LOS ANGELES — The future of Michael Jackson's children was thrown into question Thursday when his ex-wife emerged and won a delay in a custody hearing while she decides whether she wants to raise her two offspring.

It was the first legal move from Deborah Rowe since the entertainer's death. Jackson's will asks for his mother, Katherine, to get permanent custody of all three of his children.

Rowe, who met Jackson as a receptionist in the office of his dermatologist, has characterized their relationship as strictly for the purpose of birthing Jackson children. She is the mother of his two oldest children and received $8.5 million in their divorce, according to court records. His youngest child was conceived with a surrogate.

She has spent very little time with her son Michael Joseph Jr., known as Prince Michael, 12; and daughter Paris Michael Katherine, 11. But Rowe also has opposed the idea of Katherine Jackson getting custody of her children when it came up in the past.

Rowe's attorney, Eric M. George, said Thursday she had not decided whether to seek custody.

Superior Court Judge Mitchell Beckloff rescheduled a guardianship hearing for July 13 at the request of attorneys for Rowe and for Katherine Jackson, 79, who has temporary guardianship of her son's children.

The identity of the surrogate mother of the singer's youngest child, 7-year-old son Prince Michael II, has never been revealed.

Jackson's public memorial was set for 10 a.m. Tuesday at the Staples Center in downtown Los Angeles, according to a press release from the office of the Jackson family's publicist.

Randy Phillips, chief executive of AEG Live, which owns the Staples Center and was Jackson's promoter, said tickets would be free. He was not sure how they would be distributed.

But Los Angeles City Councilman Dennis Zine said the Jackson family should consider delaying the public memorial to allow more time to plan. He also said the cash-strapped city doesn't have the money to pay police overtime.

"If you can imagine 100,000 people show up and you have 20,000 capacity (at the Staples Center), there is not sufficient room. Now you have a crowd-control problem," he said. With the July Fourth holiday weekend "it's the worst time ... to work something out."

Another court hearing will proceed as planned Monday on who will take temporary control of Jackson's estate. He left all his assets to the Michael Jackson Family Trust.

A person familiar with the details of the trust said it would be shared between his mother, who gets 40 percent, his three children, who together get 40 percent, and charities for children, which would receive 20 percent. The charities will be determined later by the trust.

The person was not authorized to speak publicly and requested anonymity.

Authorities also were investigating allegations that the 50-year-old Jackson had been consuming painkillers, sedatives and antidepressants.

California Attorney General Jerry Brown said his office was helping Los Angeles police investigate the possible involvement of prescription drugs in Jackson's death.

His Bureau of Narcotic Enforcement is searching a state database that tracks doctors who prescribe controlled substances, how much and to whom.

The federal Drug Enforcement Administration also has joined the investigation. The Los Angeles Police Department asked the DEA to help, a law enforcement official in Washington told the AP on condition of anonymity because of the investigation's sensitivity.

In an interview on NBC's "Today" show, Jackson's brother Jermaine said he would be "hurt" if toxicology reports showed his younger brother abused prescription drugs.

"In this business, the pressures and things that you go through, you never know what one turns to," he said.

this is just a thought.. considering if it's really true-- she wants custody of those kids..

as she will be breaking Mj's Will & his wishes as well as those contracts she signed with him..

will she still want those kids.. IF THOSE KIDS DON'T END UP GETTING MJ's estate & TRUST Fund..instead it get distributed to all the Jackson cousins?!

Regardless of what anyone thinks, she is going into a California court system. The court will look at the previous court documents, then promptly throw them out. California courts look at guardianship of children in this order: 1. Parent 2. Sibling 3. Sibling of Parent 4. Grandparent. LaToya, and Janet have a better chance of obtaining custody than does the Grandmother.

I want what is best for those kids. They have already lost enough. I hope Ms. Rowe and Mrs. Jackson will put the welfare of those kids first. They don't need some nasty custody fight, not right now. The two ladies need to sit down, without the lawyers and media and do what's best for those kids. Also I hear that Nanny who help raised them is in town. She is with them at the Jackson home. Her name is Grace. She need to be involved too, because those 3 kids were mostly taken care of by Grace and I'm sure they have fond memories of her.

