Congressional Republicans were dealt a setback Thursday in their attempt to punish Democrats in swing districts for voting for climate change legislation in the House last week.

WDBJ-TV, a Roanoke television station, will not air a National Republican Congressional Committee (NRCC) ad attacking freshman Rep. Tom Perriello (D-Va.), citing factual inaccuracies, according to Democratic Congressional Campaign Committee communications director Jen Crider. A source familiar with the station's decision confirmed Crider's account; WDBJ general manager Jeff Marks confirmed that the ad would not run, but declined to say why.

"The ad is not running, be we have not characterized why that is," said Marks. "We don't characterize why an ad is not running. We looked into the complaints [from national Democrats], but other than saying that, you really need to find out from the NRCC."

An NRCC source said that Democrats are mischaracterizing the station's decision. "One station has temporarily pulled the ad. The station manager has also informed us that he plans to notify the DCCC about their mischaracterization of what exactly has transpired. The ad is still set to run on the other stations in the local market," said the source.

Marks said the station has made no public statement saying that it rejected the ad for factual reasons. He confirmed that he notified Democrats that he had made no public statements about the ad. He did not reject the assertion that the ad was pulled because it was inaccurate, declining to comment instead.

Earlier, the nonpartisan organization FactCheck.org called the ad "wrong."

Adjudicated FactCheck:

The ad says the bill will result in lost jobs and cost "middle class families" $1,870 a year. That sounds pretty dire, until you consider that this week we posted an item about the Office of the Republican Whip Eric Cantor's claim that the same bill would "impose a national energy tax of up to $3,100." So is the cost of the legislation going down? Did the NRCC make a mistake in its math?

Hardly. While it may seem curious that House Republicans would flog two different cost figures for the proposed legislation, it is indicative of the difficulty in determining how a cap on carbon emissions could affect Americans' electricity bills. The NRCC ad credits a Washington Times editorial for its claim that the Waxman-Markey bill would make electricity prices "skyrocket," costing families $1,870 a year. But the NRCC is wrong.

We have been all over restoring good laws from the 1930’s with regard to the financial crisis; it is time for us now to look at some of media law as well. For example:

Section 325(a) of the Communication Act of 1934 states “No person within the jurisdiction of the United States shall knowingly utter or transmit, or cause to be uttered or transmitted any false or fraudulent signal of distress”

During the Bush administration, opinion leaked over the line to create false hysteria, otherwise know as hoaxes, which are illegal in the United States This law already on the books, obviously applies to those that attempt to scare the public with purposeful or improperly researched media of all kinds aimed at the citizenry. The bolder or more frighteningly brazen the statements, the less they are beholden to opinion and more they are beholden to the public trust.

A good place to start, perhaps is Sean Hannity and other GOP work underway on Health Care where wild accusations that seem to walk the fine line on opinion, and obviously violate both in spirit and in letter Section 325(a) of the Communication Act of 1934.

The onus is on the media content creator to ensure that these types of actions are not using the media to broadcast Hoaxes, purposely or otherwise.

ntmessage: Since taking power, the Democrats have been just as shameless in their efforts to frighten the public and push through their agenda.

Remember the Stimulus bill, enacted in such haste that no member of Congress had the chance to read it? And now we learn that only a tiny fraction of the money has been paid out. Some emergency.

And what was the rush on the Waxman-Markey climate change legislation? Again, the Democrats insisted that a looming emergency justified foregoing good legislative practices.

Congress HAS time to read the legislation. They set the voting schedules. They are upset because things are going at a faster pace than usual and they do not have time to make all the deals to line their own pockets when they have to actually DO THEIR JOBS. This claim is too typical and has grown tiresome. The stimulus bill was on the internet the whole weekend of Valentine's Day and all anyone talked (griped) about was that Obama took his wife to Chicago for a romantic weekend. Why was Congress not spending the weekend (with their vast staff of lawyers) reading and interpreting the bill instead of griping in front of cameras that they have not read the bill?

Congress is at fault big-time for all they DO NOT DO.

Here's a real kicker for ya- the "Scientist" from the EPA who was supposedly silenced when he tried to publish a "study" saying global warming isn't real, is a righwing loony ECONOMIST. How about that? Hey, if you're a knuckle-dragging GOP'er it's all the same right- scientist/economist/phlebotomist?

I need to stop being stunned by the total craven disregard for truth and basic decency from these people who call themselves patriotic Americans. The repugs need to change their name to something like "Corporate and Business Interests party of Amerikkka."

If you really want to know what is being said by the GOP, turn on talk radio or Faux Noise for a few minutes. Yes, hard to take, but these numbers go up to 15 trillion on their shows. They throw numbers around and apparently no one calls them on their lies. It is very curious that they get away with lying 24/7 without consequences. They are fear-mongers. To listen to Faux and their hate, you would think we are all going to out in the streets with the "commies" by August with no jobs, no food, no doctors, much less healthcare.

Actually, I believe climate change in the correct term now b/c warming isn't necessarily the ultimate result in all places. Drastic changes in rainfall and swings in temperature in various locations could result from this process.
