VANCOUVER, Wash. — Former Vancouver police officer Clyde Ray Spencer spent nearly 20 years in prison after he was convicted of sexually molesting his son and daughter. Now, the children say it never happened.

Matthew Spencer and Kathryn Tetz, who live in Sacramento, Calif., each took the stand Friday in Clark County Superior Court to clear their father's name, The Columbian newspaper reported.

Matthew, now 33, was 9 years old at the time. He told a judge he made the allegation after months of insistent questioning by now-retired Clark County sheriff's detective Sharon Krause just so she would leave him alone.

Tetz, 30, said she doesn't remember what she told Krause back in 1985, but she remembers Krause buying her ice cream. She said that when she finally read the police reports she was "absolutely sure" the abuse never happened.

"I would have remembered something that graphic, that violent," Tetz said.

Spencer's sentence was commuted by then-Gov. Gary Locke in 2004 after questions arose about his conviction. Among other problems, prosecutors withheld medical exams that showed no evidence of abuse, even though Krause claimed the abuse was repeated and violent.

Despite the commutation, Spencer remains a convicted sex offender. He is hoping to have the convictions overturned.

Krause declined an interview request from The Columbian in 2005 and could not be reached Friday, the newspaper reported.

Both children said that while growing up in California they were told by their mother, who divorced Spencer before he was charged, that they were blocking out the memory of the abuse.

They said they realized as adults the abuse never happened, and they came forward because it was the right thing to do.

Prosecutors aren't yet conceding that Spencer was wrongly convicted. Senior deputy prosecutor Kim Farr grilled the children about why they are so certain they weren't abused, and chief criminal deputy prosecutor Dennis Hunter said that if the convictions are tossed, his office might appeal to the state Supreme Court.

Matthew Spencer said his father had ruined the relationship with his mother and he had faults, "but none of them were molesting children."

Friday's hearing paved the way for the state Court of Appeals to allow Spencer to withdraw the no-contest pleas he entered in 1985 and have his convictions vacated. Both children had previously filed statements with the appeals court, but the judges required the hearing to ensure their new testimony held up under cross-examination.

Spencer, 61, hugged his son and daughter afterward while a dozen supporters cheered.

"For so many years, nothing went right," he said. "When things keep going right, I keep waiting for the other shoe to drop."

The hardest thing about his ordeal was missing his children, he said.

"They were my life, and they were taken away from me," he said. "I could serve in prison. ..."

His voice trailed off, and his son came up for one more hug.

Someone needs to do an article about a plague in our current justice system: abusive prosecutors. This case is definitely an example of that and, sadly, it isn't the only instance. The prosecutors here aren't interested in the truth, but in just winning. In that way, they are a threat to every free, innocent American out there.

As a particularly bad example, a reporter can start with the Orange County (CA) prosecutor Tony Rauckauckas' office and work his/her away around from there.

Peter King, next time do your homework and completely inform yourself. Read what the otherside already knows. If not, it just makes you look disingenuous. Like myself you want to see true criminal prosecuted and not jailed due to hysteria. I find these cases like the McMartin case make those of us who truly suffered much harder to prosecute our perpetrators due to these hyster!a cases.
Enough psycho bable--supressed memory--etc....if it happened there is no way you can ever forget how horrific was....prosecute the criminals based on facts--stop the hysteria....speaking from experience here. Never met a true survivor who ever can not forget the horror.

There is more to the McMartin case than meets the eye. The controversial description of tunnels under the school were in fact verified by a later archeological study, and exactly fit the descriptions given by the children:

"Despite such pervasive scapegoating and predictable attrition, a few parents remained alert to some hope of vindicating their children. The opportunity came in April, 1990 with permission from the new owner of the preschool to search for the tunnels before he demolished the building and redeveloped the property These soiled but solid citizens managed to find what the district attorney had disclaimed: solid, scientific evidence that someone had not only dug tunnels under the preschool, but also had taken the trouble to try to undo them. The results of this definitive excavation are described in meticulous detail in the 185 page Report of the Archaeological Excavation of the McMartin Preschool Site by E. Gary Stickel, Ph.D., the UCLA archaeologist commissioned to do the study."

Stickel never mentioned in his report that the parents hired him. His paper was reviewed and denounced by many that were not biased. Here are two rebuttals.

This sounds like B.S. So they find tunnels. Did they find the rhinoceros that the kids said the McMartin's brought to school to have sex with? What happened to the McMartin family is a truly sad case of a sick prosecutor and crazy psycho-science.

I think a lot of true victims of childhood sexual abuse just live with it, and try to grow up not destroyed as a result, but no one ever believed them at the time.

