VANCOUVER, Wash. — Former Vancouver police officer Clyde Ray Spencer spent nearly 20 years in prison after he was convicted of sexually molesting his son and daughter. Now, the children say it never happened.

Matthew Spencer and Kathryn Tetz, who live in Sacramento, Calif., each took the stand Friday in Clark County Superior Court to clear their father's name, The Columbian newspaper reported.

Matthew, now 33, was 9 years old at the time. He told a judge he made the allegation after months of insistent questioning by now-retired Clark County sheriff's detective Sharon Krause just so she would leave him alone.

Tetz, 30, said she doesn't remember what she told Krause back in 1985, but she remembers Krause buying her ice cream. She said that when she finally read the police reports she was "absolutely sure" the abuse never happened.

"I would have remembered something that graphic, that violent," Tetz said.

Spencer's sentence was commuted by then-Gov. Gary Locke in 2004 after questions arose about his conviction. Among other problems, prosecutors withheld medical exams that showed no evidence of abuse, even though Krause claimed the abuse was repeated and violent.

Despite the commutation, Spencer remains a convicted sex offender. He is hoping to have the convictions overturned.

Krause declined an interview request from The Columbian in 2005 and could not be reached Friday, the newspaper reported.

Both children said that while growing up in California they were told by their mother, who divorced Spencer before he was charged, that they were blocking out the memory of the abuse.

They said they realized as adults the abuse never happened, and they came forward because it was the right thing to do.

Prosecutors aren't yet conceding that Spencer was wrongly convicted. Senior deputy prosecutor Kim Farr grilled the children about why they are so certain they weren't abused, and chief criminal deputy prosecutor Dennis Hunter said that if the convictions are tossed, his office might appeal to the state Supreme Court.

Matthew Spencer said his father had ruined the relationship with his mother and he had faults, "but none of them were molesting children."

Friday's hearing paved the way for the state Court of Appeals to allow Spencer to withdraw the no-contest pleas he entered in 1985 and have his convictions vacated. Both children had previously filed statements with the appeals court, but the judges required the hearing to ensure their new testimony held up under cross-examination.

Spencer, 61, hugged his son and daughter afterward while a dozen supporters cheered.

"For so many years, nothing went right," he said. "When things keep going right, I keep waiting for the other shoe to drop."

The hardest thing about his ordeal was missing his children, he said.

"They were my life, and they were taken away from me," he said. "I could serve in prison. ..."

His voice trailed off, and his son came up for one more hug.

So these adults, at age 30 and 33, FINALLY decided that the accusations were false? They should be ashamed at letting this farce so on for so long. What about, oh- ages 20 and 23? 21 and 24? 26 and 29? Appalling that they would wait so long while their father rotted away in prison for a crime he didn't commit. Just appalling.

I was on a jury that sent a man to prison for 87 years. It was only after the verdict that we were informed that the accused child had a history of falsely accusing people of sexual molestation. Nothing we could do. The guy's rotting in jail and I'm guilt-ridden for not having enough backbone to go with my doubts. I blame the vindictive mother, the dysfunctional family, the Texas system of hang 'em high with their he must be guilty because why would the D.A. bring this case to trial.

You and the other jurors have a moral obligation to start a campaign to free this poor man. What injustice! For the judicial system to keep holding the guy makes a mockery of itself. We all most certainly will answer to God one day and He certainly will judge us!

Once a jury makes a decision, it's near impossible to overturn it by a "campaign", especially where other jurors are convinced the decision was the correct one. I should have held out for a hung jury. Also, the defendant had such a god-awful attorney. You want justice, make sure you have enough money to have a good attorney. As far as something should be done about it, reversing a jury decision based upon not having all the facts presented to the jurors won't cut it. The fact that the accusing child and her mother had a history of accusing people of molestation was determined by the judge to be inadmissible to the case. Can you believe that? Past history of the defendant or the alleged victim is inadmissible.

Something left out of this story was why Clyde Ray Spencer plead no contest. His court-appointed defense attorney had not bothered to prepared a defense.

It happens all the time . Prosecutors will try to win at any cost . It doesn't matter to them if the guy never did it. Defense attornyes will defend a killer, rapist , or what ever even if they know that the person they are defending is guilty as hell. It has become who can make a name for him self first justice system, and how much you can pay justice system.

I agree, like the prosecutor and the mother should rot in jail for awhile!! Let them pay for their zealous attempt at justice through a rouse and a bunch of lies. Coercion of children, in my mind, is a crime that is equally as bad as ABUSE!!! This Krause women needs to be thrown in jail and left to rot for a few years!!

You can talk about prosecutors hiding evidence, disgusting C-word ex-wife etc. The most important part in these types of cases is having COMPETENT interviewers for child witnesses. If you ask ANY kid "did he touch your hoo hoo" enough times, eventually you will get the answer you want. While no water-boarding was involved, the resulting worthless information is EXACTLY THE SAME QUALITY. Any cop who interviews a child in this manner should be thrown in prison for life, because if the kid really was abused, now there is no way to prove it from their testimony alone. It really ought to be a hanging offence. Not to mention all the wasted man hours, court time etc. And that is assuming the wrongly accused walks out the door free afterwards. There is almost no way to calculate the cost in a case like this where the wrongly accused goes to prison for two bleeding decades! If the mother isn't charged with some form of child neglect for what she did in encouraging them to think they were abused, when she CLEARLY knew otherwise, then something is seriously wrong with the system.

This happens more than you can imagine. When a wife is going through an ugly divorce, often she will coerce the children into this mess. I believe Nancy Grace said MJ was pressured into "settlement" with Jordie Chandler's father. There has got to be some way this man can have the same public announcement of his innocence and the ex-wife should be given the jail term.

There are other cases like this one. A estranged spouse yells molestation and an AG wants to make a name for him/herself. They abuse their possition, hide evidence, "lose" evidence. Like CIA tapes being destroyed. It happens all the time. Those lusting for power are often willing to bury innocent people.

MSNBC has a show, narrated by Sean Penn on a very simular incident. The Duke LaCross team incident also comes to mind. Even the O.J. Simpson case was compromised because instead of using the evidence they tried planting evidence.

All of cases like this compromise real molastation and rape cases. Turn public oppinion more to distrust of all sides. Makes a jury doubt everything, including evidence.

All so an AG can make a name.

Of course child sexual abuse is real and is abhorrent. But a culture grew up in the 1980s that said that all allegations of such conduct were automatically true because 'children don't lie'. I can still remember gagging when I heard that piece of arrant nonsense. I remember being a child and lying my bloody head off. And even if the children denied anything had happened, investigators could easily convince themselves of the suspect's guilt based on the hip hogwash of 'repressed memories'.

There are people still rotting in prison on such bogus charges.

Frankly, and as a 'leeebrul' I hate to say it, but all this was largely driven by extremist radical feminists and their anti-male jihad. The lunar end of the 'progressive' movement (and I include such people in that category with great reluctance) discredited the whole show with this sort of BS, and left us open to the conservative resurgence that gave us the Bush catastrophe.
