WASHINGTON — When President Barack Obama increased unemployment benefits as part of his economic stimulus, he also made some Americans ineligible for hundreds of dollars a month in food stamps.

Under the economic recovery plan, laid-off workers have seen a $25 weekly bump in their unemployment checks as part of a broad expansion of benefits for the poor. But the law did not raise the income cap for food stamp eligibility, so the extra money has pushed some people over the limit.

Laid-off workers and state officials are only now realizing the quirk, a consequence of pushing a $787 billion, 400-page bill through Congress and into law in three weeks.

And for people hurt by the change, there's no way around it.

"Everybody tells you, 'Yeah, I can understand why you're frustrated. It doesn't sound right.' But nobody knows where to go," said Mark Milota, 47, of Marietta, Ga., who was laid off in November from his job at a medical billing company.

The Georgia Department of Human Resources explained in a letter to him last month that, because of the stimulus, he was ineligible for food stamps. He now makes $1,538 a month _ $21 too much for a family of two to qualify.

"We have to pay him that $25 a week," said Brenda Brown, assistant commissioner at the Georgia Department of Labor. "And he doesn't have the option not to accept it."

Milota said he was told that, without the stimulus money, he would have received about $300 a month in food stamps.

"I'm doing things I've never done before: I'm going to food pantries. I've gone to places for assistance on bills," Milota said. "Some bills are just not being paid. I'm three months behind on my mortgage."

Unemployment benefits vary by state and the income cap for food stamps also varies based on family size, so it's impossible to say for certain how many people are hurt by the change. Government officials believe it is only a small fraction of the record 6.8 million people on unemployment. Many more people will benefit from a stimulus law that expanded unemployment and food stamp benefits.

"We've gotten some questions about this. Not tons and tons, but we have been getting questions about this," said Jean Daniel, a spokeswoman for the Department of Agriculture, which overseas the food stamp program now known as the Supplemental Nutrition Assistance Program.

When cases like Milota's began popping up in Iowa recently, officials called Washington, asking what to do.

"We were told we were interpreting the food stamp regulations correctly," said Roger Munns, spokesman for the Iowa Department of Human Services. "Once you're over the income limit, regardless of the reason, you're no longer eligible."

Once handed out as paper vouchers, food stamps are now delivered to people near the poverty level through debit cards that they can use to buy food. A record 32.5 million people participate in the program. Once the government determines someone is eligible, officials use a formula to calculate the monthly benefit, which ranges from $16 to $588. The average is about $111.

Because those close to the income limit tend to get less money in food stamps, Munns said most people who are bumped out of the program by the extra $100 in unemployment benefits each month will break even or fare just slightly better. But the stimulus checks were intended to ease the effects of the recession, not simply cancel out another government assistance program.

Lawmakers crafting the stimulus knew this would become a problem, said Stacy Dean, director of food assistance policy at Center on Budget and Policy Priorities, a liberal think tank. They could have headed it off by raising the income tax or declaring that the $25 stimulus checks would not affect food stamp eligibility. Both were expensive options that could have forced states to reprogram their computer systems.

But more importantly, hashing out those details would have taken time.

"People were aware of this but, as you recall, the stimulus was moving along and then it was passed in about a day," Dean said. "There was not a lot of policy discussion on this."

Milota said he had never been on food stamps before and resisted applying for months, believing he would find a job. But that has proved difficult. When he applied for a customer service job recently, he said the company told him there were 1,000 applicants.

The stimulus law was intended not just as a jolt to the economy but also to ease the burden on people in Milota's situation. Besides unemployment benefits, the law also increased food stamp benefits _ just not the income cap.

"I truly believe when it came out, they felt it was to help people, and they never wanted to hurt people," said Milota, who says he leans Republican but voted for Obama.

Officials in Washington say they're aware of stories like this. Changing things, however, requires changing the law. States could do this one by one, or Congress could do so.

"This is not something the president or this agency could do independently," Daniel, the Agriculture Department spokeswoman, said.

It appears that only those who have been down or have a sense of compassion understand how tragic this is. People are losing their jobs, their homes, now their ability to buy food. Maybe they had a better lifestyle, but to go from that to unemployment is frightening, especially because the bulk of these jobs are being lost to corporate greed rather than individual shortcomings. We need to do all we can to help our neighbors these days. The jobs are gone, the money is drying up, the government is struggling to get us out of this mess that's been brewing for years. No matter how little we may have, it is imperative that we give and help when we can. Together we will get through this. We need only look at what is happening in Iran to appreciate what we have here. Together we can get back on our collective feet. So stop dissing and start helping. Stop being a part of the problem and work to be part of the solution!

