Attorney General Eric Holder restated his intention on Wednesday to release a comprehensive report, declassified to the fullest extent, on the legal advice provided by the Bush administration in its authorization of enhanced interrogation techniques.

Speaking before the Senate Judiciary Committee, Holder said that delays in releasing the findings of the Office of Professional Responsibility's (OPR) investigation into former President George W. Bush's Office of Legal Counsel (OLC) was the result of administrative obstacles and not political foot-dragging or objections from the CIA

"No it is not," he said, when asked if CIA interference was a factor in delaying the publication of the OPR report.

"It is our hope to release as complete a report as we can," Holder said. "And one of the things that I think we want to do is declassify as much of this report as we can so that when people read it... they will have a full feeling for what it is, how the lawyers in the OPR dealt with (the investigation) and what is the basis of the conclusions that they reached."

Holder's remarks came in response to questioning from Rhode Island Democrat Sen. Sheldon Whitehouse, who noted that the Senate had been told more than a year ago of a pending investigation into the legal rational used by the Bush administration lawyers.

The Attorney General's testimony came on the same morning that the Washington Post reported that the CIA was pushing the Obama White House to suppress key findings of a separate report by the agency's own inspector general. That report is believe to show that the torture of terrorism suspects had not yielded strong or operational information.

Whitehouse pressed repeatedly as to whether in the case of the OPR report, the CIA was trying to influence the study's findings. Noting that the agency had a role in reviewing the report and advocated keeping some of the findings classified, the senator asked Holder what kind of assurances he had received that those agency officials, who might be implicated, were not influencing the process.

"I don't think we have gotten anything yet from the CIA," responded Holder, "at least nothing I'm aware of with regard to what their position is concerning the declassification issue.... This may be not an issue at all. And to the extent that it is an issue, I will interact with [CIA] Director [Leon] Panetta and raise the questions that you raised in addition to our general feeling that we want to have as much as this declassified as we can."

Several hours before Holder testified, a group of human rights and civil liberty organizations released a letter to the Attorney General calling on his office to release the OPR report quickly.

"We welcomed your decision to release several OLC memoranda that authorized the use of abusive and illegal interrogation techniques such as waterboarding, forced nakedness, stress positions, and exposure to frigid temperatures," read the letter, signed by the American Civil Liberties Union, Amnesty International, the Brennan Center for Justice, and others. "But within the four corners of these legal documents is only a small part of the picture," the letter stated. "By releasing the OPR report, you will demonstrate the administration's continuing commitment to transparency and openness. You will also help strengthen a proper understanding of the important role played by government lawyers serving the United States."

Do we now live in some banana republic where every time there is a change in power we prosecute the previous administration and throw them in jail.

If that is the case, the current admin may just want to rethink this as their terms will be up soon also.

I for one am proud that Bush and crew kept us safe and did not bow down to our enemies.

If Clinton had not decimated the military and specifically the intelligence forces we would never have had 911.

They've got one chance to do it right by doing it carefully and thoroughly. The records management alone in an investigation this size must be monumental.

And for the record, when we speak about justice delayed meaning justice denied, we are making reference to the constitutional right to a speedy trial once someone has been charged with a crime and is languishing behind bars. It speaks directly to the rights of the accused. There is no right to seeing a legal or judicial process happen fast because it is the political desire of those observing.

This is an interview that Terry Gross did about 7 weeks ago with
Philippe Sands who is a British international lawyer with a great deal of knowledge in international treaties and contracts. He wrote 'Torture Team' several years back where he basically named the names we now know so well - Woo, Bybee etc - and basically said 'just wait folks, just wait'. He is assisting in some unspecified manner the Spanish judge. He also helped prosecute Pinochet. The interview is very informative, and gloriously mellifluous. Enjoy :

When a strong and legitimate judicial process exists in a country, as it does in ours, the Haag is disinclined to interfere by pushing for a process in the International Court. The investigation underway in Spain can occur because that court has some legal standing as Spanish citizens were involved.

I looked up the IG firing. If you go to the non-partisan sites (you have to go pretty far down) it would appear that President Obama had good cause to lose confidence in the IG and could therefore notify Congress of his intention to fire, which he did! They gave the IG the option of resigning and let him know of their intentions and their reasons.

i know this is going to time. here in the U.S. courts( for example) prosecution of a murder trail can take up to 18 to 24 months to a defendant find his/her innocence or guilty verdict by the juries. besides Holder have only been as an AG at the DOJ for less and 5 months and we're talking about millions of pages and files that needs to sort though before any indictments can be handed down. have patience Justice is slow so it can complete.

I still say that Holder needs to get the Bush moles OUT of the JD...as quickly as possible. I'm very suspicious that one of them released that DOMA piece of sh*t the other day.
That said, could the Obama admin be softening up and finally starting to listen with half an ear to the people who put him in there? Is it too much to "hope" for?

The ticking time bomb scenario is not even used as an excuse for torture anymore. That was like the proof that was coming from Saddam's nukes in the form of a mushroom cloud unless we immediately invaded Iran.

Then the justification became that torture worked. When that was disproved, the justification was that it wasn't really torture or that the torturers relied in good faith on advice of counsel.

The real reason for torture is to illicit a confession. Remember John McCain's "confession?" Such confessions can be used as propaganda or even the basis for wars.

There is no evidence that suitcase nukes are held by AQ. I believe that torturers are sadistic and want to send a message to others. Plus, it makes you feel better - sort of like spanking a child only to find that the dog did eat his homework. It makes the parent feel better.

I wonder if all these excuses would have worked at the Nurenberg trials. The only way to stop it and witchcraft trials is a return to sanity and humanity. If you want to blame the lawyers, this is a good time for that. Also blame the democrats for their extraordinary rendering prior to 9-11. It was happening according to the book Ghost Plane.

The wheels of Justice turn slowly, and when you mix in politics, the process can sometimes appear to be frozen solid. But these reports, and there is a second one coming, are admissable evidence and must be prepared accurately.

If our Justice system does not advance the case, the International Court has already assigned it to a Judge and it will move forward to prosecution there.

This is pure manure. Torture is illegal & has been considered illegal since at least when we hung Japanese soldiers for water boarding Americans. There is no ethical, proper, supportable or legal way to argue that water boarding is legal, unless you are willing to break the law. No STATE BAR allows attorneys to lie or break the law. There is neither excuse nor justification. There is only the Obama government acting as accessories after the fact.

I watch the election results in Iran & laugh. Once upon a time, the US could/would have had something to say. After 2000, that is too high a level of hypocrisy. Same with human rights violations.
