CAMBRIDGE, Mass. — The woman who dialed 911 to report a possible break-in at the home of black Harvard scholar Henry Louis Gates Jr. said Wednesday she was wrongly labeled a racist based on assumptions about her and words she never said and hoped the recently released recording of the call would put the controversy to rest.

With a trembling voice, Lucia Whalen, 40, said she was out walking to lunch in Gates' Cambridge neighborhood near Harvard University when an elderly woman without a cell phone stopped her because she was concerned there was a possible burglary in progress.

Whalen says she was vilified on blogs as a racist after a police report said she described the possible burglars as "two black males with backpacks." Her lawyer has said mainstream media outlets and bloggers had concluded she was a privileged white neighbor.

Tapes of the call released earlier this week revealed that Whalen, a first-generation Portuguese-American who doesn't live in the area, did not mention race. When pressed by a dispatcher on whether the men were white, black or Hispanic, she said one of them might have been Hispanic.

"Now that the tapes are out, I hope people can see that I tried to be careful and honest with my words," Whalen said. "It never occurred to me that the way I reported what I saw be analyzed by an entire nation."

Cambridge police Commissioner Robert Haas acknowledged that the police report contains a reference to race, but said the report is merely a summary of events. The arresting officer, Sgt. James Crowley, has said his information on the race of the suspects came during a brief encounter with Whalen outside Gates' house; she contradicted that Wednesday, saying she made no such description.

Gates' arrest for disorderly conduct in his own home by a white police officer sparked a national debate over racial profiling and police conduct. The controversy intensified when President Barack Obama said police "acted stupidly" when they arrested his friend.

Gates, whose disorderly conduct charge was dropped, has said he was outraged and has demanded an apology from Crowley; Crowley said he followed protocol and responded to Gates' "tumultuous behavior" appropriately.

Whalen, a Harvard alumni magazine employee, said she lived in fear during the immediate aftermath of the arrest when she was dogged for comment and maligned based on the information attributed to her in the police report.

"The criticism at first was so painful I was frankly afraid to say anything. People called me racist. Some even said threatening things that made me fear for my safety," said Whalen, whose husband, Paul, put his hand on her shoulder in comfort her as she spoke. "I knew the truth, but I didn't speak up right away because I did not want to add to the controversy."

She said she felt more comfortable speaking publicly after the tapes were released. She refused to answer questions about the police report or what she saw that day.

"I am proud to have been raised by two loving parents who instilled in me values including love one another, be kind to strangers and do not judge people based on race, ethnicity or any other feature than their character," she said.

Obama, the nation's first black president, has said he chose his words badly when he reacted to his friend's arrest, and he has invited Crowley and Gates to meet with him at the White House for a beer on Thursday evening.

Whalen's attorney, Wendy Murphy, said Gates, Crowley and Obama overreacted, while Whalen kept her cool.

"The three highly trained guys who reacted badly are getting together for a beer," Murphy said. "The one person whose actions have been exemplary will be at work tomorrow in Cambridge. I don't know – maybe it's a guy thing. She doesn't like beer anyway."

Murphy had said Monday her client is "by no means the entitled white neighbor," which was "the theme in the blogs and the implication in some of the mainstream news media."

Whalen said she has worked in Cambridge for 15 years and hopes that the community's reputation would be restored. She also said she respected Gates and the Cambridge police department and hoped her decision to finally speak out would not add to the controversy.

"I was called racist and I was a target of scorn and ridicule because of the things I never said," she said. "The criticism hurt me as a person, but it also hurt the community of Cambridge."

Despite the trouble it caused her, Whalen said she would make the call again.

"I've had much reflection on that, and, yes, I would make the call," she said. "If you're a concerned citizen, you should do the right thing."

when groups of people complain and offer evidence of abuses for years and years and the perpetrators of said abuse continuously and through various channels deny the existence of the abuse, there will never be movement towards change. I will not allow the authors of racism in America to define nor validate change for me because those very authors are against the foundations of change. Irregardless of whom is racist or bigoted in America at this point, it has grown from a seed which was not planted by those whom were abused. They are not ignorant people, but rather well educated, and for those very perpetrators to attempt to act as though no one has a memory, i.e. blacks, native americans, latinos, women, gays, or that slavery and other atrocities never happened or to somehow believe that "it could not have been that bad", or even worse, that to deny it's existence or even to attempt to deny their voices to be heard without media tampering is foolishness that has already started to bite back at those very perpetrators. Remember you will be a minority soon and your existence as you know it will change forever based on what you have sown. What you reap, you shall surely sow.

