WASHINGTON — Contrary to White House wishes, Attorney General Eric Holder may push forward with a criminal investigation into the Bush administration's harsh interrogation practices used on suspected terrorists.

Holder is considering whether to appoint a prosecutor and will make a final decision within the next few weeks, a Justice Department official told The Associated Press. The official spoke on the condition of anonymity because he was not authorized to speak on a pending matter.

A move to appoint a criminal prosecutor is certain to stir partisan bickering that could create a distraction to President Barack Obama's efforts to push ambitious health care and energy reform.

Obama has repeatedly expressed reluctance to having a probe into alleged Bush-era abuses and resisted an effort by congressional Democrats to establish a "truth commission," saying the nation should be "looking forward and not backwards."

Justice Department spokesman Matt Miller said Holder planned to "follow the facts and the law."

"We have made no decisions on investigations or prosecutions, including whether to appoint a prosecutor to conduct further inquiry," he told the AP on Saturday. "As the attorney general has made clear, it would be unfair to prosecute any official who acted in good faith based on legal guidance from the Justice Department."

Newsweek magazine, which first reported the development, said Holder was aware of the political implications of having a probe and preferred not to create unnecessary trouble for the White House. Still, the attorney general was troubled by what he learned in reports about the treatment of prisoners at the CIA's "black sites."

The probe would focus in part on whether CIA personnel tortured terrorism suspects after Sept. 11, 2001. Holder has said those who acted within the government's legal guidance will not be prosecuted, but has left open the possibility of pursuing those who went beyond the guidance and broke the law.

Holder has discussed with his staff the possibility of a prosecutor, saying he needed someone with "gravitas and grit," the magazine reported. In the end, the attorney general asked for a list of 10 candidates, five from within the Justice Department and five from outside.

"I hope that whatever decision I make would not have a negative impact on the president's agenda," Holder told Newsweek. "But that can't be a part of my decision."

A view of political desensitation: The DOJ says, well, we will investigate only this narrow angle of the presentation of "abnormal" torture in conjunction with how and who authorized "normal torture", related to what we feel needs investigated. They have to investigate because of treaties against torture. The uproar regarding partisan investigations begins, and then subsides. And then, revelations spark blinding flashes of the obvious and they reveal more they already knew and dig deeper.

Because this is a highly charged issue they have to desensitize the general public before letting more golden nuggets of truth out.

The more truth that comes out, the less overseas vacation trips these perps will take. Other countries are reportedly not as shy about enforcing treaties related to torture. Then, eventually maybe some of the actors and directors in this mess can take an extended paid trip with meals they don't have to pay for, or choose.

I'm wishing to see more truth in action.

I don't trust internal investigations. The FBI or independant investigators should investigate the DoJ, the DoJ should investigate the CIA, and the CIA should be deleted.

The problem at the DoJ is the incompetent, criminal, bobbleheads hired as career prosecutors by the Bush adminstration.

Could they possibly be anymore partisan than they already are?

No, there is nothing at all that the Republicans have not done, or can possibly do in the future, in their attempts to derail our legislative agenda. They have already been to Oklahoma city and done that too. We will survive and move forward regardless.

Do you mean more partisan bickering than there is now? Don't let health care be an excuse not to prosecute war crimes. We are sick and tired of excuses. We can't do this because that needs to be done is doing nothing. Do it and do it right for once.

Sure, what about a civil war? 66 million voted for Obama and 58 million voted against Obama. Do you think more people are behind Obama now or are more people dissapointed with Obama. Where are the jobs? Where is the stimulas? Unemployment is now way above what Obama said he would fix. I don't remember anybody talking about a "two year" plan. Just more bull from the Obama administartion.

Why don't some of you google: Cloward-Piven strategy with Obama.

Be sure to demand that ALL criminal activity be investigated & prosecuted, not just low-level operatives. I for one will be very disgusted & angry if this turns out to be the Lyndie England scapegoating party round two. NO BUSH ADMINISTRATION OFFICIALS SHOULD BE OFF-BOUNDS!

Follow up on the great work begun in Spain by judge Baltasar Garzón: start by looking at the top of the food chain.

The breatless "Will he or won't he/" reporting of this story is kind of unfortunate, because it makes what should be a question of law into a story about Holder. That does the rule of law no favors.

I'm sure Holder would say that when it's made the decision will be solely about the facts, the evidence, and the law. If there's enough evidence that a crime was committed, of course we'll prosecute. If not, we won't. This is neither a personal nor a political decision, nor should it be.."

I'll believe it when I see it. A lot of phony rumblings in the past and no follow-through. Torture, coupled with the Afghan POW slayings and this country's unwillingness to demand accountability from the Bush administration are not going to help American foreign relations that's for sure.

Better put some hustle in it, Holder; the time is running on the statute of limitations.

There won't be war crimes prosecutions of Bush or Cheney or the rest of the gang. Not here and not by any other country. If you think so, you're deeeeeloooshunUL.

Conspiracy is the key to this. Criminal conspiracy. Without that, there's nothing. The SOL is five years.

Tick tock.

Obama Orders Review Of Alleged Deaths Of Taliban Prisoners In Afghanistan.
Obama is investigating 2000-2001 possible crimes.

Favorite    Flag as abusive Posted 10:09 PM on 07/12/2009

This was investigated and reported by NEWSWEEK back in about 2003! The facts re: these deaths are horrible and should have precipitated an investigation way back then, but Republicans and the MSM were blocking ANY acknowledgement of what was going on!

Dammit! Laws HAVE been broken, human rights ignored, war crimes committed IN OUR NAME! I'm tired of hearing Obama equivocate about holding anyone in the past administration ACCOUNTABLE for breaking just about every law our nation is founded upon! ENOUGH!!!

If Obama continues to shut down, discourage, and stonewall justified Congressional and Justice Dept. investigations, he will lose my respect and support in 2012! His refusal to allow proper investigations is simply POLITICAL, an effort to get Repub votes on his agenda! Forget it! --- His open hand has been met with a FIST at every turn!

It's long past time to for all our "leaders" to put politics aside and FACE THE UGLY TRUTH about the past eight years!

That is how the right moves against Americans. They marginalize and "radicalize" them: "Us against them" ideology where Americans are the enemy.

That is why they need to be prosecuted, convicted, and imprisoned without sympathy or remorse. It is good for the country to separate criminals from society... That is why we have prisons in the first place.

What if Obama is not opposed to an investigation into Bush/Cheney but just wants to spend his political capital elsewhere? If Holder is seen as pushing the investigation while Obama is seen as the pragmatist who is above partisanship this is a win-win situation. The Republicans cannot attack Obama for failing to interfere with his Attorney General, meanwhile all of the darkest secrets of the previous administration get exposed over time. Finally once all the gory details are made public Obama, knowing that the Conservative majority on the supreme court would overturn any conviction pardons Bush and Cheney and scores yet more political points. Obama is the most sophisticated political operator we have seen in our lifetimes and I would not put a play like this past him.

I think that holds pretty true to a point. I do not think a solid criminal conviction would reach the SCOTUS. Look at I. Lewis Libby.

Sure this is all speculation but I've noticed that Obama has this knack for turning situations around, think of the Reverend Wright situation which he was able to turn around, the appointment of Judd Gregg to Commerce which seemed crazy but somehow ended up playing out in a way which weaked the Republicans and strengthened his own party and the way in which his campaign was able to make first Hilary Clinton's campaign team and then John McCain's look like rookies even though both teams had some very smart operatives.