Think about this..... My Wife is from the Dominican Republic, she has been here for 2 years, we can not claim our 3 children on our income tax, (they do not have SS numbers). YET we support them and have to show that we can and that we ARE supporting them in the papers we filed to bring them to the USA. BUT a Mexican family can get temporary Tax ID numbers and claim their child under the NAFTA (Canada too.) I would get support from for food stamps if they where here, but alas they are not. We had to pay 3000 to PROVE she is their mother with a DNA testing. I Love my Country and my People but the GOVT makes me say shucks once in a while

this has happened in Utah where we live my son lost his job and he made 1.00 too much his wife cried

some thing is so wrong they are living with us now and we are not going to last to much longer our selves

and since we lost our job things have been quite depressed around our home

it is hard for every one who lost there job our whole community has lost around 70 % of our jobs

companies are asking workers to do illegal things like drive without a CDL

Mr. Milota's case is unfortunate but also very unusual. To collect $300 in food stamps (or SNAP benefits as they are now called) his household of two would have to have a net monthly income of only $223. His gross income, without the unemployment increase, would have been $1,430. This means his household has $1,207 in deductions. The maximum deduction allowed for most households of two is $590. The only exceptions are households with someone over 60 or disabled who has medical expenses and households that pay legally required child support.

There are a number of inaccuracies in this article. For example, the statement "the monthly benefit ... ranges from $16 to $588", is wrong. The minimum monthly benefit is $1 and the maximum depends on household size. The maximum for a four person household is $668, for an eight person household, $1,202 and it increases by $150 for each additional person. There is no limit on household size.

I should have said "the maximum deduction allowed for most households of two, with no earned income, is $590." There is an additional deduction of 20% of any earned income. In this example, since all income is from unemployment insurance, there is no earned income.

The problem was not in the stimulus bill, it is in the food stamp program, now called SNAP (Supplemental Nutrition Assistance Program), gross income test. This test introduced back in the Regan era prohibits households with gross incomes over 130% of the poverty guidelines from receiving any SNAP benefits regardless of their other circumstances. Since the benefits themselves are based on net income after various deductions, this means that, at least in theory, a family of eight could lose $1,202 in monthly benefits because their monthly gross income increased by a penny (from $3,857.49 to $3,857.50). Without the gross income test, the $25 weekly unemployment increase would have uniformly resulted in a monthly decrease of $32 in SNAP benefits for households eligible for both. Congress should repeal this test. While they are modifying the program they should also get rid of the special rules that give residents of Alaska and Hawaii better food stamp benefits then the residents of the other 48.

It is not easy to qualify for SNAP benefits For example, if a household owns a 5-year old Toyota Corolla with 100,000 miles on it they are not eligible. Since the Clinton welfare "reform" unemployed households without children can only collect SNAP benefits for three months out of every thirty-six. The stimulus package and previous emergency unemployment benefit extensions temporarily removed this restriction in states with high unemployment.

Thanks for the info, but this should be revamped because we are about to have more getting unemployment with the closure of these GM plants and who knows how long these people will be able to find work,or how long they will have to go back to school and get an education in another field of work, all this has got to be considered. I am not trying to be (funny) but which ever blogger said that they need to sit down and read and do it's homework is 100%right. Today you can't just say, well by next month you should have found a job because as this man in the article stated he has been looking and looking for a job and clearly did not want to apply for foodstamps, he had no choice. I thought that welfare was design to be a helping hand until you can get on your feet. Dinksinker, since you are knowledgable in this area how long was welfare designed for a person to receive? and how can we get this changed? If you know the answers share them. Thanks.

Welfare includes many different programs all with their own rules and regulations. Currently in states with high unemployment, unemployment compensation (which is not welfare) can be collected for up to 72 weeks, but 33 weeks of this coverage are scheduled to expire before those losing their jobs now can collect them. Congress needs to further extend this program.

Food costs in Honolulu (126% of the national average) and in Anchorage (also 126) are much lower than in New York City (142). Should New York also have its own special poverty levels?

What's so difficult about solving this problem? ................ All the states need to do is to raise the wage eligiblity limit so that persons can qualify for food stamps.

The rethugs seem to only follow the rules to the letter, when they know that it would hurt the poor and needy (mostly minorities), or if it opens a door to bash the Obama administration.

But they have no problem breaking the rules if it benefits the corporations, the wealthy and themselves­..........­... Remember financial institution deregulation, the VP Cheney/Haliburton/ KBR conflict of interest, the blatant violation of the Geneva Convention, Wire tapping, Rendition, the DOJ under the Bush administration, the 2000 Florida recount, the Libby pardon, etc, etc etc?

we all talk but take no action, I'm sure the government loves the net, people read stories and instead of protesting anymore they/we e-mail or blog about it while the rich laugh all the way to the bank. What if all the poor and unemployed stayed home for a week, no fast food places, no coffee cafe, no dry cleaning, house keeping, landscaping ect. I bet they would change their tune. How many times did congress turn down raising the minimum wage while giving themselves twenty some thousand cost of living raises? And how many days are they in session? much be nice with heath and retirement benefits to boot all for a whopping 2 years service. yes yes-now I see why everybody's happy that people like my grandfather (82 years old) lost his health insurance after 35 years of service, but hey, he got to keep the cheap watch and plywood plaque
