JENA, La. — Five members of the Jena Six pleaded no contest Friday to misdemeanor simple battery and won't serve jail time, ending a case that thrust a small Louisiana town into the national spotlight and sparked a massive civil rights demonstration.

State District Judge Tom Yeager then sentenced the five, standing quietly surrounded by their lawyers, to seven days unsupervised probation and fined $500. It was a far less severe end to their cases than seemed possible when the six students _ all of whom are black _ were initially charged with attempted murder in the 2006 attack on Justin Barker, a white classmate. They became known as the "Jena Six," after the central Louisiana town where the beating happened.

"I just thank God that it's all over," said John Jenkins, father of Carwin Jones. "It's been a long, painful journey for everyone on both sides of this thing."

Barker and his family and friends sat without expression throughout the hearing. Barker's attorney said he graduated and is now an oil field worker. The family did not comment.

As part of the deal, one of the attorneys read a statement from the five defendants in which they said they knew of nothing Barker had done to provoke the attack.

"To be clear, not one of us heard Justin use any slur or say anything that justified Mychal Bell attacking Justin nor did any of us see Justin do anything that would cause Mychal to react," the statement said.

The statement also expressed sympathy for Barker and his family, and acknowledged the past 2 1/2 years had "caused Justin and his parents tremendous pain and suffering, much of which has gone unrecognized."

Barker spent several hours in the emergency room after the attack, but was discharged and attended a school event the next night.

Story continues below

By pleading no contest, the five do not admit guilt but acknowledge prosecutors had enough evidence for a conviction. LaSalle Parish District Attorney Reed Walters said in a statement that he could have won convictions but wanted to end the matter for Barker.

Charges against Jones, Jesse Ray Beard, Robert Bailey Jr., Bryant Purvis and Theo Shaw had previously been reduced from attempted murder to aggravated second-degree battery. All but Shaw were assessed $500 in court costs. The judge did not tack that punishment on to Shaw's case because he stayed in jail for almost seven months, unable to raise bail, following his initial arrest.

Each paid the fine and court costs immediately. The payment of restitution to Barker was also part of the deal, but the amount was not released. A lawsuit filed by Barker against the group was also settled Friday, though the terms were confidential.

The only member of the group to serve jail time was Bell, who pleaded guilty in December 2007 to second-degree battery and was sentenced to 18 months in jail.

Four of Friday's defendants have graduated from high school, and all are attending or getting ready to attend college. Purvis has completed his first year and Bell is planning to attend college this fall. Beard is a senior in high school in Connecticut.

"They can move along with their lives," said Bailey's attorney, James Boren. "And because there are no felonies they can look forward to full lives ahead."

The severity of the original charges brought widespread criticism and eventually led more than 20,000 people to converge in September 2007 on the tiny town of Jena for a major civil rights march. Some $275,000 was raised to hire a large defense team for the six, said Beard's attorney, David Utter.

Racial tensions at Jena High School reportedly grew in the months before the attack. Several months prior to the attack, nooses were hung in a tree on the campus, sparking outrage in the black community. Residents said there were fights, but nothing too serious until December 2006 when Barker was attacked.

"Everybody pointed a finger at Jena during this, but this happens to African-American males across the country," Utter said. "These young men were lucky that people cared and donated money so they could afford good attorneys. That made the difference."

Really? Cause back when I was in high school ( less than ten years ago) if a school yard fight broke out, we had reasonable punishment, like suspension, and talks with our parents. Prosecution for attempted murder? an Attempt by Jena officials to silence and intimidate Jena's black population.

When I was in high school, it might go like you said for a one-on-one fight, but if six people ganged up on one kid, and he had to go to the emergency room, you're damn right the police will be called.

Any group which gets preferential treatment, never wants to admit, sometimes even to themselves, that they are getting preferential treatment. I bet you that most people can pick out which posts were from whites and which were from minorities based upon the point of view of the posts.

So according to your logic Blacks have enjoyed preferential treatment here in the U.S. You mean to tell me that being hung for reading is preferential in your mind? What about being targeted for sub-prime loans, that's preferential?

I wonder why the White kids who beat the Latino kid to death and received like a year in prison is not in the headlines. Mainstream media, liberal media and conservative media have avoided this topic. The masses must agree with the sentence they received.

If you have to wonder why, you must not have lived in this country very long. There are certain penalties for white kids, and other penalties for minorities. And for rich white kids, almost anything goes. Unless the crime is against another rich white kid.

They weren't rich and the case went to the jury. I wonder why no one is calling that jury incompetent, or accusing them of playing the "race card."

None were convicted of the most serious charges. Piekarsky got 6 to 23 months for simple assault, and Donchak got 7 to 23 months for corruption of minors. Walsh pled guilty to violating Ramirez' housing rights (a federal crime), and could get 4 to 9 years- he's awaiting sentencing.
I have to agree- it's kind of weird. This is a case of murder, and yet coverage (even here in eastern PA, less than an hour away) is scant.
For those who don't know- this is in Shenandoah, PA. This town is near Hazleton, which has the distinction of having Lou Barletta as it's mayor.
There's a reason Carville called this state Pennsyltucky.