Debbie Rowe spent no time whatsoever with those children. I so wish some of you who post a comment would read the history before making a statement. Grace, the nanny, was their surrogate mother. The children NEED to stay together. If I was the Judge, I would award them to Katherine with the stipulation that Grace stay on as nanny until Blanket is age 18. Also, there needs to be a condition that the Abusive Grandfather cannot ever live in that house or that those children cannot be around him without supervision. He is certifiable. Katherine and Joe have lived in separate houses for quite a long time. He is in Vegas. Hopefully, Katherine will live until Blanket is age 18 so they don't have to be moved and uprooted AGAIN. My children are grown but this case has certainly brought to light that all of those with young children need to make provisions for where those children will go in case of an accident and death. It happens.

Doesn't Debbie already have an ongoing relationship of some kind with the kids? I'm sure it will be worked out just fine.

The judges in Family Court probably see scenarios similar to this fairly frequently (with one parent deceased and the birth mother and relatives of some kind both wanting to get custody of the children.

I'll bet this kind of case will not be a stranger to the judge who handles it. They will more than like be on top of the situation. The faces are different, but the situaion is probably very familiar. Famous, rich or not.

In case no one here read her interview, she said, "I do not want those kids. They are Micheal's kids not mine. My animals are my animals".

Biology doesn't make you a good parent. It would be nice but it doesn't. She has made it clear on more than one occasion as she walked away with millions.

Besides, one day the kids will see how she really felt about them and it will be painful, so if they are living with mommy dearest it will be unimaginable.

People keep saying she was a close friend of some sort, but If I remember clearly she said in her interview that she hadn't seen them and didn't want to.

The way I see it, debbie wants the money and if the kids come with it, well that is something she will just endure. Sad.

I've never read an interview on her. Just giving my thoughts the way everyone else on the site is.

And here is another thought, as I am sure the just will consider many thoughts in this case:

Although Michael asked that the children go to Katherine, then Diana, both Katherine and Diana are mothers. They know how important it is for kids to have their mother if possible. Believe it or not, they may not object to Debbie getting the children, they may not find the reason Michael does not want her to have them all that bad.

The idea that if the kids want to get to know their mother seems like a good one. Katherine could keep the kids legally. If it works out that the kids bond with their mother, what could be so bad about that?

In regards to Debbie's interview, I would think she would have said something to make the deal stick with Michael and keep the going for him as easy as possible considering the money she was receiving in the transaction to hand the kids over whether that was the truth of what was in her heart or not. I somehow feel there may be more to this. Sure the judge will ask about it.

She would not allow the chidren to call her mom. She felt that they were Michael's children, not hers. Also, I think that the kids are old enough to decide where they would prefer to go, and II am certain that would be with their grandmother.

I think the children deserve a chance to have a mother for a while, growing up without one has probably not been the best experience for them. It would be ideal for Debbie and Katherine to work thinks out where they all have an open relationship.
Debbie has a ranch out of town, that would be a peaceful place for them to adjust. Debbie is a sweet woman, she cared a lot for Michael, that was why she did it for him. There is no reason to think she would not be a sweet loving mother.
79 years old is old and Katherine has trouble walking now, so it would be mostly staff that did anything with them.
After being sequestered away by Michael, it would be nice to see them get something more normal and logical in their lives.
Of course Ms. Rowe left them with Michael, he was the boss, but now he is dead, the children need a mother. If she got 8 million, she doesn't really need money and that is not the issue anyway, the children are the issue. What do you care if the money to care for the children goes to Debbie? Really!
In CA the judge speaks with the kids and mother's rights are paramount unless there is a serious problem, which Ms. Rowe does not have.

I totally agree with you.

Debbie didn't have a chance in hell to get to know those kids as along as Michael was alive. She was just the means to an end for him. He wanted the children with out the bagage of haveing a female around.

