LOS ANGELES — The future of Michael Jackson's children was thrown into question Thursday when his ex-wife emerged and won a delay in a custody hearing while she decides whether she wants to raise her two offspring.

It was the first legal move from Deborah Rowe since the entertainer's death. Jackson's will asks for his mother, Katherine, to get permanent custody of all three of his children.

Rowe, who met Jackson as a receptionist in the office of his dermatologist, has characterized their relationship as strictly for the purpose of birthing Jackson children. She is the mother of his two oldest children and received $8.5 million in their divorce, according to court records. His youngest child was conceived with a surrogate.

She has spent very little time with her son Michael Joseph Jr., known as Prince Michael, 12; and daughter Paris Michael Katherine, 11. But Rowe also has opposed the idea of Katherine Jackson getting custody of her children when it came up in the past.

Rowe's attorney, Eric M. George, said Thursday she had not decided whether to seek custody.

Superior Court Judge Mitchell Beckloff rescheduled a guardianship hearing for July 13 at the request of attorneys for Rowe and for Katherine Jackson, 79, who has temporary guardianship of her son's children.

The identity of the surrogate mother of the singer's youngest child, 7-year-old son Prince Michael II, has never been revealed.

Jackson's public memorial was set for 10 a.m. Tuesday at the Staples Center in downtown Los Angeles, according to a press release from the office of the Jackson family's publicist.

Randy Phillips, chief executive of AEG Live, which owns the Staples Center and was Jackson's promoter, said tickets would be free. He was not sure how they would be distributed.

But Los Angeles City Councilman Dennis Zine said the Jackson family should consider delaying the public memorial to allow more time to plan. He also said the cash-strapped city doesn't have the money to pay police overtime.

"If you can imagine 100,000 people show up and you have 20,000 capacity (at the Staples Center), there is not sufficient room. Now you have a crowd-control problem," he said. With the July Fourth holiday weekend "it's the worst time ... to work something out."

Another court hearing will proceed as planned Monday on who will take temporary control of Jackson's estate. He left all his assets to the Michael Jackson Family Trust.

A person familiar with the details of the trust said it would be shared between his mother, who gets 40 percent, his three children, who together get 40 percent, and charities for children, which would receive 20 percent. The charities will be determined later by the trust.

The person was not authorized to speak publicly and requested anonymity.

Authorities also were investigating allegations that the 50-year-old Jackson had been consuming painkillers, sedatives and antidepressants.

California Attorney General Jerry Brown said his office was helping Los Angeles police investigate the possible involvement of prescription drugs in Jackson's death.

His Bureau of Narcotic Enforcement is searching a state database that tracks doctors who prescribe controlled substances, how much and to whom.

The federal Drug Enforcement Administration also has joined the investigation. The Los Angeles Police Department asked the DEA to help, a law enforcement official in Washington told the AP on condition of anonymity because of the investigation's sensitivity.

In an interview on NBC's "Today" show, Jackson's brother Jermaine said he would be "hurt" if toxicology reports showed his younger brother abused prescription drugs.

"In this business, the pressures and things that you go through, you never know what one turns to," he said.

What is it about her or what did she do that he would not want the kids to go back to their own natural mother if something happened to him? That she was left out of the will says something.

If she really cares about those kids, why does she have to THINK about whether or not to seek custody? She is such a gold-digging loser. Michael should have been a lot more selective. But oh well, what's done is done. May he rest in everlasting peace and may those kids be placed in a loving home (in other words, not with Debbie Rowe!)

Although Rowe gave birth to these kids she will have a hard time getting custody for the following reasons:

1 - She gave them up as part of the divorce.
2 - She tried to get custody after the divorce and signed a new agreement in exchange for money to go away for good. What a mom , you want money instead of a relationship with your kids.
3 - She was purposely left out of Jackson's will.
4 - She was basically a surrogate. If she had not been married to Mike at all she would not have a leg to stand on.

I am sure the judge will hear what she has to say because she gave birth to the kids and was once married to MJ, but the fact that she basically abandoned them twice and she has NO relatationship with them does not bode well for her.

Also - Blanket is not her child and the courts will likely not split up the kids to give Rowe her own way.

I think the most Rowe can hope for is some form of visitation. Also if she has not had any relationship with the kids they will not want to spend time with her. The judge will take what the kids want into account.

Before MJ died she did not give a DAMN about these kids, now that he is gone she really only wants the jacksons to give her more money to have her stay away.

The point is, he's their father regardless of whether he's contributed with genetic material or not - he's named in their birth certificate as the father. Debbie Rowe will get a hearing because
1. she contributed with genetic material
2. she gave birth to them
3. She was married to their father when they were born

Even if condition #1 didn't apply, she would still get a hearing because of #3. However - and this is a BIG however - genetics alone is not enough to determine custody; the courts will look at every circumstance, the facts are:

1.she stated that they were a "gift" for MJ conceived through AI;
2. she was paid millions, and readily accepted them, to walk away - not once, but twice;
3. she publicly said she didn't want anything to do with them;
4. she didn't -over a period of 12 years - seek to bond with these children;
5. the courts wouldn't split the two eldest children from their young sibling (and she doesn't have any legal claim to the latter) ...

So, she has an extremely weak case. But she might be hoping that ,by making some waves, she'll be third time lucky and someone will pay her again to go away; I don't think that will happen and she'll drop the whole thing once she realizes how much it'll cost in legal fees. Finally, the courts might grant her visitation rights, but I'm pretty sure she'll pass on that, as she won't have control of the children's fund.

She will go back to her horses faster than you can say "beat it" and, hopefully be out of these children's life for a while; of course, they'll be the sequel, "Mommy Dearest ", when the children take control of their money and she pulls a long lost doting mother on them - but that will be another soap opera.

She will eventually have custody of the kids. With some good lawyering and a friendly judge, it's a cinch. As well she should. She is after all, the mother of the children.

There are plenty of Aunts and Uncles and cousins for MJ's children. Any one of the siblings could be possible to raise MJ children. For some reason the media seems to want to make a big deal out of Michael's Mother taking these little white children in. Hey Michael was black raising 3 white children. What's the difference?
