Under international maritime law and aviation law a distinction is made between crew and passengers that is similar to that of combatants and civilians under the laws of war. Under their own municipal law governments may extend the definition of who is a civilian to exclude those who work for the emergency services, because members of the emergency services may from time to time need additional legal powers over and above those usually available to ordinary citizens.

By legal definition, is a police officer considered an non-combatant since their under Homeland Security now or is Homeland Security legally defined as a military organization since they're significant to the war on terror?

Oh yeah... they photographed and insulted those detainees to death.

They were made to be the 'fall guys' for an official torture policy -- authorized in and ordered from the White House -- and that's wayyyy wrong. Those in positions of command bear the greatest responsibility. But there is no question that those convicted did in fact commit crimes of torture, murder-by-torture, and numerous lesser forms of criminal abuse. There is no defense for "just following orders."

There is in this case - CIA believed they were lawful orders - WH Counsel told them so. No CIA Agent or Officer should be held responsible for doing something they were ordered to do. In this particular instance - the agent went outside the boundaries and was punished.

Wrong. This was settled long, long ago. Have you been in a coma?

There are numerous rights which all persons (citizen or not) have by virtue of either a.) a Constitutional restraint or prohibition on government, or b.) an affirmative duty imposed by the Constitution on government.

The right of habeas corpus is just one such right... and the Geneva Conventions -- which the Supreme Court has held do, in fact, apply to detainees -- impose numerous affifmative duties upon the government as well as prohibitions regarding detainee treatment.
