Politico:

President Barack Obama's claims of broad executive authority to carry out the war on terror are drawing fire from an unexpected source: federal judges nominated by President George W. Bush, who asserted the sweeping powers in the first place.

In recent weeks, three different Bush appointees considering cases relating to war-on-terror detainees have rejected arguments from Obama's Justice Department, which adopted virtually unchanged the positions the Bush administration had staked out.

Now there is a misleading headline.

Judges upholding the Constitution?

Judges appointed by Bush upholding the law?

Those are both much better headlines.

Funny thing when you get appointed to a lifetime position. You start to pay attention to the law. And the Constitution.

Justice Souter was no fluke.

Judges appointed by Bush upholding the law when CONVENIENT

Or just:
Bush Judges put Partisan Politics above the Nation!

Haven't been paying attention have you/

The article is about Bush appointees who are ruling AGAINST Presidential powers.

Just like the Supreme Court has done recently.

They are ruling against the Neo-Con Unitary President, or Presidential is All Powerful in War Time.

And this should be noted and the judges thanked for doing their job.

Yay Team! It is now part of national law, thanks to conservative judges, that the President does not have unlimited powers :) :)

Much much better then a non-binding Presidential Policy. A Judicial Opinion carries the weight of the law.

tho I agree with reiging in executive powers I must say the GOP better back down on the phrase "judicial activism" because the way I see it a majority of the judges in this country and the "5-4" conservative Supreme Court seem to be ruling as "activists" thru their ideological ultra conservatism than precidence and the rule of law.

This Supreme Court is the worst so far. They gave Bush the 2000 election when the Constitution never gave that power to the courts.

Cheney (err Bush) WAY overreached on executive power in the "so called" war on terror (what a crock) I'm happy to see that power being reigned in. I feel much more comfortable with President Obama in charge instead of Cheney, but we do not elect kings, we elect executives and there MUST be checks and balances.

The problem being with judges like this when another Republican gets in office they may well decide he DOES have these powers and away we go again. It's also the problem with Obama not investigating and prosecuting the Bush war crimes.

Putting party and convenience above nation and justice is bad.

While I hate like hell to agree with these human stains on the notion of justice, those really are powers best used with some oversight. This is America, after all, and we have a large government because checks and balances don't happen in a vacuum.
