LOS ANGELES — The future of Michael Jackson's children was thrown into question Thursday when his ex-wife emerged and won a delay in a custody hearing while she decides whether she wants to raise her two offspring.

It was the first legal move from Deborah Rowe since the entertainer's death. Jackson's will asks for his mother, Katherine, to get permanent custody of all three of his children.

Rowe, who met Jackson as a receptionist in the office of his dermatologist, has characterized their relationship as strictly for the purpose of birthing Jackson children. She is the mother of his two oldest children and received $8.5 million in their divorce, according to court records. His youngest child was conceived with a surrogate.

She has spent very little time with her son Michael Joseph Jr., known as Prince Michael, 12; and daughter Paris Michael Katherine, 11. But Rowe also has opposed the idea of Katherine Jackson getting custody of her children when it came up in the past.

Rowe's attorney, Eric M. George, said Thursday she had not decided whether to seek custody.

Superior Court Judge Mitchell Beckloff rescheduled a guardianship hearing for July 13 at the request of attorneys for Rowe and for Katherine Jackson, 79, who has temporary guardianship of her son's children.

The identity of the surrogate mother of the singer's youngest child, 7-year-old son Prince Michael II, has never been revealed.

Jackson's public memorial was set for 10 a.m. Tuesday at the Staples Center in downtown Los Angeles, according to a press release from the office of the Jackson family's publicist.

Randy Phillips, chief executive of AEG Live, which owns the Staples Center and was Jackson's promoter, said tickets would be free. He was not sure how they would be distributed.

But Los Angeles City Councilman Dennis Zine said the Jackson family should consider delaying the public memorial to allow more time to plan. He also said the cash-strapped city doesn't have the money to pay police overtime.

"If you can imagine 100,000 people show up and you have 20,000 capacity (at the Staples Center), there is not sufficient room. Now you have a crowd-control problem," he said. With the July Fourth holiday weekend "it's the worst time ... to work something out."

Another court hearing will proceed as planned Monday on who will take temporary control of Jackson's estate. He left all his assets to the Michael Jackson Family Trust.

A person familiar with the details of the trust said it would be shared between his mother, who gets 40 percent, his three children, who together get 40 percent, and charities for children, which would receive 20 percent. The charities will be determined later by the trust.

The person was not authorized to speak publicly and requested anonymity.

Authorities also were investigating allegations that the 50-year-old Jackson had been consuming painkillers, sedatives and antidepressants.

California Attorney General Jerry Brown said his office was helping Los Angeles police investigate the possible involvement of prescription drugs in Jackson's death.

His Bureau of Narcotic Enforcement is searching a state database that tracks doctors who prescribe controlled substances, how much and to whom.

The federal Drug Enforcement Administration also has joined the investigation. The Los Angeles Police Department asked the DEA to help, a law enforcement official in Washington told the AP on condition of anonymity because of the investigation's sensitivity.

In an interview on NBC's "Today" show, Jackson's brother Jermaine said he would be "hurt" if toxicology reports showed his younger brother abused prescription drugs.

"In this business, the pressures and things that you go through, you never know what one turns to," he said.

ou got it right! She gave up all parental rights and now wants to step in for the welfare of the children? Give me a break!! Katherine may be 79 years old, but you can believe she has the love and wisdom to care for these kids. As a grandmother, I can attest: God made grandparents to get it right the second time around!

Hopefully Ms. Rowe and Mrs. Jackson will do what is best for those kids. They just lost their father and they don't need to go through a nasty court fight. I know people will say that they are not Michael's kids, but I say he has been there for those kids from day one, they know him as their father. Ms. Rowe took money twice for those kids. Now guess what? I still it is all about the money once again. She gets the kids now, she is set for life. She can put all the horses she want on that ranch she brought with the money she got from Michael. Those 3 kids need to remain together. Please do what is best for those kids. They are old enough to say where they want to stay.

You're bad mouthing a nice lady thinking that all people are only in it for the money, that could just be your projections.
Debbie knows that the children might need their mother now that they've lost the only parent they really knew.
She was loving enough to bear these children for Michael, what makes you think she has turned into a completely different person over the years? You don't even know her.
It is almost perfect that there is a mother who is willing to step up and take care of these children, that is a pretty big undertaking . It will be a lot of work and adjustment, but she is willing to do it for the children. I can't see what could be better.
Katherine can still be grandma, but she is 79 and they need someone younger. They'll no doubt have an open relationship if both women are as loving as Michael said they were. They also need to be cared for away from Joe and his ilk. They aren't "just Jacksons" they are Americans, they deserve to see the other side. They'll be 18 in no time, let them have all the love they can while they grow up.

Nice. She wants to separate the youngest child from his older sibs right after their father and only parent in the world dies. I dont know if she was the donor of the eggs. I dont know if MJ or any other black man is the father but it sure doesn't look like it. Next thing you know, the alleged sperm donor will be demanding custody. This is just the beginning, folks. Its gonna get weirder and weirder. I feel sorry for those poor kids in the middle of all this chaos. That mother/surrogate (whatever) doesn't seem the least bit concerned about what the kids are going through.

Actually, the report says that she would agree to take the youngest to keep all three together. It's a very shrewd move, actually. Insisting on separating the children would significantly weaken her case. That would give the judge enough "best interests of the children" leverage to keep the kids from her.

If I were her, I'd go to court with a plan for a third party controller on the money to authorise use of funds for children's needs only and that would likely seal the deal. Well, that and a good visitation plan for Katherine and any other Jackson interested in having a relationship with the kids.

Her attorney states that she has not made a decision yet ... ok, hopefully those children take 20 years to make their decision ... if she has any parental rights, my prayer is that those children divorce her !

Yeah, but if she has a mouth she could say no. It will be hard to get sympathy from any judge or jury on this and if I am correct at the age of 12 in the state of CA a child can petition the court as to which parent or guardian they want to live with.

I can't see a judge wanting to split those three children. That is reason enough for her not to get full custody. I am sure that the delay is because she is in talks with the Jacksons. Money, money. I hope they go to court. She'll lose.

My guess is that the lawyer who is advising her on this is not taking the case on contingency. Her previous actions, behavior, and statements are on the public record, so if there is any justice in this world, her petition will be denied without hearing. I don't know if Katherine Jackson is the very best choice, but it has to be better than Ms. Rowe.
