A South Side man caught carrying a weapon outside the Chicago home of President Barack Obama last fall was sentenced to five years in prison Friday.

This was just stupid on his part. I wonder would he have tried to approach Bush or any of the other presidents like that.

There was no threat, he wasn't carrying the weapon. The 5 yrs is excessive.

Aggravated unlawful use of a weapon by a person who has been previously convicted of a felony in this State or another jurisdiction is a Class 2 felony for which the person shall be sentenced to a term of imprisonment of not less than 3 years and not more than 7 years.
This was the issue here. He actually got a lessor sentence.
how was he "using" the weapon. the weapon was found in his car.

This man was detained and his vehicle searched because he approached a secure area and now is going to prison for it. He didn't threaten anyone, he didn't brandish a weapon he simply made two attempts to speak to Obama at his home.
I can understand the police and secret service restricting the number of people permitted on Obama's street but I believe they over stepped their bounds in searching the vehicle and that search is what lead to the arrest and conviction and that should be overturned.
He was a felon with a gun, which is illegal, in the city of Chicago, where guns are essentially illegal, who approached police tasked with protecting the President. He was absolutely not in the right here.
I live right around the corner and those cops do not fool around.
the police didn't know about the weapon until the search of the vehicle. A citizen wanting to speak to their elected representative is hardly suspicious.
Guns are illegal in Chicago because the city chooses to believe that their city ordinance trumps the US Constitution. Heller v DC proves otherwise.

The report states that he repeatedly approached the officers, which apparently made them sufficiently suspicious to search his vehicle. I have no problem with that.

the Bill of Rights still applies even to a citizen that has been convicted of a felony. They may lose their right to bear arms and right to vote but they retain the right of speech and to petition the govt for a redress of grievances. Obama was in no danger and the police had stopped the man a considerable distance from the Obama house. There is no evidence in the article that he attempted to circumnavigate the security or charge through it but rather stopped both times and spoke to the officer on duty. They overstepped their bounds by searching the vehicle.