The more these fake cases come to light the harder it becomes for people who were truly molested as children to seek justice. As a survivor myself I have always been appauled for the quick to prosecute.
I( never bought the repressed memory garbage and never bought the guilty by hysteria. For those of us who were truly molested these bogus cases make our lives much more difficult. Punish those truly guilty and stop guilt by hysteria.

I strongly suggest watching Sean Penn's documentary on the subject, WITCH HUNT, which I saw recently on MSNBC. I remember watching the news stories at the time in complete disbelief. I think they are what started the whole "California weirdos" thing. The courts made the children the victims, the accusers and, ultimately, the villains in the stories. And as I recall, Janet Reno was right in there in the Florida cases. What the prosecutors did to these kids was child abuse, plain and simple, and they should be going to jail for at least as long as the falsely accused parents did. That wouldn't even be a blip on the radar of what these people went through. Their lives were over, whether they were found guilty or not. One of the biggest travesties of justice in American history.

it took these adults almost 20 years to come forward???? the mother should be jailed for 20 years. the cop should be stripped of her badge. Oh, yeah, I hope this man sue the ever loving s**t out of California. Poor guy.

Nearly every man I've seen come out of this kind of unjust prosecution has come out smiling and largely serene about the situation. I commend them. I would be a little peeved. I remember being 9 and no one could make me believe something that didn't happen, especially if my father's life was on the line. It surely shouldn't have taken the kids 20-24 yrs to discover they were wrong. This was about manipulative vindictiveness by the mother and a sympathetic detective taken too far.

Spot on!

I've read a lot of different theories being posted, i.e. rogue detective, overzealous prosecutor but the X factor in all of this is the mother. Hello??? They were going through a divorce. False claims of sexual abuse, beginning in the 70's and peaking in the 80's, were commonplace. Experts believe this phenomenon was the result of changes to custody laws that promoted the "best interest" of children as opposed to the "tender years doctrine". Under the latter, mothers were disproportionately awarded sole full custody of the children. However, under "best interest" more fathers began seeking joint custody following divorce. To unduly influence the courts in their favor, a large percentage of women began to manipulate and coach their children into bringing false accusations of sexual abuse against their fathers.

The late Richard Gardner, a clinical psychologist in NYC, defined this phenomenon as "Parental Alienation Syndrome". Unfortunately, this condition has been adopted by bible of psychological disorders or DSM-IV.

I know all of this because my ex accused me of abusing our daughter when we divorced in 2003. The damage to father and daughter is irreparable.

The zeal and hysteria to prosecute "possible" child molesters rather then looking at all the facts brings to mind the justification that both presidents Bush and Obama are making that even those cleared in terrorism cases may still need to stay imprisoned "just in case," even though there is little to no hard evidence to convict them. Anything that provokes fear among the populous makes the public act irrationally and, in some cases, inhumanely, which puts pressure on leaders to "get a conviction" or at least to label even cleared suspects with a "criminal" tag for the rest of their lives.

That is what happened to MJ in the Santa Monica trial. You had a lot of "Experts" trying to infuse possibilities in the childrens minds that were being questioned as possible victims in the case against MJ., about 30 children were questioned even being told lies by investigators as to how much expertise they had in relating to them. Talk about tainting the witnesses. Even that did not work. Not one child could honestly say that anything unusual had taken place. From what I understand even the guy who was paid out of court $22 million has now recanted that he was molested by MJ. Imagine if the death penalty was an option in cases like this like how some want. Think about how many innocent people would be killed as a result untrue statements, rogue cops with agendas, angry ex-wives, because it's assumed kids don't lie and what a woman says about or against a man seems to carry more weight, etc.

My mother also accused my father of sexually molesting my brother and me about 25 years ago. Only after extensive questioning of us kids by a court-appointed psychiatrist, complete with anatomically-correct dolls and "did Daddy ever touch you here?" questions was he exonerated and allowed visitation rights.

I am on the verge of tears reading this man's story.

I'm sure they were doing what they believed was in the best interest of the kids. It's not like they get extra AIG size bonuses or anything for maliciously prosecuting people.

this is the very nature of the kinds of ppl that become prosecutors, third rate lawyers who can't make it withour a goverment job. The country is full of them the system is corrupt. Honest D.A.'s probably do exist but I wouldn't take any bets about who they are. The worst thing about it is that most Judges are former Assistant D.A.'s who ajudacate nothing merely continue prosecuting. Why is anyone surprised about this...?

If they aren't sure his children are now telling the truth, they should look for other incidents. Molesters usually don't stop with just their kids. If their mother told them to do that, she's the one who should be arrested and put in jail for 20 yrs. Divorcing parents seem to never put their children first.

No the authorities don't dare look that closly at their work, there are to many screw ups and they'd start loseing and have to really do hard work to honestly convict real criminals.