It also wasn't anywhere near attempted murder when he went to his prom a day or two later. He wasn't in the hospital in a coma, didn't have major operations (or minor ones). He simply had a few bruises. The white posters make it seem like the white kid was left for dead, beaten up 6 against 1, but if it was 6 white kids on 1 black kid in the town, I can assure you they wouldn't have been charged with attempted murder. A white kid pulling a gun on the black kids sure as heck didn't bring any charges. You make a mountain out of this molehill with attempted murder charges, the next time there is no incentive to stop once you get going. In for a dime, in for a dollar. You're going to be in prison for most of the rest of your life for a fight? You might as well justify the attempted murder charge.

Where I come from, you talk trash, you better be able to back up your smarta** comments. Don't go crying to mommy afterwards.

And finally, while a 6 on 1 beatdown may not be legal (or some may say fair), it will at least make these cocky white kids think twice about shooting off their mouth using these racial insults against minorities with impunity.

"And finally, while a 6 on 1 beatdown may not be legal (or some may say fair), it will at least make these cocky white kids think twice about shooting off their mouth using these racial insults against minorities with impunity."

So the next time a black calls me a honkey or cracker I can get 5 of my cracker friends and go beat them up to teach them a lesson? We`d end up in the news being called KKK, lynch mob and have Jesse and Al on our butts screeching, etc. Give me a break. lol

When nooses are put up to intimidate the blacks, and a white kid can pull a gun on the black kids without any consequences, naturally you would expect that when provoked by being called the N word they would lash out. Should they wait for the white kids buddies to show up with more guns? Its tough when the white establishment has shown a disregard for the safety of ALL students.

No one knew who put up the nooses, but from the news reports, they apparently didn't look very hard. Kind of reminds me of the KKK, intimidating blacks hidden under their white sheets, not being caught because many of the members or sympathizers were also part of law enforcement and civic leaders.

Not to mention cases where minorities have actually been k i!!ed by h@te crimes. I have mentioned the case in Pennsylvania a couple of times on this post just to show the hypocrisy of a number of people who have po $ted here. However, HP keeps censoring me and I just don't have that kind of patience.

What about the case in Texas where the three white guys caught a black guy James Byrd Jr. and dragged him behind their pickup truck until he died. One of the guys convicted didn't get the death penalty.

I want to make a correction. They knew who put up the nooses. The Principal of the school recommended that the school expel those youths, but the white superindendent believed it was an adolescent prank and overruled.

Isn't putting up nooses to intimidate black students, within the context of Southern history, terrorism?

You want it to be that way so bad, don't you? You can't create the narrative of the white person unjustly wronged by black brutes, so reach for the OJ card. This is surreal. The kid used ethnic slurs and got rearranged. It's not nice, but that's why one shouldn't do that.

Leopards don't change their spots, I am sure eventually they will kill someone that someone cares about or assault someone somewhere where prosecutors do their duty. Having worked in the justice system I can assure you that reabilitation is rare.

You're talking about the white guys, right? One drew a gun on the black kids, and didn't even get a slap on the wrist. He may shoot the gun the next time. Or it may progress from putting up a noose in the night, to actually going out and hanging a black guy like in the good old days?

This is a poorly written article because it leaves it all completely unclear as to what had originally happened. If I hadn't paid attention back when this was current news, I'd be _completely_ lost by this article. And, in fact, it was only in reading the comments that it jogged my memory enough to put the pieces back together in my mind. ...The article should have spelled out an overview of the story so we readers would get it on the first pass.

As for what happened, I'm not sure justice was exactly served but it was a lot closer than what was going to have happened if there hadn't been a media firestorm some years ago... Really, these black kids were shat upon, no doubt about it. _Any_ serious convictions (of them) would have been a real travesty...

This type of thing goes on in tons of southern towns in the south against black people.
Go just sventy miles north of Jena, Louisiana to Magnolia, Arkansas where black men get ten years in jail for weed.

There are some pretty draconian federal sentencing guidelines for cocaine and LSD. Yes people get around them with the help of judges and prosecutors, but not always.

I lived near the area in Alexandria La. in the late 70s, early 80s and lived on the AF base there, attended public school. For those who never lived in La. or done any real time in the center of the state, it is difficult to understand the level of racism and violence that still goes on today. My first experience in the South, it was unbelivable, sickening, and saw more than my share of white on black, black on white.

The racists whites labled me a "yankee Ni@$#$ lover" since my friends from the base were black and associated with them. I was actually told by the black kids that my life wd. be easier if I went and sat with the white kids. The Black military kids I knew would introduce you to the ground without a word if the word N#%$ was ever said and saw it happen more than once.

When the situation made the news knowing the racist-judges included-in the area wd. do all they could do to send these kids away and am surprised they got off. I felt no pity for the white kids who got his ass handed to him. He def. got what he deserved and there are tens of thousands in that state who need the same beating.

"LaSalle Parish District Attorney Reed Walters said in a statement that he could have won convictions but wanted to end the matter for Barker."

And tons of more bad publicity for the town of Jena and their Parish. I'm not sure anything was learned through this, except that racism continues to be ugly.

Not everyone is like that. The South that I know and love has little to do with all that. I realize that's not the case elsewhere but when you say "the South" instead of "parts of the South" or something like that you sting people who don't deserve it. Another thing, I'm sick of "the South" being used to describe ONLY white people. "The South" is all of us who live in it.
