WASHINGTON — Obama administration officials said Friday they had no grounds to investigate the 2001 deaths of Taliban prisoners of war who human rights groups allege were killed by U.S.-backed forces.

The mass deaths were brought up anew Friday in a report by The New York Times on its Web site. It quoted government and human rights officials accusing the Bush administration of failing to investigate the executions of hundreds, and perhaps thousands, of prisoners.

U.S. officials said Friday they did not have legal grounds to investigate the deaths because only foreigners were involved and the alleged killings occurred in a foreign country.

The Times cited U.S. military and CIA ties to Afghan Gen. Abdul Rashid Dostum, whom human rights groups accuse of ordering the killings. The newspaper said the Defense Department and FBI never fully investigated the incident.

Asked about the report, Marine Corps Col. David Lapan, a Pentagon spokesman, said that since U.S. military forces were not involved in the killings, there is nothing the Defense Department could investigate.

"There is no indication that U.S. military forces were there, or involved, or had any knowledge of this," Lapan said. "So there was not a full investigation conducted because there was no evidence that there was anything from a DoD (Department of Defense) perspective to investigate."

A Justice Department official said the FBI had no jurisdiction to investigate. The official was not authorized to discuss the matter publicly and spoke on condition of anonymity. Separately, Justice Department spokesman Matthew Miller declined to comment.

A spokesman for former President George W. Bush did not have an immediate comment Friday night.

Reacting to the Times' report, human rights group Physicians for Human Rights called for the Justice Department to begin a criminal investigation into whether the Bush administration blocked inquiries into the Taliban deaths.

"For U.S. government officials to claim that there is no legal basis to investigate this well-documented mass atrocity is absurd," said the groups deputy director, Susannah Sirkin.

The allegations date back to November 2001, when as many as 2,000 Taliban prisoners died in transit after surrendering during one of the regime's last stands, according to a State Department report from 2002.

Witnesses have claimed that forces with the U.S.-allied Northern Alliance placed the prisoners in sealed cargo containers over the two-day voyage to Sheberghan Prison, suffocating them and then burying them en masse using bulldozers to move the bodies, according to the State Department report. Some Northern Alliance soldiers have said that some of their troops opened fire on the containers, killing those within.

Dostum, the Northern Alliance general who is accused of overseeing the atrocities, has previously denied the allegations.

A former U.S. ambassador for war crimes issues, Pierre Prosper, told the Times that the Bush administration was reluctant to investigate the deaths, even though Dostum was on the payroll of the CIA and his soldiers worked with U.S. special forces in 2001.

Dostum was suspended from his military post last year on suspicion of threatening a political rival, but Afghan President Hamid Karzai recently rehired him, the Times reported.

This well documented story is news to me, and I read quite a bit. How "well" documented was this? Did ABC, NBC, CBS do a piece on this in 2001 when it happened?

I recall the story from when it happened, including the descriptions of one of the truck drivers who had attempted in vain to rescue the men being asphyxiated in his sealed-up shipping container.

I do admit, the story disappeared off the face of the earth afterward.

It was widely reported on page 97 of section 4 of most national newspapers.

Same place it was reported that Saddam had no WMD's and had nothing to do with the events of 9/11/01. The corporate media does generally promote those kinds of stories as headline news since they are not part of the agenda.

Yes, it was widely reported, same as it was widely reported that the "Northern Alliance" are a bunch of US sponsored terrorists. (aka "warlords"). It just wasn't reported on page one or in the first section of most newspapers or as "breaking" or "headline" news.

It's too depressing to read the entire article. The methods used it Gitmo were refined in Afghanistan then taken there. This is a shameful part of our history which has taught us we can't claim innocence. For anyone who wanted to find out the truth it has been available for free on the internet (like this article) or for sale in bookstores. The failure of our leaders to take action makes them accomplices, our failure to pressure our representatives makes us accomplices.
This can not be swept under the rug, who would have thought we'd come to this?

But, I'm also sure the Obama decision is consistent with all his other statements on investigations of any kind of anyone, anywhere, at any time.

I don't get why Obama is supposed to announce that he's doing an investigation anyway. It's not within his power. He could get in trouble for doing that. This needs to be done internationally anyway in my opinion.

When CIA-backed Afghan warlord Abdul Rashid Dostum had up to ’several thousand’ Taliban prisoners sealed and suffocated to death in metal shipping containers just days after the United States invaded the country, it did not go unnoticed by the White House.

They simply chose not to do anything about it and quietly worked to discourage efforts to uncover the truth, according to a late Friday report by The New York Times.

“ ‘At the White House, nobody said ‘no’ to an investigation, but nobody ever said ‘yes,’ either,’ said Pierre Prosper, the former war crimes ambassador for the United States,” reported the Times. “ ‘The first reaction of everybody there was ‘Oh, this is a sensitive issue. This is a touchy issue politicall­y.’’ ”

“During Afghanistan’s tortured 30 years of war, Dostum served in the Soviet occupation forces and backed the pro-Moscow Najibullah government before switching sides,” noted Global Research. He joined with the US-backed Islamist militias that overthrew Najibullah, then was part of the fierce factional rivalry for power in Kabul before the Taliban finally took control.”

Dostum, a key ally of Afghan President Hamid Karzai, is expected to be reappointed as Karzai’s military chief of staff, the paper noted. Dostum ran for President of Afghanistan in 2004.

We are becoming as bad as any of our enemies. The Obama administration promised transparency and investigations and has not investigated anything. A democracy uncovers and punishes crimes even when and especially when committed at the highest levels. When we sweep such crimes under the rug, we let the next lawless administration claim a precedent for its actions. it will come soon.

The statement is correct. If no US personnel were involved the US has no ability on it's own to start a War Crimes investigation. The UN could investigate. Tha Afgan gov't could investigate. We can't. A horrible thing happened but we are not the world police.

And people are complaining about our ethics? We had no troops or forces in enough numbers to enforce the Taliban to play by our rules. And how could this surprise anyone?? The Taliban invaded Afghanistan brutality never seen in our day and age, these guys were bitter and wanted revenge, so there ya go.
