WASHINGTON — When President Barack Obama increased unemployment benefits as part of his economic stimulus, he also made some Americans ineligible for hundreds of dollars a month in food stamps.

Under the economic recovery plan, laid-off workers have seen a $25 weekly bump in their unemployment checks as part of a broad expansion of benefits for the poor. But the law did not raise the income cap for food stamp eligibility, so the extra money has pushed some people over the limit.

Laid-off workers and state officials are only now realizing the quirk, a consequence of pushing a $787 billion, 400-page bill through Congress and into law in three weeks.

And for people hurt by the change, there's no way around it.

"Everybody tells you, 'Yeah, I can understand why you're frustrated. It doesn't sound right.' But nobody knows where to go," said Mark Milota, 47, of Marietta, Ga., who was laid off in November from his job at a medical billing company.

The Georgia Department of Human Resources explained in a letter to him last month that, because of the stimulus, he was ineligible for food stamps. He now makes $1,538 a month _ $21 too much for a family of two to qualify.

"We have to pay him that $25 a week," said Brenda Brown, assistant commissioner at the Georgia Department of Labor. "And he doesn't have the option not to accept it."

Milota said he was told that, without the stimulus money, he would have received about $300 a month in food stamps.

"I'm doing things I've never done before: I'm going to food pantries. I've gone to places for assistance on bills," Milota said. "Some bills are just not being paid. I'm three months behind on my mortgage."

Unemployment benefits vary by state and the income cap for food stamps also varies based on family size, so it's impossible to say for certain how many people are hurt by the change. Government officials believe it is only a small fraction of the record 6.8 million people on unemployment. Many more people will benefit from a stimulus law that expanded unemployment and food stamp benefits.

"We've gotten some questions about this. Not tons and tons, but we have been getting questions about this," said Jean Daniel, a spokeswoman for the Department of Agriculture, which overseas the food stamp program now known as the Supplemental Nutrition Assistance Program.

When cases like Milota's began popping up in Iowa recently, officials called Washington, asking what to do.

"We were told we were interpreting the food stamp regulations correctly," said Roger Munns, spokesman for the Iowa Department of Human Services. "Once you're over the income limit, regardless of the reason, you're no longer eligible."

Once handed out as paper vouchers, food stamps are now delivered to people near the poverty level through debit cards that they can use to buy food. A record 32.5 million people participate in the program. Once the government determines someone is eligible, officials use a formula to calculate the monthly benefit, which ranges from $16 to $588. The average is about $111.

Because those close to the income limit tend to get less money in food stamps, Munns said most people who are bumped out of the program by the extra $100 in unemployment benefits each month will break even or fare just slightly better. But the stimulus checks were intended to ease the effects of the recession, not simply cancel out another government assistance program.

Lawmakers crafting the stimulus knew this would become a problem, said Stacy Dean, director of food assistance policy at Center on Budget and Policy Priorities, a liberal think tank. They could have headed it off by raising the income tax or declaring that the $25 stimulus checks would not affect food stamp eligibility. Both were expensive options that could have forced states to reprogram their computer systems.

But more importantly, hashing out those details would have taken time.

"People were aware of this but, as you recall, the stimulus was moving along and then it was passed in about a day," Dean said. "There was not a lot of policy discussion on this."

Milota said he had never been on food stamps before and resisted applying for months, believing he would find a job. But that has proved difficult. When he applied for a customer service job recently, he said the company told him there were 1,000 applicants.

The stimulus law was intended not just as a jolt to the economy but also to ease the burden on people in Milota's situation. Besides unemployment benefits, the law also increased food stamp benefits _ just not the income cap.

"I truly believe when it came out, they felt it was to help people, and they never wanted to hurt people," said Milota, who says he leans Republican but voted for Obama.

Officials in Washington say they're aware of stories like this. Changing things, however, requires changing the law. States could do this one by one, or Congress could do so.

"This is not something the president or this agency could do independently," Daniel, the Agriculture Department spokeswoman, said.

