LOS ANGELES — The future of Michael Jackson's children was thrown into question Thursday when his ex-wife emerged and won a delay in a custody hearing while she decides whether she wants to raise her two offspring.

It was the first legal move from Deborah Rowe since the entertainer's death. Jackson's will asks for his mother, Katherine, to get permanent custody of all three of his children.

Rowe, who met Jackson as a receptionist in the office of his dermatologist, has characterized their relationship as strictly for the purpose of birthing Jackson children. She is the mother of his two oldest children and received $8.5 million in their divorce, according to court records. His youngest child was conceived with a surrogate.

She has spent very little time with her son Michael Joseph Jr., known as Prince Michael, 12; and daughter Paris Michael Katherine, 11. But Rowe also has opposed the idea of Katherine Jackson getting custody of her children when it came up in the past.

Rowe's attorney, Eric M. George, said Thursday she had not decided whether to seek custody.

Superior Court Judge Mitchell Beckloff rescheduled a guardianship hearing for July 13 at the request of attorneys for Rowe and for Katherine Jackson, 79, who has temporary guardianship of her son's children.

The identity of the surrogate mother of the singer's youngest child, 7-year-old son Prince Michael II, has never been revealed.

Jackson's public memorial was set for 10 a.m. Tuesday at the Staples Center in downtown Los Angeles, according to a press release from the office of the Jackson family's publicist.

Randy Phillips, chief executive of AEG Live, which owns the Staples Center and was Jackson's promoter, said tickets would be free. He was not sure how they would be distributed.

But Los Angeles City Councilman Dennis Zine said the Jackson family should consider delaying the public memorial to allow more time to plan. He also said the cash-strapped city doesn't have the money to pay police overtime.

"If you can imagine 100,000 people show up and you have 20,000 capacity (at the Staples Center), there is not sufficient room. Now you have a crowd-control problem," he said. With the July Fourth holiday weekend "it's the worst time ... to work something out."

Another court hearing will proceed as planned Monday on who will take temporary control of Jackson's estate. He left all his assets to the Michael Jackson Family Trust.

A person familiar with the details of the trust said it would be shared between his mother, who gets 40 percent, his three children, who together get 40 percent, and charities for children, which would receive 20 percent. The charities will be determined later by the trust.

The person was not authorized to speak publicly and requested anonymity.

Authorities also were investigating allegations that the 50-year-old Jackson had been consuming painkillers, sedatives and antidepressants.

California Attorney General Jerry Brown said his office was helping Los Angeles police investigate the possible involvement of prescription drugs in Jackson's death.

His Bureau of Narcotic Enforcement is searching a state database that tracks doctors who prescribe controlled substances, how much and to whom.

The federal Drug Enforcement Administration also has joined the investigation. The Los Angeles Police Department asked the DEA to help, a law enforcement official in Washington told the AP on condition of anonymity because of the investigation's sensitivity.

In an interview on NBC's "Today" show, Jackson's brother Jermaine said he would be "hurt" if toxicology reports showed his younger brother abused prescription drugs.

"In this business, the pressures and things that you go through, you never know what one turns to," he said.

Well Dan Abrams, was the first to plant the seed on NBC; about Debbie Rowe still having legal rights to the kids. In addition, notice no one said anything when Michelle Obama mentioned that her Mother take care of her children well she was campaigning and that is why she moved into the White House. There are numerous children, including myself who was raise my their grandparents. Furthermore, I bet that Gloria Allred is positioning herself to be one Debbie's Row's attorney ( she built her fame going after Michael Jackson as well), in addition...all those so call Michael Jackson friends who he begged for drugs and claim he was a drug addict; are also currently be paid or promise type of money if she should win custody. I was so angry as I watched Larry King, Keith Olbermann, Nancy Grace, Morning Joe, Anderson Cooper...not one of them asked these friends of Michael Jackson, for dates and times that Michael asked them for drugs or dates that they witness him taking drugs. Yet networks allowed these accusations to be presented as facts. What is evident is that racism within the media is alive and well and because they couldn't get him on the child molestation charges so they next bet charge- Drug addict. No proof. But that is what institutional racism is, we minorities don't control the narrative, white control media gets to paint us as they see fit even when we die.

primary problem w/ Katherine is she is nearly 80, and not in fab. health; worse yet, even tho Joe was "cut out", they are still married, (even if he lives half a day away), and, as a Jehovah's Witness, she is quite religious about her marriage; Joe is a big manipulator. Clearly, Debbie should not have them-----no earler caring, NO "bonding" , and it would split them up from their youngest brother-------essentially, this is a massive mess. Maybe the nanny will be back (supposedly, Katherine liked her---nice if true). Also, at least he had Diane Ross as a backup----not bad-----true she's 65, but, she has raised 5 children, put them thru college, I believe, and in spite of usual celeb/ent. stuff here and there, not all a bad idea----

Diana Ross is a real superstar. Danced center stage at Caesars palace with her once. They would live the life they are accustomed to with her, if God forbid something happens to their grandma some day. If anything with this new decision to make Katherine the childrens new legal parent, , maybe Katherine can bring out the talent she instilled in her own famous children. I believe you belong where God meant you to belong. Michael was their soul parent, and chose his mother to carry on with his affairs and responsibilties and the courts must honor the will.

I think that Dianna Ross is an interesting choice for raising the kids. I don't know anything about how her own kids turned out, but at least she's kept them out of the spotlight and did it without making them wear masks.
I cannot imagine letting these kids around Joe Jackson. That man is beyond the pale. There are no words in any language low enough to describe him.
Those poor children, selfishly brought into this world and raised by a narcotic addled man with the maturity level of a 5 year old and now this.
Just a sad situation all around.

No matter what someone say about Diana Ross, she raised well adjusted kids, look at her daughter and her son that are both actors, Tracy Ross and I think one of the sons that is an actor is named Brandon, but they are well adjusted adults, you have never heard anything bad about her kids in the news. Kate Jackson is a good person and a good mother, Joe Jackson used the kids to make money for the family and in his own pea brain, he thought he was doing what was best for the kids and the family. He no longer lives with Katherine jackson and should would probably have paid help with the kids, I can't see the court giving them to debi rowe.

On the news someone mentioned the children's grandmother's age, i.e. whether she has the energy to raise three young children. People... the Jackson's are a wealthy family. They will hire help. Those kids will be well cared for, make no mistake.

The only Jackson that is wealthy in her own right is Janet; the rest of the family have a mix of low paying jobs, no significant savings, no high value property, bad credit, and bankruptcy in their financial resumes.

Debbie Rowe found a way to get to the money. She said in her own words that she did not want the kids. She is now an official gold digger. If she wanted a relationship with those kids, she would have done anything to establish it--that is what a true mother would do. Now, she suddenly wants custody. It is called money talks.

is it really "known" that she is not the real mother? she stated yesterday she will take the dna test... I am not coming in on her side , just saying if you think you have all of the facts straight on any of this mess , you might end up thinking again.. at this point only real tests results and anyone passing a lie detector test should be taken for their word.. And some might say that's not really proof enough..

I can't wait until Chris Matthews comes back to Hardball. I like Chuck Todd but he didn't handle the interview with Gloria Allred and Toure from Rolling Stones well. They were suppose to talk about Jackson's kids and the new video of Jackson. Allred felt the need to address the fact that Jackson was a molster.

I can't stand Allred and she only seems interested in high profile questions that brings attention to herself.
