UPDATE: The Army has revoked the deployment orders for a soldier who said he shouldn't have to go to Afghanistan because (he believes) Barack Obama was never eligible to be president.

Because he's a reserve soldier who volunteered for an active duty tour he can "ask for a revocation of orders up until the day he is scheduled to report for active duty," a public affairs officer explained. Cook volunteered for the tour in May of this year. It is not clear why he did so, considering his current objections.

Obama birth certificate deniers won a small victory in court on Monday. Meanwhile, one such conspiracy theorist refused to deploy to Afghanistan on the grounds that Barack Obama isn't a legitimate president.

A judge said he would listen to "the merits" of Alan Keyes' case challenging Obama's presidency. While a spokesman for the U.S. Attorney's Office said the move was merely procedural, birth conspiracy proponents are encouraged:

Supporters of a case that disputes the legitimacy of Barack Obama's presidency claimed a small victory today when U.S. District Judge David O. Carter told them to fix their paperwork and that he would listen to "the merits" of their case. But others present for the hearing Monday at the federal courthouse in Santa Ana stressed that the case remains a long way from ever getting a full airing in court and may never get to that point. Perhaps because of that history, Orly Taitz, the lawyer who filed the current suit, was greatly cheered by Monday's hearing. "He's very determined to hear the case on the merits," Taitz said, referring to the judge. "He stated, the country needs to know if Mr. Obama is legitimate, if he can legitimately stay in the White House."

Orly Taitz, the lawyer in Keyes' case, is also representing a soldier who refuses to acknowledge Obama as his president. U.S. Army Maj. Stefan Frederick Cook has argued that he shouldn't have to go to Afghanistan because the man sending him there isn't really president.

In the 20-page document -- filed July 8 with the U.S. District Court for the Middle District of Georgia -- the California-based Taitz asks the court to consider granting his client's request based upon Cook's belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.


Cook further states he "would be acting in violation of international law by engaging in military actions outside the United States under this President's command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties."

A hearing to discuss Cook's requests will take place in federal court this week.

This guy is no soldier. He is an anti-American Republican extremist who wants to make a political point by disgracing the United States of America and her duly elected President. Why would he volunteer to serve in May of this year if he knew he had this objection to our commander-in-chief? It's not like he had served under previous Presidents. His actions seem very deliberate and premeditated.

I think what is going on here is a carefully thought out conspiracy by right wing extremists to embarrass our President and undermine our country. The military must not stand for this. There needs to be an investigation and the people behind this conspiracy should be prosecuted to the full extent of the law.

Didn't Obama have to have the highest of security clearances before becoming president, so why would an agency that was still under George W. Bush have not discovered that he was not born in the U.S. during that investigation?

FYI, no agency in the Government is charged with verifying a Presidential candidate's birth or citizenship. That's why no one looked into Obama's birth in the first place. The NY Times went after McCain claiming he was not a natural born citizen, so McCain promptly produced his certified birth certificate to the Times along with the various laws in effect that show he is a natural born citizen, being born on a US Base in Panama. Why don't you think Obama did not do the same thing? Produce the certificate?

This still amazes me, people will never get over the fact, that yes a man of African decent is the president. He was born here, people not in Indonesha, here in the USA, where only his story is possible. What I can understand is why people would believe if he was not born here, why John McCain or none of the other Demorcatrs running for office never found this out. Give me a break, get use to saying this phrase "Say it Loud My President is Black and I am Proud".

John McCain, by the way, was born in what was then called the Panama Canal Zone, which has never been part of the USA or its territories. The GOP always seems to forget that.

while I get your point, to even hint that McCain is not a natural born citizen flies in the face of all of us who served overseas, and whose children were born during those assignments. To diminsh his citizenship under these circumstances is ludicrous.

That being said, Obama is a natiral born citizen -- case closed.

I far prefer to say "Barack Obama is our President and we should be thankful for that." He is superbly qualified to be our President. I personally am proud of the fact that I recognized that quality long before he ever announced his candidacy.

With the exception of African-Americans and people of native African descent who are justifiably proud of his accomplishments, his skin color is of no importance except to those toothless, drooling cretins that still lurk in the shadows on the fringes of society.

No amount of evidence will satisfy the birthers they'll always come up with some excuse not to believe that he is actually President. The only thing that might satisfy them was if God came down and said that he is a natural born citizen. But i doubt they'd even believe that.

Most members of the guard and reserve, whether active or inactive, are honorable men and women who have and only want to continue to serve their country.

THIS particular so-called citizen soldier represents the worst of what is wrong with the guard and reserve. He was more than happy to PLAY at soldiering, attend drill, meetings and trainings, and to collect their "drill pay" and other benefits.

That would be up to and including the moment they find out they're actually going to have to be soldiers, and go to war. He's now in DEEP trouble, because he's in danger of actually having to give in return. So he conveniently decides that President Obama isn't actually the president.

Sometimes all it takes is one sharp example to teach people a lesson, and by letting this cowardly POS "get out of it" we're letting a bunch of his fellow travelers learn exactly the WRONG lesson.

I vote we court martial him, kick him out, and give him 48 hours to pay back EVERY penny he's accepted over the years. With interest.

This coward should never have signed up for the Army. He will use any excuse to not have to go to war. You are a sorry excuse of a man, and I am pretty sure the rest of the armed services would be glad to see you go home. The real men that put their lives on the line EVERY single day, don't need some weak link when their lives might need protection. Gore did not win officially. After the supreme court decision (truely, this was absurd), the votes were counted in detail and months later the press posted the story that in reality Bush did have the most votes.
