Jobs health is definitely something that should have been disclosed. What escapes is their rationale in not doing so. It would have come out anyways, like it did. Warren Buffet, one of the most successful ethical business person said he should have.

First of all people have conditions that change hourly when it come to medical problems. I have seen a sore throat become throat cancer. I have seen an upper back ache become a heart attack.
Now the SEC may concerned over Mr. Jobs medical condition but there are more important tasks at hand. The SEC should be investigating all the insider trading that took place just before the great down turn of 2008. Or how about going after the ones that caused the melt down. Not a single person has been charged. Madoff volunteered and turned himself in . He does not count.
The SEC yo yos that are star struck need to leave their national Enquirer at home and get off their behinds and do the job.
I wonder what real important issue is not being addressed because those people are throwing out this smoke screen?

It will be interesting to see which regulatory agency holds sway here. Trying to force Jobs to disclose private health information violates HIPAA laws. I wonder if the DOJ can fine the SEC for violating HIPAA? This could be very interesting and actually have ramifications for all the rest of us. If the SEC can force disclosure or gain access to the personal medical records of a private citizen, that sets a horrible precedent for all of us.

Uh Oh, a healthy American company not based on fraud! Quick, tear it down! Maybe they can skip the middle man and make Apple pay a fine directly to Goldman Sachs. I swear, we are more like a 3rd world country every day.

Let's see, they could investigate the rating agencies, such as Moody's, which were partly to blame for the latest financial fiasco that rivals the great depression (they had conflicts of interest up the wazoo!). They could have investigated Madoff years ago when many financial experts sent them information regarding a possible Ponzi scheme and they could have done the same with Stanford. What the F#@@ SEC, are medical records the only thing you are "competent" at evaluating and not financials? Maybe you all should be looking into getting jobs in the health insurance agencies.

Someone explain to me why the man's health has anything to do with the value of the company that produces an actual product not just vapor like hedge funds and derivatives.

When are we going to have some oversight over the TARP funds?

I agree. Why is his personal health information not protected like every other American's? He should be free to disclose or not disclose whatever he is comfortable with. Good grief! He is not an elected official holding an important national security position. He is a private citizen who heads a company with plenty of spare talent to run it should anything happen to him. This is ridiculous.

Side note about the mysterious collapse of WTC Bldg #7; it housed SEC files relating to numerous Wall Street investigations, as well as other federal investigative files. All the files for approximately 3,000 to 4,000 SEC cases were destroyed. Some were backed up in other places, others were not, especially those classified as confidential. Files relating Citigroup to the WorldCom scandal were lost.

But for bank and investment fraud? SEC was sleeping, could care less. But for Apple's Job's health? They pile on because: it's easy and visible. Just like the FBI shaking down kids, but missing 911 threats, and the IRS going after the unemployed but looking the other way regarding off shore tax fraud.

This is so obvious. I hope Apple tells the SEC to shove it.

Good points on here about the pick-and-choose behavior of the SEC.

Also, I'm interested how the business community shakes its finger at company heads who hide their health. Don't they realize by now that these leaders are practically feudal lords? If the people around Kim Jong Il or Fidel Castro or Woodrow Wilson feel the need to cover up their health issues, why can't the handlers of Steve Jobs, Lord of the Apple Subnation, use the same tactic? Our businesses are too big to fail and our business leaders are too powerful to be sick.

So they missed the phony power shortage in CA, and they missed the Bernie Madoff scam even when tipped off by Harry Markopoulos. But the health of some computer geek goes from bad to worse in more than a week and they're right on top of it. The SEC is the epitome of ineptitude!
