I Like ItI Don’t Like It

On Friday, President Obama signed a new war spending bill into law, but "not without taking a page from his predecessor and ignoring a few elements in the legislation," the Hill reports.

Obama included a five-paragraph signing statement with the bill, including a final paragraph that outlined his objections to at least four areas of the bill.


President George W. Bush was heavily criticized for his use of signing statements, declaring he'd ignore some elements of legislation by invoking presidential prerogative.

The Obama administration announced in the statement it would disregard provisions of the legislation that, among other things, would compel the Obama administration to pressure the World Bank to strengthen labor and environmental standards and require the Treasury department to report to Congress on the activities of the World Bank and International Monetary Fund (IMF).

Today I have signed into law H.R. 2346, the "Supplemental Appropriations Act, 2009." This Act provides the necessary resources for our troops while supporting ongoing diplomatic and development efforts around the world.

We face a security situation abroad that demands urgent attention. The Taliban is resurgent and al Qaeda is increasing its attacks from its safe haven along the Afghanistan-Pakistan border. The funding provided in this Act will ensure that the full force of the United States is engaged in an overall effort to defeat al Qaeda and uproot this safe haven.

At the same time, funding contained in this Act will provide resources to help create political and economic stability in post-conflict areas. These funds will assist Afghans and Iraqis in protecting and sustaining their infrastructure and building their capacity for more responsive and transparent governance. The Act also provides critical support for continued U.S. diplomatic and development activity in Iraq, Afghanistan, and Pakistan.

In addition, this Act includes funding for other domestic and international issues, including nearly $8 billion to enhance our Nation's capability to respond to the potential spread of the H1N1 flu outbreak. It also expands the resources available to the International Monetary Fund (IMF) by allowing it to boost its lending ability. Many developing countries are experiencing severe economic decline and a massive withdrawal of capital, and the IMF needs to make sure it has the resources necessary to effectively respond to the current financial crisis.

However, provisions of this bill within sections 1110 to 1112 of title XI, and sections 1403 and 1404 of title XIV, would interfere with my constitutional authority to conduct foreign relations by directing the Executive to take certain positions in negotiations or discussions with international organizations and foreign governments, or by requiring consultation with the Congress prior to such negotiations or discussions. I will not treat these provisions as limiting my ability to engage in foreign diplomacy or negotiations.

Does anyone know if we are going to get any accountability for the "Stimulus
Monies" to each state?
There are some needy schools and infrastruc­ture...and yet money is being placed
elsewhere instead...­for example> to pay down state's deficit. :(
That's not what "Stimulus" was supposed to be used for!

Every day Obama looks more and more like Bush . No. It's part of a pattern . Are you O.K. with war criminals and traitors riding off into the sunset as if nothing happened ? Well I am not. If you set about preventing mass murderers and war profiteers from being held accountable are you any better then them ? Not in my book . Anyone who read this article without reading the signing statement would be misled. The President is not "ignoring" parts of the law. He believes that parts of the law are unconstitutional if applied in such a way that limits his "constitutional authority to conduct foreign relations". The President, under the Constitution, has certain powers, which cannot be limited or directed by Congress through the passage of legislation. Rather than veto the legislation because it could be interpreted as unconstitutional, the President will apply it in a manner that is consistent with the Constitution. Congress cannot limit the President's ability to conduct foreign relations or require the President to consult with Congress prior to conducting foreign relations.

What possesses the Huffington Post, or any media, for that matter, to write an article about an article written by another publisher? You might as well reprint a press release. Do your own research and report the news correctly.

To clarify my post explaining the difference between a SIGNING STATEMENT (legal) & a LINE ITEM VETO (illegal).

Again... the VETO actually renders an ENTIRE Bill MOOT. It makes it an "UN-LAW". The proposed legislation is then RETURNED to the Congress to either RE-WRITE or to OVERRIDE the veto. Until ONE of these thngs are accomplish­ed.. the IS NO LAW.

By using a SIGNING STATEMENT.­.. the President is not NEGATING the legislatio­n.. NOR is he CHANGING it.... he is merely stating his CONCERN that certain ASPECTS might be Unconstitutional & that he intends either to ignore enforcing these aspects (restricted to HIS role in them) or to implement them in a manner that falls within the boundaries of what he feels IS Constitutional.

This IS within his purview.

It is a right the Executive has been using since MONROE.. & the SCOTUS has ruled as to its legitimacy.

the constitution is silent on the matter, they are not arguably unconstitutional unless they are used to ignore the law or interepret the law in a way that conflicts with the language of the law. Changing the scope or meaning of the legislation with a signing statement would violate the presentment clause

I got a better idea, show me where it's legal in the Constitution. Course, I CAN show you in the Constitution where it says that Congress is the legislative branch, and as such, is the ONLY branch that can create, modify or repeal legislation.

Signing statements, especially when done in such a fashion, are nothing more than criminal confession that the signer is about to ignore the law. Remember, even if a President chooses to ignore a law by refusing to sign it at all, it still becomes LAW after 10 days doesn't it? Signing statements cannot change, alter or otherwise nullify anything in the law. If the President disagrees, he's simply whining like a 2 year old pitching a tantrum.
