NEW YORK (AP) - A man who told an undercover policeman to get off his family's front steps punched the officer and struggled over the officer's gun before being shot dead, police said Sunday.

Shem Walker hit the officer on the head and grabbed his gun Saturday night, police said. Other officers heard the undercover officer or a plainclothes colleague identify themselves, top police spokesman Paul Browne said.

But Walker's relatives said they were nearby and didn't hear any officers identify themselves, said Councilwoman Letitia James, who visited the family Sunday. The shooting raised questions about police conduct, she said.

The undercover officer was serving as backup for a Brooklyn drug investigation at a deli a few doors down from the home in Brooklyn's Clinton Hill neighborhood, Browne said. The racially and culturally diverse neighborhood is where the rapper The Notorious B.I.G. grew up.

The drug investigation didn't involve Walker, but he came out of the home and told the officer to leave, hitting him on the back of the head and saying, "If you don't move, I'll make you move," the police spokesman said.

When the officer stood up to confront him, Walker punched the officer in the face and the two tumbled to the ground, Browne said. Another plainclothes officer involved in the investigation tried to grab Walker, who shook him off, he said.

The first officer had drawn his gun, and Walker grabbed it, Browne said. The gun went off twice as the two scuffled, shooting Walker once in the chest, Browne said.

Other officers nearby said they had heard someone yell, "Police! Don't move," and a civilian witness heard a shout of "Freeze!" Browne said.

The 36-year-old officer, whose name wasn't released, needed two stitches for a cut to his head. He's been placed on administrative duty, as is standard while shootings are investigated, Browne said.

James, a Brooklyn Democrat, told reporters the discrepancy between the police account and the family's account "raises some serious questions in my mind."

Walker, 49, often asked people not to linger on the front steps, said James, whose district includes the neighborhood, home to actress Rosie Perez and rapper-actor Mos Def.

Walker's sister, Jean Nurse, said he was a "good person at heart" and the father of two daughters. She declined to comment further.

Another story now says the Officer had earphones and didn't hear the request. Someone said coverup time and slowly but surely that's exactly what's happening...

Unfortunately the story has turned out just as we suspected. I'm not black but even I can say this always only happens to black people. In the 30 years in this city I can recall no white man ever shot in-front of his own stoop. If anyone can find an article, please enlighten me. We all need to let Police Commissioner Kelly and Mayor Bloomberg (or Tony Avela when he get's into office) know that this is no longer acceptable and the Police must be kept in check the same way they keep the people in check. Cops are no different than you and me, why does everyone give them omnipresent power? They're that punk kid that bullied your kids on the block, or that ex-gangmember who needed someone new to harrass, or that kid from the Island who was raised so passive-ag­gressively that he is full of rage and can't wait to let it out. I'm sure there are a million more profiles but they're all there, just like the rest of the population, confused and scared.

People squatting on your stoop is an affront....I don't like it but I will stop short of thunking someone on the head for doing it. NYPD again used excessive force but if this guy struck first he was asking for trouble.

The problem with police in general is that there is no one to police them as long as the top brass lets them act like this these things will continue to happen.WE as a community really need to do something about this.This doesn't happen in better neighborhoods the cops treat these neighborhoods like war zones!!!!!­!!!!!!!!!!­!!

If a private citizen get assaulted, they are expected to defend themselves only to the extent that the assault is halted. They do not get a "green light" to kill their assailant just because they're being assaulted. Case after case where it is ruled that self-defense does not give you carte-blanche to become a murderer.

And yet this officer, simply because he has the legal right to carry a gun, feels he gets to operate by a different standard? If he were a private citizen whose only fault was minor trespassing and this guy punched him in the head, he has SEVERAL options he can take BESIDES or BEFORE drawing a gun. But instead, the knowledge that he has a gun causes him to go straight into gorilla mode, and now someone is dead whose only crime is telling someone with a gun to get off his property.

Do they teach these people, law at the police academy?Obviously they must forget it once they graduate.It's as if the law does not apply to them.I smell a big lawsuit on this one.sad though that someone is dead.

New York City has a special fund to payoff NYPD lawsuits it is in the budget. As a matter of common law, the state allows its citizens to sue it for damages. We have no special right to sue the government for damages.

The first report about this (at the New York Daily News website) read “HANDYMAN KILLED BY NYPD” . . . . . two hours later (at the same article) the headline read “EX-CON SHOT BY OFFICER”.

I had three out of four plain clothes Brooklyn cops (two of them mutant muscular skinheads covered in tattoos) screaming at me one night for what felt like minutes before the fourth and seemingly only level-headed one in the group reminded them that they were cops, cuing them all to pull their badges from under their shirts and identify themselves. For what felt like another five minutes they yelled about how they were going to take me in for the pot they smelled and knew I was smoking but couldnt find. After taking down my info a few times and giving me a few more arrest threats they got bored and the frightening mutant leader led the others away, mouths foaming at the prospect of finding more unsuspecting dopes smoking cigarettes on their stoops before the second Obama/Mccain debate.

I dont know why they bother putting other cops' stories in articles like this. We all know what theyre going to say.

Many cops have NO SELF-CONTROL. Their psychological screening is lousy.
Cops are also extremely defensive, insecure and dangerous LIARS.
Their training is lacking.
