ANCHORAGE, Alaska — Days before Gov. Sarah Palin is scheduled to leave office, the former vice presidential candidate is facing yet another legal distraction: An independent investigator found evidence she may have violated ethics laws by trading on her position as she sought money for lawyer fees.

A report obtained Tuesday by The Associated Press says Palin is securing unwarranted benefits and receiving improper gifts through the Alaska Fund Trust, set up by supporters.

An investigator for the state personnel board says in the July 14 report that there is probable cause to believe Palin used or attempted to use her official position for personal gain because she authorized the creation of the Alaska Fund Trust as the "official" legal defense fund.

The practical effect of the ruling on Palin will be more financial than anything else, although the fate of the tens of thousands of dollars in the fund is unclear, said Palin attorney Thomas Van Flein. The report recommends that the complaint be resolved without a formal hearing before the board. That allows her to resolve the issue without a formal ethics reprimand.

Palin posted an entry on Twitter in which she said the "matter is still pending," a statement echoed by Van Flein.

"Re inaccurate story floating re:ethics violation/Legal Defense Fund;matter is still pending;new info was just requested even;no final report," she wrote.

"The fund itself was not created by me nor is it controlled by me. Neither I nor my lawyer has received a penny from this fund," Palin elaborated in a statement.

"I find the notion that I have taken any action pertaining to the legal defense trust fund misguided and factually in error," she said. "I have not 'acted' relative to the defense fund, and it is misleading to say I have."

The fund aims to help Palin pay off debts stemming from multiple ethics complaints against her, most of which have been dismissed. Palin says she owes more than $500,000 in legal fees, and she cited the toll of the ethics probes as one of the reasons she is leaving office on Sunday.

Kristan Cole, the fund's trustee, said organizers have frozen the fund pending the personnel board's review. Many federal politicians, including Hillary Clinton, former U.S. Alaska Sen. Ted Stevens and others are routinely allowed to have such funds to pay off legal bills, but quirks in Alaska law can present ethics issues.

Van Flein said the potential loss of money from the fund had absolutely no bearing on Palin's decision to resign.

He said Palin received the report 11 days after her July 3 announcement that she was leaving office. He also noted that the investigator recommended the governor seek reimbursement from the state for the cost of fighting ethics complaints that have been dismissed.

"It's cheaper for the people of the state of Alaska to have the bills paid for through the trust fund," Van Flein said. "But if that can't be done, then it looks like the state of Alaska could pay."

The investigator, Thomas Daniel, suggested that Alaska lawmakers may need to create a law that reimburses public officials for legal expenses to defend complaints that end up being unfounded.

Palin's friends and supporters created the Alaska Fund Trust in April, limiting donations to $150 per person. Organizers declined to say how much it has raised, and had hoped to raise about $500,000. A Web-a-thon last month brought in about $130,000 in pledges.

In his report, Daniel said his interpretation of the ethics act is consistent with common sense.

An ordinary citizen facing legal charges is not likely to be able to generate donations to a legal defense fund, he wrote. "In contrast, Governor Palin is able to generate donations because of the fact that she is a public official and a public figure."

The ethics complaint was filed by Eagle River resident Kim Chatman shortly after the fund was created, alleging Palin was misusing her official position and accepting improper gifts.

"It's an absolute shame that she would continue to keep the Alaska Fund Trust Web site up and running," Chatman told the AP.

At least 19 ethics complaints have been filed against Palin, most of them after she was named the running mate for GOP presidential candidate John McCain. Most of those have been dismissed, although one was resolved when Palin agreed to reimburse the state more than $8,000 for the costs associated with nine trips taken with her children.

John Coale, a Washington lawyer who helped set up the fund, called the probable cause finding "crazy," adding that if upheld, it would mean that no governor could ever defend themselves against frivolous ethics complaints.

"Anybody can keep filing ethics complaints and drive someone out of office, even if you're a nut," Coale said.

Unlike other states, he said, Alaska has no legal counsel's office devoted to defending the governor from allegations brought against her in her official capacity.

