalizing all drugs. That scares ordinary Americans. All drugs are not equal. Granted the war on drugs is wrong, but all drugs should not be legalized. That discussion distracts from the real discussion about a plant, which should not be classified with hard drugs like heroin. The discussion of legalizing all drugs, utilizes fear to distract from the conversation about cannabis hemp.

CATO also estimates that over 90% of the Mexican cartels' revenue comes from the prohibition premiums resulting from marijuana in the U.S. Cut their cash by 90% and they can no longer afford to field massive armed forces to dominate parts of Mexican society.

As long as drugs, especially relatively harmless ones like marijuana are illegal in the U.S. there will be chaos in some part of latin america.

I heard another guy from CATO say it well: "prohibition doesn't work, drugs are going to be used, does anyone really think we would be better off if Al Capone was running the alcohol industry instead of Anheuser Busch?"

Kudos to Barney Frank. Anyone with half a brain realizes the classification of cannabis hemp is wrong! Cannabis should not be classified with heroin.

It's time to right the wrongs of Richard Nixon, a president who left office in shame. His shameful reclassification of cannabis should have been removed, when he resigned in shame.

The war on cannabis has been a war which America could not afford. It has caused us great harm. It's time for change! Reclassifying cannabis hemp is a good place to start.

Cannabis hemp reclassification crosses party lines. Democrats and Republicans alike, realize the war on cannabis hemp is wrong and we can no longer afford to lock up people for mere cannabis possession.

THC levels are much higher than when your daddy smoked pot. THC does induce psychosis. Sometimes the induced psychosis is irreversible. Did you know when we legalized alcohol again that alcoholism increased immensely? But I am a Libertarian, I don’t believe in legislating morality. Let the masses dance and sing, but remember there are consequences and consequences governments don’t impose the individual will impose.

You need to dig further.

It is the mexican version of the german word for the name of the ganja based religious leaders east of Turkey. Maybe it is slang, but it is hardly a drug culture slur. Unless you are suggesting the good germans meant it that way?

I recommend you do more reading into the history beyond our shores before you make such 'learned' pronouncements. Here is a good book, "Marijuana - The First Twelve Thousand Years",

Actually marijuana is a slang term! Cannabis hemp history tracks back thousands of years, while marijuana history only goes back to the 1930's. The slang name (marijuana) was created in the '30's to instill fear of the plant cannabis. They changed the historical name of the plant to one, which they could spin, without ordinary Americans realizing they were talking about cannabis hemp.

With the help of yellow journalism, cannabis hemp was changed to a plant to be feared (marijuana). To date, I truly have heard no real facts, which makes cannabis hemp a plant to fear! The slang term, marijuana gave way to spin, fear over fact!

The facts about cannabis hemp are astounding, when you eliminate the fear associated with the slang term marijuana. If I had my way, we would stop using the slang term marijuana and go back to it's oringinal name cannabis hemp. Cannabis hemp tracks back thousands of years, through many cultures.

A change in Federal laws is long overdue. Legalizing pot, or at least de-criminalizing, while maintaining control over the substance, makes sense and is more in line with our current culture. I'm not a user, but I have no problem with those who do anymore than with those who use alcohol. Getting pot cases out of our courts, jails and prisons would benefit society far beyond the benefit we currently receive under prohibition.

It's about dog-gone time.

We as America started out as a country that grew "drugs" (tobacco), which was one of our main cash crops. The tobacco product was one of the parts that formed our economic base at the time. If tobacco is legal, so should weed be. Also, prohibition of alcohol wasn't to our overall benefit.

The case of Mr. Lynch is part of the larger "war on drugs" that has absolutely failed, costs us billions per year, and fills our overcrowded prisons, which is another thing we all pay for in the end. This relates to the article written by Jim Webb about our incarceration problem.
