Stefan Frederick Cook: Soldier Won't Deploy Over Obama Birth Certificate

UPDATE: The Army has revoked the deployment orders for a soldier who said he shouldn't have to go to Afghanistan because (he believes) Barack Obama was never eligible to be president.

Because he's a reserve soldier who volunteered for an active duty tour he can "ask for a revocation of orders up until the day he is scheduled to report for active duty," a public affairs officer explained. Cook volunteered for the tour in May of this year. It is not clear why he did so, considering his current objections.

Obama birth certificate deniers won a small victory in court on Monday. Meanwhile, one such conspiracy theorist refused to deploy to Afghanistan on the grounds that Barack Obama isn't a legitimate president.

A judge said he would listen to "the merits" of Alan Keyes' case challenging Obama's presidency. While a spokesman for the U.S. Attorney's Office said the move was merely procedural, birth conspiracy proponents are encouraged:

Supporters of a case that disputes the legitimacy of Barack Obama's presidency claimed a small victory today when U.S. District Judge David O. Carter told them to fix their paperwork and that he would listen to "the merits" of their case. But others present for the hearing Monday at the federal courthouse in Santa Ana stressed that the case remains a long way from ever getting a full airing in court and may never get to that point. Perhaps because of that history, Orly Taitz, the lawyer who filed the current suit, was greatly cheered by Monday's hearing. "He's very determined to hear the case on the merits," Taitz said, referring to the judge. "He stated, the country needs to know if Mr. Obama is legitimate, if he can legitimately stay in the White House."

Orly Taitz, the lawyer in Keyes' case, is also representing a soldier who refuses to acknowledge Obama as his president. U.S. Army Maj. Stefan Frederick Cook has argued that he shouldn't have to go to Afghanistan because the man sending him there isn't really president.

In the 20-page document -- filed July 8 with the U.S. District Court for the Middle District of Georgia -- the California-based Taitz asks the court to consider granting his client's request based upon Cook's belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.

Cook further states he "would be acting in violation of international law by engaging in military actions outside the United States under this President's command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties."

A hearing to discuss Cook's requests will take place in federal court this week.

I am truly amazed at all the chatter this article is causing. Is he legal? Is he not? With all that the country is facing after years of neglect and bad decision making? If a person volunteers for something then chooses not to follow through that is their choice even though the reason they are giving for not following through was in place when they made the decision to volunteer. Can someone explain to me how Governor Linda Lingle fits into the global conspiracy? As the Republican governor of Hawaii, she could have handed her party a triumphant victory in 2009 by refuting the existance of an original Birth Certificate being on file in state records. Instead, she confirmed its existance.

What's the reasoning for not accepting her stated position in this matter?

This is ridiculous on something this serious that they have to methodically wait for years for some party to meticulously carry the case forward. Mike, until we know what hospital he was born in, his doctor or any WITNESS who was around that day, no one will ever believe these after the fact, generation of documents. I know what hospital I was born in, it's right on the paper. I don't know what the difficulty is. It could be that he was born in Hawaii but there is something embarassing that we are unaware of. It will be speculated on forever until it's put to rest.

"Earlier today, Quon said Cook submitted a formal written request to Human Resources Command-St. Louis on May 8, 2009 volunteering to serve one year in Afghanistan with Special Operations Command, U.S. Army Central Command, beginning July 15, 2009. The soldier's orders were issued on June 9, Quon said.

So, he volunteers on May 8, when Obama was President and possibly knowing that as a volunteer he could back out. I smell a set up...

I'm surprised that Obama supporters aren't also demanding that Obama release his "original" Birth Certificate to shut his detractors up. I've looked at many of the websites that talk about this subject, and I'm sorry but it just isn't the same as Obama holding it in his hands for the world to see and doing a jig because he's permanently shutting up the conspiracy theories. This is a test of character. If the pres has honor and integrity, he will present his qualifications to the military. He is their commander & chief.
He was born to parents from different countries. Because his mother was under 21 at the time of his birth, his citizenship went to the country of his father at that time (okay that is a technicality).

He attended some expensive colleges, did he register as a foreign citizen? He was there as an adult and if he did, then he is disqualified by his own doing.

He will not present these documents, but asks our families to sacrifice members to serve in the armedforces. The people in the military are held to a standard higher than any in congress, higher than those that serve on police forces, higher than your average citizen. They expect their leader to show the same integrity and honor he expects from them. Is that too much to ask?
If he can show, he claimed US citizenship as an adult, this will all be over, it is not about the color of his skin, it is about the content of his character.