This is the most important clause in the AFT document (or any trust document). It is the reason for the trust's existence and necessity. There is NOTHING in the official purpose of the AFT related to legal defense or legal proceedings or ethics complaints. In fact, the purpose of the trust is for any expense at all incurred by Sarah Palin "as a result of the fact that she is Governor . . . or as a result of the performance of her duties as Governor." Those are the only limitations instilled by the purpose clause.

The sole and exclusive purpose of this Trust is to provide a proper means for the acceptance of money, property, and services, including, if necessary, pro bono legal services, to provide for all reasonable, necessary, and appropriate fees or charges incurred by (i) SARAH PALIN as a result of the fact that she is Governor of the State of Alaska or as a result of the performance of her duties as Governor of the State of Alaska; and (ii) Covered Individuals.* [...] In addition, the purpose of the Trust shall be to pay all reasonable, necessary, and appropriate expenses of Trustee's counsel and such other and usual, customary expenses and services that have been or may be incurred in connection with the above-stated purpose . . . Trust funds may be used for no purpose other than those specifically provided herein. *For purposes hereof, a "Covered Individual" shall be any other person determined by the Trustee, in the Trustee's sole and absolute discretion, to (i) hold a "covered staff' position within SARAH PALIN's administration and/or an employee in the office of the Governor of the State of Alaska; and (ii) hold a covered relationship with SARAH PALIN, including without limitation, a family member, such as a parent, spouse, child, grandchild, sibling and other close family relationship.

I interviewed Ms.Cole, who confirmed that she and other supporters of the governor came up with the idea of soliciting contributions to pay the governors legal fees.Ms.Cole also stated that she and other supporters set up the Alaska Fund Trust.

LA Calif. C4P blogger Rebecca ManSour is up in Alaska now, and she posted @ C4P that “they all donated to the trust fund b/c of Sarah Palin (the person) not Sarah Palin the Governor”….this right after Kristan Cole's presser. Clearly, another red herring. Sarah Palin isn't a private citizen (yet) and state law prevents Palin from accessing funds collected in this manner.

Let's all just forget about Sarah Palin.

All this attention on her is no longer worth the time.

She was the embodiment of the worst of the Republican agenda in 2008, and has apparently been even worse at governing the state of Alaska since she was elected in 2006.

Let her slay salmon all day long for the rest of her life. She'll be happier, and so will the people of the United States.

Before I read one more comment about $arah being treated differently than others who have legal funds....

Palin is bound by the The Alaska Executive Branch Ethics Act.

While other groups/individuals in OTHER STATES may have similar funds, they are not bound by the AK Ethics Act.

Bill Clinton was not bound by the Alaska Ethics Act.

That's correct and the Alaska Fund Trust was wrong to compare Palin's legal fund to that of Senators John Kerry, Ted Stevens, and Hillary Clinton, Representatives Tom Delay and Richard Gephardt, and President Bill Clinton.

Only Palin's fund had to comply with Alaska's state laws and her lawyers missed the mark.

No one has yet to make a case why Sarah Palin's Wasillabilly clan is allowed to draw money from the fund.

Todd Palin's sister was arrested a few months ago for burglary. According to the trust agreement, she is eligible to receive money from the fund for her legal bills. That's not right. That's not ethical.

Palin twittered recently that she was packing up her personal stuff from the Governor's mansion over the past few days. Hmm, I thought she scammed Alaska out of per-diem because she was living at her home in Wasilla (which is 40 miles from her office in Anchorage) instead of living at the governor's mansion. Sarah Palin was very much involved with the formation of the Alaska Fund Trust. In April of this year a disagreement about who and how the fund should be managed and handled led to the dismissal of the SarahPAC fund managers. The legal fund started immediately afterward. Those expensive how power lawyers setup the legal fund for federal laws but failed to properly take into account Alaska's state laws.

How were these lawyers paid? That's a gift to Sarah. Did she report it?

The Alaska Trust Fund was perceived as a mockery on ethics because it was a front for raising money for Sarah and her family to cover their legal misdeeds. Why should Todd and Sarah Palin's parents, children and siblings be able to draw money from this fund? What do they have to do with Sarah's ethics as Governor?
