PATERSON, N.J. — Curfews might not be just for kids anymore in one northern New Jersey city.

Seeking to curb violence after a spate of deadly summer shootings, Paterson officials are considering an unusual ordinance that would prevent people of all ages from gathering outside in public late at night.

The measure could be the nation's first citywide, non-emergency curfew to include adults, several experts said.

"We're trying to think outside the box," said Mayor Jose Torres. "This was triggered predominantly by fear among city residents over the shootings that have been occurring this summer."

A 29-year-old Paterson man was gunned down in his car last week in the latest chapter of a tit-for-tat battle between rival groups, according to police who decline to describe them as gangs. The battle has generated community fear, even though overall shootings and violence remain low by historical standards.

Paterson, New Jersey's third-largest city at 147,000 people, has had six homicides and 30 shootings this year, according to city data. That compares with 13 homicides and 37 shootings for the same period of 2008.

The curfew would last for two months and bar people from loitering outside from midnight to 7 a.m. Violators would face up to a $2,000 fine and 90 days in jail. It would not apply to people in transit.

The measure was initially scheduled for consideration by the City Council on Monday, then Tuesday, and is now slated for Sept. 1. If the measure is approved, a second vote and a public hearing would still be needed before it goes into effect.

Legal challenges are a possibility, and Torres attributed the voting delays to the need to word the ordinance just right.

The American Civil Liberties Union has already successfully defeated several juvenile curfews in New Jersey courts, said Ed Barocas, legal director of the state ACLU. Adult curfews are usually associated with the imposition of martial law, which typically is restricted to emergencies, wartime or military occupation, according to the ACLU.

"An adult curfew is unprecedented in our state," Barocas said.

"It's just completely unheard of," said Jon Shane, a professor of policing administration at the John Jay College of Criminal Justice in New York City. "Not to mention being generally unconstitutional."

As unpalatable as the measure is among legal scholars, some Paterson residents are willing to consider anything that diminishes the violence.

Mohamed El Filali, a 44-year-old Paterson resident, said he fears the proposal will only drive illegal activity indoors.

"If it curtails crime I don't have an issue with it," said El Filali, outreach director for the Islamic Center of Passaic County. "It's a bold and ambitious gesture."

DaShaun "Jiwe" Morris, who describes himself as an inactive member of the Bloods street gang, said the ordinance is problematic because it clearly targets illegal gang activity and depends on the ability of police to distinguish between gang members and neighborhood residents sporting the same hairstyles and fashions.

"They're going to get a lot of the wrong people," said the 28-year-old Morris, who lives in nearby Newark. "It's an invitation to racial profiling."

New Orleans, New York City and Jersey City are among cities that have previously imposed curfews in designated areas, such as parks, but those bans were not citywide.

There are reasons that the Nazi/ Fascist mantra is growing and it has nothing to do w/ Obama's race. The long assault on the Constitution really came into focus with the patriot act and FISA and despite all of the "Hope" and "Change" propaganda of the election, it's become painfully obvious that Obama is cut from the same cloth as Bush.

These local assaults to our civil liberties are the proverbial straws piling on the camel's back. How does someone that was elected to represent "the people" have the stones to even suggest something like this?

Anyone who has studied law, knows that all of the maxims of law are based on two things - loss and injury. Laws were never meant to restrict the rights of of people that aren't causing injuries and that aren't causing other people loss (financial or otherwise). Does government really have the right to force a law abiding adult to get a "pass" in order to transport yourself out of the country (pass-port)? Do they get the right to force people to get vaccinated? Or force people to get health insurance? Or restrict people's freedom of movement - like this law would do?

This isn't the purpose of government - the only way to teach these people a lesson is to punish them by voting them all out of office. Get off of the dems vs repubs, left vs right game and vote out everyone who sees the law as a yoke to place

This is clearly counter to the the First Amendment of the US Constitution. I hope the ACLU will file suit.

The problems might be poor policing, poor government, and limited budgets.

Oh, yes, we want lower taxes, and if we loose all our rights in the process, so be it,we are still the freest country in the world.

The 95% of the people in this community who voted for Obama are the ones who are for this. Actually the gangsters and poverty pimps were against Obama. Did you miss the Black guys in the jeans and white t shirts that tried disrupting his speeches at campaign stops? There was a disconnect between the people of the communities striving for decent lives and the criminals and their protectors. That is why the so called Black leaders, Sharpton and jackson, did not fully support Obama until they were pushed by the people. Obama's message of personal responsibility and getting an education did not sit well with those people. Everyone talks about the prisons making money off of incarcerating people. But no one wants to criticize the people who make a living off perpetuating failure and feeding the prisons. Glamorizing these criminals, such as fifty cents, and allowing these people to continue to terrorize and recruit is all part of the problem

An epidemic is among us! Grown folk do not know how to act! HELLO! This is why there is now a curfew for adults. If an adult is out until 2 AM - can someone please tell me who is watching their kids - cause you know they have KIDS (PLURAL)? You guessed it: NOONE!
But the fact remains that all of these kids are running wild because their parents are out at 2 A.M. getting high and drunk, jacking up people's property and disturbing their neighbors who have a job to get to the next day! It's a damn shame that this has to be done, and actually needs to be done in many other places in the U.S.! Now the only thing left to do is hire and effectively train more law enforcement to start arresting and fining these fools!!! Good Luck & God Bless!!!!!

All this will do is push the violence from 12 am - 7 am to 7 am -12 am.

Curb violence now by increasing community awareness and anti-gang events citywide. Curb violence long term by increasing education funding and reform, and of course health care reform.

Healthy minds and bodies strengthens the possibility of turning out a productive human being.