$300 a month for food? I don't think I've ever paid $300 for a month's worth of food! I could live 3 months on that much!

For a family, $300.00 does not go a long way. If you are claiming to live on about $100.00 a month, you are single and eating very little. Approx 90 days in the 3 month period you mentioned. You could only spend about $3.00 a day, which is extremely unlikely.

Do you keep track of how much you spend? About 2005 when I started seriously looking for every place I could save a buck, I put all my grocery store receipts in a file for a month. I was really shocked at how many little $20. side trips I'd been making. I thought I was spending much less than I really was.

So, basically, he is out of 200.00 a month that he could have used for food. Well, he is going to have to just budget. He could save by drinking water instead of colas or fruit flavored beverages. Or, he can buy a 100 ct box of tea and drink iced tea instead. His family could also cut back on the expensive meats that it appears he has used and opt for wheat pasta and vegetables. I have saved hundreds of dollars a month by eliminating processed junk food and meats. These families will have to change their eating habits to compensate for the 200.00 deduction. Also, he could save by cutting coupons , buying store brand items as opposed to name brand and making sure that he does not eat out. Those fast food restaurants can be very expensive. If he drinks alcohol, he will have to cut back on that as well. He can make it work.

Please indicate where it says that this man is buying colas and fruit flavored beverages or expensive meats instead of the least expensive options. How do you know he is not cutting coupons and buying generic brands or that he has ceased eating out? Congratulations to you for being able to cut your grocery bill, and while you offer good suggestions that I'm sure many people have already adopted, you are hardly right to accuse this man of excess where you have no proof.

You're right. I don't have definitive proof , but I suspect that fresh fruits and vegetables did not contribute to his stanch build. I also suspect that high protein meats and perhaps colas or beer may have played a bigger role in his diet than water. I also see that he uses paper towels. He could totally cut that out of the budget. It's an unnecessary expense given his current situation. I'm looking at his grocery bags and I gotta say, generic and store brands packaging are not usually that colorful. So, I am speculating based on what I am looking at.

Not. He is getting more money now for his bills. He could add that $25 to his food bill. The government is not supposed to be taking complete care of him. He gets unemployment and that helps to keep a roof over his head. The government did not intentionally make him ineligible for food stamps, but many people are because of other income. The story is only concentrating on people who exceed the income limit by $25 or less, to coincide with the additional $25 provided for by the stimulus plan. Only a ignorant fool would think it was intentional.

The government also used to not allow a father to live with his family if they were receiving welfare payments. They also could not own any property, only an old clunker (car). THAT was intended. This is not.

By this comparison, it's great that I only have one chronic illness instead of two, or that I only lost one job instead of the three I need to pay my bills. No one is arguing that Americans are going hungry like Somalians, but to deny that there is a hunger problem in America is irresponsible and reprehensible. Would you rather we wait until a million American children are walking around with distended bellies before we attempt to curb this problem?

These 'so-called poor' are obese for a number of factors related to their poverty. The cheapest places for food are often discount retailers and fast food chains, none of which are particularly dedicated to healthy eating. I'm sure many people would love to buy organic food and fresh meats and produce, but not everyone has access to a good grocery store or farmers' market, because of financial or geographical restrictions. Also, someone with multiple jobs cannot afford time to plan and cook healthy meals nor can they necessarily schedule weekly workouts. If your job involves standing at a cash register or answering phones then that will contribute to an unhealthy lifestyle.

As for phones, we need them to communicate, and we need cars to get to work as many cities lack decent public transportation. Do some people have 2 tvs with cable? Probably - because they would like to be entertained every now and again, but do they have 2 big screen plasmas and premium plus sports packages?

They could easily create what is called a "Spend Down Option" so Americans don't go hungry, by this the recipient then pays the $25.00 dollars back to their local Social Services, and then qualifies for Food Stamps..!

Also if he qualifies for $300.00 in food stamps that is not for only one mouth to feed, but at least two...!

Of course for Geitner and that little sh-t Bernanke, feeding the hungry would likely qualify as "Moral Hazard..!"