Sad to say, them more I hear what is going on in the news the more distubing MJ seems to me.

I love his music as much as the next person, but he who holds the money gets what he wants and in this case it was all about the kids for him.

I have no doubt that he loved his children.

This whole thing is so sad. God Bless this family to work this out for the childrens sake.

oh pls.. Rowe made herself plain ever since she got involved in this making it clear-- she was having these kids so Mj can have kids.. as he cannot adopt..

so rather late in the day to come up with all this melodrama.. there's enough interview clips of her to attest to what I s aid.

she knew exactly what she was getting into-- in fact, she offered herself! MJ would never have dreamt of her otherwise.

Now, there's a black woman who s ays- she's Banket's MUm.. ay! forget it. she's black.. Banket is Whitew.. for starters.

as usual, with anything to do with MJ & Money is involved.. all these cracks come out of the woodwork.. just like during the allegations.

when people are consumed with greed they never have enough money. Also, didn't big debbie divorce him? Katherine can mother them, get an excellent female nanny but big debbie isn't it.

I hope someone has these kids best interest at heart. They have lost their dad, to many on this site say give them to big debbie, which will separate the kids, because she is the biological mom.

Eight million dollars, not to mention any amount wouldn't be enough to leave my kids with anyone that I didn't feel were safe, but big debbie did. The Jackson's get her even if many don't. It is all about the money.

Deborah Rowe is being called every dirty name in the book, but the guy who cooked up the irresponsible scheme that left three innocent children in a state of chaos is on his way to sainthood. Even if Jackson's mother is the nicest, kindest lady in the whole wide world, she can't possibly be prepared for the circus that was bequeathed to her and the children.

The best thing for the kids is to stay with their grandmother for the time being, but the grandmother needs to let the kids get to know their mother; they are old enough to decide Ms. Rowe's merits as a parent. We don't know for a fact what kind of arrangement Michael Jackson had with Debbie Rowe, and I suspect there is a lot more to it than Ms. Rowe simply not seeing the kids.

It seems to me that Katherine Jackson is a good, stable parent, and more than likely the reason why her kids have avoided the trouble that befell other child stars. The only two things that concern me is (1) her age and (2) her religion. While she is apparently as healthy as someone pushing 80 can be, it remains to be seen if she'll be able to do that for long.

I can tell you as someone who grew up amongst the Jehovah's Witnesses that it can be a very hard religion to grow up in. While I was able to stay out of it and only accompany family to the meetings while my mother was at work, I know firsthand what that religion can do to a young person, particularly when the child does not really want to be one. Knowing the religion, I'm sure the children will be expected to follow "The Truth" as long as they are in Katherine Jackson's household.

i was with you until you mentioned her religion. what does that have to do with anything?

plus here's the bottom line. Rowe gave up custody. they signed papers and everything. MJ had full custody. he decided that should something happen to him, his mom would get the kids. unless there is some sort of loophole in the papers, kids should go to his mom. You could say "well we're not talking about material stuff, we're talking about human beings". true but Rowe doesn't seem that stable to be honest. gave up on her kids for a few millions, the father dies and all of a sudden she comes out of no where saying she wants the kids? come on now...

here's what i think Katherine should do. let Rowe spend time with the kids like you said. and if she decides to trust Rowe with them, so be it. but it should be her (Katherine's) decision.

She didn't come out of nowhere asking for the kids. She tried to get more access to the children in 2004 and Jackson took them out of the country to Bahrain. That was a documented court petition, so it's fact.

Speaking as one who grew up as a witness I disagree. First of all my mom taught us the "Truth", but it was never forced on us and not all of us are witnesses today. My mom treats us all the same. Your reality princessannie is not everyone's reality. I am very thankful for the way I was raised. I don't know what you though it did, but I never found it a hard religion. There is structure. There should always be structure for kids no matter what.

Reports on tv are often far from accurate as to what Witnesses teach. Rebbie is the only one of the kids that is a Witness. We all have have been given the freedom of choice. Including you. I don't know who told you you had to be a Witness, because you didn't. Remember choice.