In Whalen' s defense she did tell the dispatcher that it was possible the person lived there. Even on the TV show C0PS, there were instances where the officer was talented enough to ask the proper questions before escalating a situation. It should have never gotten to the point of confrontation. Besides, the Cambridge law is very lenient regarding what a citizen can express to a police officer. No matter what Mr. Gates said, Crowley should've let it roll off his back. Based on their law, Gates was under no obligation to be polite or cordial.

Whalen was misrepresented by Crowley. Had it not been for Crowley's deceit and incompetence, this powder keg would've never been ign/ted.

Read the article.

"Despite the trouble it caused her, Whalen said she would make the call again."

"I've had much reflection on that, and, yes, I would make the call," she said. "If you're a concerned citizen, you should do the right thing."

Yes I read what she was quoted as saying tn the article. However I also saw a news clip of her public statement and she appeared very distraught about the comments made about her after the incident. She said some of the comments made to her made her fear for her personal safety.

Ii is my guess that if she is faced with the same choice in the future, she will not be as quick to call 911 to report an incident. Of course we will never know if she does not make a call. Personally I am now wondering whether I would make a 911 call.

Lucia Whalen made the right call. If that is what she had actually seen that description would be fine.

It was officer Crowley who lied and put words in her mouth that she never said. He falsified his police report and should be held accountable for his actions. Though he never will.

Even if she HAD said there were "two black males", why exactly would it have mattered?

It wouldn't have mattered. It matters that Crowley says in the report that she did and that they had backpacks.http://www.thesmokinggun.com/archive/years/2009/0723092gates1.html

She says she didn't tell him that.

Remember, Sgt Crowley is not a rooky. He is an instructor in the Police Academy.
In an interview, he said he did not know Prof Gates but expected to receive some flax for the arrest.

As a Police Academy instructor, you would think Sgt Crowley would have been aware of MA appeal court decision last year overturning a conviction mirroring the arrest and charges that he assigned to Prof Gates.

So a seasoned Sgt/instructor in the police academy charging a noted Professor with charges that were recently overturned in his own state is troubling. I would expect instructors and supervisors of rookies to keep up with laws governing his profession.

What responsible officer would go running up on the porch then turn his back on the door to talk to someone if they were concerned about safety? Was that proper procedure? Remember Sgt Crowley is not a rooky.

On a radio interview shortly after the story broke, Sgt Crowley told the interviewer he was concerned about responding officers’ safety so he said he told the dispatcher to slow the cars. On the tape, you can hear him tell the dispatcher to “keep the cars rolling”. Another lie, Sgt Crowley has a creditability problem. He never expected that “keep the cars rolling” tape to be released.

Shortly after Sgt Crowley told the dispatcher the identity of Prof Gates, and apparently while Sgt Crowley was still inside the resident, a request was made to dispatch a “wagon”. Code: Come transport an arrestee. Sgt Crowley made up his mind to arrest Prof Gates inside the resident and waited until he came outside to execute the arrest. That “wagon” dispatch was a dead giveaway.

Information Overlooked

Since Ms Whalen reported two men going into the resident, why is there no report of the driver leaving? If the Sgt had taken the time to talk to Ms Whalen, he would have discovered the driver had left. Poor police procedure on Sgt Crowley.

What are correct police procedures on a Breaking and Entering? For safety purposes, they normally stop a safe distance and observe before entering. If Crowley was concerned for his own safety as he is trying to portray, this is a dead giveaway that he is lying.

I have been thinking about that for a couple of days. Something just doesn't add up there.

A black officer was with officer Crowley at the time they responded and he supported Sgt. Crowley's description of events - can you so easily overlook that?

I think Sgt Crowley was initially alone at scene until he called for the other officers.

There is another person missing in this case. The driver was there in the house. Who has interviewed that man? We have now heard from everyone but this man. Why is he silent?

Favorite    Flag as abusive Posted 09:55 PM on 07/29/2009

By all accounts he was gone by the time the police got there. This actually brings up questions.

If the driver left, the women would have known and presumably told the police. Something doesn't add up.

Obviously it's nothing new with Gates. He wrote on his college application "As always, whitey sits in judgement of me".

It was embarrassing to watch ....Judge Joe Brown was on the panel. He could not believe what the man was saying. Of course Larry Elder blamed Obama and Gates. Oh he also blamed Black people for their tendency to commit crimes. How much do they pay that man??????
